• the extraction or operational area does not encroach within 100<br />

metres of the community, group of dwellings, individual<br />

dwellinghouse(s) or sensitive establishment concerned.<br />

The <strong>Garlaff</strong> development would not conflict with the provisions of<br />

Policy MIN26.<br />

(xxiv) Policy MIN27: Protection of areas of nature conservation interest from<br />

adverse effects of opencasting.<br />

(xxv) Policy MIN28: Protection of built heritage resources and the natural<br />

environment from adverse opencast proposals.<br />

(xxvi) Policies MIN29 and MIN30 : Protection of landscape and protection of<br />

tourism and recreational resources<br />

It is considered that the proposed development would not conflict<br />

with the above policies.<br />

(xxvii) Policy MIN31: Protection of landscape value and quality of areas from<br />

opencast developments.<br />

The Environmental Statement for the <strong>Garlaff</strong> extension<br />

incorporates a section on visual and landscape impacts. The<br />

Environmental Impact Assessment process has recognised that<br />

mitigation is required to avoid or reduce visual and landscape<br />

impacts.<br />

(xxviii) Policy MIN32 : Protection of water resources.<br />

It is not considered that the proposed development would conflict<br />

with this policy.<br />

(xxix) Policy MIN33: The <strong>Council</strong> will, if mindful to grant planning permission for<br />

an opencast coal development and if considered appropriate, request an<br />

applicant to enter into an agreement with the <strong>Council</strong> under Section 75 of the<br />

Town and Country Planning (Scotland) Act 1997 in order to regulate, by<br />

agreement, such matters as cannot adequately be regulated by the imposition of<br />

planning conditions.<br />

The applicant has indicated a willingness to enter into a Section 75<br />

Agreement in respect of the matters contained within Policy MIN33.<br />

(xxx) Policies MIN34 and MIN35: Mineral Trust Fund contributions encouraged<br />

in respect of opencast operations to be used for community improvements.<br />

Submission of appropriate information on coal extracted from site.
