37. The full value or ‘Earnest Money Deposit’ paid here with should be<br />

absolutely forfeited to the GSECL should I/We not deposit the full amount of<br />

specified security deposit.<br />

38. The contractor should give employment preferably to the persons who have lost<br />

their land for Wanakbori TPS.<br />

39. The work will have to be carried out in co ordination with other Agencies on the<br />

same site. On account of this, in case the contractor has to stop or delay his<br />

works for some time, he will not claim anything extra. only Corporation may<br />

consider to give suitable extension in time limit if necessary on such account.<br />

40. Any disputes arising out of the contract if not settled mutually, then the same<br />

shall be settled by Gujarat Public Work Arbitration Tribunal act-1992.<br />

41. The contractor has to submit the solvency certificate of Nationalized Bank of 20<br />

% of estimate cost and Experience certificates for the works done satisfactorily<br />

of same nature along with the tender other wise the tender is liable to be<br />

rejected.<br />

42. The GSECL reserves the right to terminate this contract at any time without<br />

assigning any reason whatsoever by giving a notice period of one month from<br />

the date of notice of termination of the contract .Contractor will not be entitled for<br />

any compensations/damage/losses, whatsoever on account of such termination<br />

of the contract.<br />
