Dear Mr President,<br />
We write <str<strong>on</strong>g>to</str<strong>on</strong>g> you regarding the decisi<strong>on</strong>s of the 2 March 2009 Envir<strong>on</strong>ment Council and the<br />
forthcoming decisi<strong>on</strong>s c<strong>on</strong>cerning <strong>GMOs</strong>, as we are very c<strong>on</strong>cerned about the manner in<br />
which you are trying <str<strong>on</strong>g>to</str<strong>on</strong>g> force through the authorisati<strong>on</strong> of highly c<strong>on</strong>troversial genetically<br />
modified plant varieties in the EU.<br />
Last M<strong>on</strong>day, the Council rejected by qualified majority the proposal <str<strong>on</strong>g>to</str<strong>on</strong>g> lift the bans in<br />
Hungary and Austria <strong>on</strong> the authorisati<strong>on</strong> of the GMO maize variety MON810. On two<br />
previous occasi<strong>on</strong>s (2006 and 2007), when asking for lifting of bans, you have received<br />
similar signals of cauti<strong>on</strong> from a majority of Member States based <strong>on</strong> qualified doubts about<br />
impacts of the cultivati<strong>on</strong> of GMO varieties <strong>on</strong> public health, biodiversity and farming.<br />
Instead of taking these c<strong>on</strong>cerns seriously, you have chosen <str<strong>on</strong>g>to</str<strong>on</strong>g> increase pressure in order <str<strong>on</strong>g>to</str<strong>on</strong>g><br />
promote the cultivati<strong>on</strong> of <strong>GMOs</strong> in the EU- against clear oppositi<strong>on</strong> from the majority of<br />
citizens, against the objecti<strong>on</strong>s of your own competent Commissi<strong>on</strong>er colleagues and against<br />
serious doubts repeatedly expressed by a substantial number of ministers of envir<strong>on</strong>ment of<br />
EU Member States.<br />
We are especially c<strong>on</strong>cerned about the "Sherpa group" that you initiated in order <str<strong>on</strong>g>to</str<strong>on</strong>g> hold<br />
informal discussi<strong>on</strong>s <strong>on</strong> how <str<strong>on</strong>g>to</str<strong>on</strong>g> accelerate GM approvals, which is highly untransparent and<br />
undemocratic. You claim as justificati<strong>on</strong> for your pro GMO-policies, that the ruling of the<br />
World Trade Organisati<strong>on</strong>'s dispute settlement panel against EU legislati<strong>on</strong> <strong>on</strong> <strong>GMOs</strong> had<br />
questi<strong>on</strong>ed the right of EU member states <str<strong>on</strong>g>to</str<strong>on</strong>g> ban <strong>GMOs</strong> - which simply is incorrect.<br />
In the light of these c<strong>on</strong>cerns, we would like <str<strong>on</strong>g>to</str<strong>on</strong>g> ask you <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure the implementati<strong>on</strong> of the<br />
Council decisi<strong>on</strong>s of December 2008, where, for example, Member States have unanimously<br />
underlined the right of Member States <str<strong>on</strong>g>to</str<strong>on</strong>g> prohibit GMO cultivati<strong>on</strong> <strong>on</strong> the grounds of specific<br />
regi<strong>on</strong>al c<strong>on</strong>diti<strong>on</strong>s. In order <str<strong>on</strong>g>to</str<strong>on</strong>g> underline our request, we will send a <str<strong>on</strong>g>letter</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g> the Presidents of<br />
the European Parliament political groups, asking them <str<strong>on</strong>g>to</str<strong>on</strong>g> support a moti<strong>on</strong> of censure against<br />
the Commissi<strong>on</strong> at the upcoming March II Plenary sessi<strong>on</strong> if the Commissi<strong>on</strong> does not initiate<br />
the measures, or agrees <str<strong>on</strong>g>to</str<strong>on</strong>g> a politically binding commitment of implementati<strong>on</strong> of the points<br />
menti<strong>on</strong>ed below.<br />
We hope that we will be able <str<strong>on</strong>g>to</str<strong>on</strong>g> work productively with you <strong>on</strong> this issue.<br />

The President of the Commissi<strong>on</strong> should have given by then a politically binding<br />
commitment of implementati<strong>on</strong> that:<br />
- No further authorisati<strong>on</strong>s of the cultivati<strong>on</strong> of <strong>GMOs</strong> will be proposed, including Bt11<br />
(Syngenta) and 1507 (Dup<strong>on</strong>t/ Pi<strong>on</strong>eer), Amflora (BASF) before these varieties fully comply<br />
with the criteria menti<strong>on</strong>ed below;<br />
- In the near future, a proposal for the l<strong>on</strong>g awaited risk assessment and, based <strong>on</strong> this, a<br />
proposal for approval or rejecti<strong>on</strong> of a new authorisati<strong>on</strong> of MON810 for cultivati<strong>on</strong> will be<br />
presented;<br />
- No measures against Member States shall be proposed forcing them <str<strong>on</strong>g>to</str<strong>on</strong>g> authorise <strong>GMOs</strong><br />
until the risk assessment menti<strong>on</strong>ed below has been carried out;<br />
- The Parliament shall be informed about advisory and lobbying activities of c<strong>on</strong>cerned<br />
industries including specifically Europabio and other relevant parties interested in the<br />
promoti<strong>on</strong> of GMO cultivati<strong>on</strong> in the EU.<br />
The President of the Commissi<strong>on</strong> shall initiate the following, or agree <str<strong>on</strong>g>to</str<strong>on</strong>g> a politically<br />
binding commitment <str<strong>on</strong>g>to</str<strong>on</strong>g> implement the December 2008 Council decisi<strong>on</strong>s including:<br />
- An appraisal and a comprehensive list of specific regi<strong>on</strong>al agr<strong>on</strong>omical and envir<strong>on</strong>mental<br />
c<strong>on</strong>diti<strong>on</strong>s with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> the potential cultivati<strong>on</strong> of a GMO within the European Uni<strong>on</strong>,<br />
including suggesti<strong>on</strong>s for specific risk management measures <str<strong>on</strong>g>to</str<strong>on</strong>g> protect them (see paragraphs<br />
1 and 16 of the Council C<strong>on</strong>clusi<strong>on</strong>s <strong>on</strong> <strong>GMOs</strong> of 4 Dec 2008);<br />
- The assessment of the l<strong>on</strong>g-term risks as part of any proposal for cultivati<strong>on</strong> (3). An<br />
overview, including a list, <strong>on</strong> the availability of independent studies (i.e. neither c<strong>on</strong>ducted<br />
nor financed by the applicant) <strong>on</strong> the risk and properties of a specific GMO as part of any<br />
proposal for cultivati<strong>on</strong> or use as food and feed (paragraphs 10, 11);<br />
- The assessment of envir<strong>on</strong>mental c<strong>on</strong>sequences of cultivati<strong>on</strong> of specific <strong>GMOs</strong> with<br />
respect <str<strong>on</strong>g>to</str<strong>on</strong>g> their own pesticidal properties as well as changed agricultural practices regarding<br />
the use of certain pesticides where <strong>GMOs</strong> are resistant <str<strong>on</strong>g>to</str<strong>on</strong>g> such pesticides in accordance with<br />
Directive 91/414 as part of any proposals for cultivati<strong>on</strong> (paragraph 4)<br />
- The assessment of socio-ec<strong>on</strong>omic implicati<strong>on</strong>s of proposed approvals for cultivati<strong>on</strong><br />
(paragraph 7);<br />
- The critical appraisal of the compositi<strong>on</strong> of the scientific committee of EFSA, reflecting the<br />
Council decisi<strong>on</strong> of December 2008;
