Rehabilitate-Own-and- Operate A contractual arrangement whereby an existing facility is turned over to the private sector to rehabilitate/refurbish and operate with no time limitation imposed on ownership. As long as the operator is not in violation <strong>of</strong> its franchise, it can continue to operate the facility in perpetuity. This <strong>Standard</strong> <strong>Form</strong> <strong>of</strong> <strong>Bidding</strong> <strong>Documents</strong>, in addition to Expression <strong>of</strong> Interest, includes the following: 1. Design/Drawings A. Notice <strong>for</strong> Expression <strong>of</strong> Interest 1. Notice <strong>for</strong> Expression <strong>of</strong> Interest provides guide lines to the Employer <strong>for</strong> inviting interested prospective bidders <strong>for</strong> prequalification or short listing as well as <strong>for</strong> calling <strong>of</strong> Bids. The Employer may modify as per specific conditions and requirements <strong>of</strong> the project. 2. The notice is meant <strong>for</strong> publication in the national/ international newspapers, as well as on PEC Website & PPRA Website in case <strong>of</strong> Federal Govt. procuring agencies and <strong>for</strong> other additional distribution to be decided by the Employer as notice <strong>for</strong> calling <strong>of</strong> Bids. All the blank spaces are to be filled in by the Employer. 3. The eligible bidders are defined in Clause IB.3 <strong>of</strong> Instructions to Bidders. 4. The notice should be published so as to give the prospective bidders sufficient time <strong>for</strong> preparation and submission <strong>of</strong> bids which may be up to 154 days depending on the size <strong>of</strong> the <strong>Works</strong>. 5. For the sale <strong>of</strong> <strong>Bidding</strong> <strong>Documents</strong> Price should be nominal so as to cover reproduction and mailing costs and to ensure that only bonafide bidders will apply. 6. The amount <strong>of</strong> Bid Security should be a lump sum figure ranging from 1% to 3% <strong>of</strong> the likely cost <strong>of</strong> the <strong>Works</strong> and should be the same as given at Sub Clause IB 20.1 <strong>of</strong> Instructions to Bidders. 7. Bid Reference Number should be the same everywhere as given in Notice <strong>for</strong> Expression <strong>of</strong> Interest and letters <strong>of</strong> Technical and Price Proposals. 8. The venue and time <strong>of</strong> receipt <strong>of</strong> bids and the venue and time <strong>of</strong> opening <strong>of</strong> bids are to be entered in the last paragraph <strong>of</strong> the Notice <strong>for</strong> Expression <strong>of</strong> Interest. However, date <strong>for</strong> the receipt and opening <strong>of</strong> bids shall be same. B. Instructions to Bidders 1. Instructions to Bidders provide the general introduction, details <strong>of</strong> the Project, guide lines <strong>for</strong> preparation <strong>of</strong> Bids, other relevant details on Concession, <strong>Bidding</strong> Procedure, Assessment <strong>of</strong> Bidders and in<strong>for</strong>mation that will be required to be provided by the Bidders etc. Any amendment in the text shall be made through <strong>Bidding</strong> Data wherein instructions to be followed have been inserted in italic which shall be deleted by the users after completing the <strong>Bidding</strong> Data. However, the users may modify/elaborate the contents <strong>of</strong> Clauses IB 42 to 44 only <strong>for</strong> making them the project specific. 2. Special Instructions to Bidders should be project specific with modifications and adaptations to Instructions to Bidders as appropriate. 3. The Employer shall prepare the documents listed at Serial Nos. 2, 4 to 8 and 14 <strong>of</strong> Sub-Clause IB 9.1 <strong>of</strong> Instructions to Bidders and incorporate the same <strong>for</strong> completion <strong>of</strong> the documents comprising the Bid. 4. For completion <strong>of</strong> documents at Serial No. 7 and 8 <strong>of</strong> Sub-Clause IB 9.1, detailed instructions are given at Para C below.
