Dear Friends of Iowa Legal Aid:<br />

The most enduring things are ideas. The<br />

ancient Athenians built wonderful buildings<br />

in which they cultivated sublime ideas of<br />

justice and democracy. Today, even their<br />

most beautiful buildings are ruins, but their<br />

beautiful ideas are alive and expanding. When<br />

we strive to extend access to the justice system<br />

to all people, we add to and strengthen a<br />

foundation laid down long ago. Such access<br />

serves to improve the legal system and the law,<br />

which will never be settled until it is settled in<br />

complete accord with justice.<br />

As President of the Iowa Legal Aid Board of Directors, I have come to be<br />

impressed by and to respect the commitment of the lawyers and support staff<br />

of Iowa Legal Aid. They have dedicated themselves to bringing quality legal<br />

services to the Iowans most in need of such services. The work done by these<br />

selfless people does not simply improve the legal system, but also improves<br />

society and thus the quality of life <strong>for</strong> all of us.<br />

Those of you who have made donations, volunteered, or both have indeed<br />

done something good <strong>for</strong> which you are entitled to and have the gratitude of<br />

others and <strong>for</strong> which you have the right to feel justly proud. Iowa Legal Aid<br />

is not simply staff and clients, but it is also the product of all who help it in its<br />

mission. When any of us put <strong>for</strong>th ef<strong>for</strong>ts on behalf of Iowa legal Aid, we help<br />

build the “<strong>Strong</strong> <strong>Foundation</strong>s <strong>for</strong> a <strong>Brighter</strong> <strong>Future</strong>.”<br />

Iowa Legal Aid has made, is making and will make a difference in the lives<br />

of its clients. It also makes a difference in the lives of the rest of us by helping<br />

us not only to remember that it is ideas like justice and democracy that really<br />

The year 2005 was a watershed year marked by a turnround in the financial<br />

outlook <strong>for</strong> Iowa Legal Aid. For the first time since 2002, program revenue<br />

increased, reversing a three-year trend of major losses of funding. This was<br />

achieved through Iowa Legal Aid’s partnership with the legal community,<br />

and the support of fellow providers of services to low-income Iowans<br />

and others dedicated to equal justice under law. The following are a few<br />

examples of how 2005 proved to be a year that promised a brighter future<br />

<strong>for</strong> Iowa Legal Aid.<br />

The Annual Campaign <strong>for</strong> Equal Justice raised over $450,000 through the<br />

support of hundreds of donors. Law firms, foundations and individuals joined together to provide the<br />

financial resources necessary to support legal assistance <strong>for</strong> the most vulnerable Iowans. One of the high<br />

points of the Campaign, was the annual celebration of this work at Equal Justice After Hours: A Tribute<br />

to Friends of Iowa Legal Aid and the accompanying induction of four remarkable Iowans into the Iowa<br />

Legal Aid Hall of Fame. Attorney General Tom Miller, Ge<strong>org</strong>e Wittgraf, Lois Eichacker, and Addison Parker<br />

were inducted at a ceremony attended by hundreds at the Hotel Fort Des Moines in March. Each is a true<br />

champion of justice, whose support <strong>for</strong> legal aid has paved the way <strong>for</strong> the work we are able to do today.<br />

Other funding increases, renewals, and new opportunities made the year promising as well. A bipartisan<br />

legislative ef<strong>for</strong>t resulted in reinstatement of a line item in the state budget as well as an<br />

increase in state funding <strong>for</strong> the Legal Services <strong>for</strong> Persons in Poverty Grants Program. At the same time,<br />

the Iowa Supreme Court’s Interest on Lawyers Trust Account Commission provided additional funding<br />

with the increased revenues available to them to distribute. Community foundations and United Ways<br />

across the state also increased their financial support.<br />

Financial support from all of these sources will help Iowa Legal Aid extend services to low-income<br />

individuals across the entire state of Iowa. As indicated more fully in the report, in 2005 Iowa Legal Aid<br />

closed over 16,300 cases, helping a projected 37,500 Iowans. While thousands were helped, many were<br />

also turned away. See the next page <strong>for</strong> more in<strong>for</strong>mation on America’s justice gap.<br />

The bottom line is that 2005 was a year that Iowa Legal Aid and its partners built a strong foundation<br />

<strong>for</strong> a brighter future where “equal justice under law” is more than a promise. Thanks to all of our<br />

partners and supporters who have come together to work <strong>for</strong> fairness in 2005. We look <strong>for</strong>ward, with<br />

optimism, to 2006.<br />

the JustIce gap<br />

Even though thousands of Iowans were served, thousands also were turned away. The Legal<br />

Services Corporation in Washington, D.C., conducted an analysis of legal needs entitled,<br />

“Documenting the Justice Gap in America - The Current Unmet Civil Legal Needs of Lowincome<br />

Americans.” The report found that <strong>for</strong> every client served by an LSC-funded program, at<br />

least one person who sought help was turned down because of insufficient resources. Only a very<br />

small percentage of the legal problems experienced by low-income people (one in five or less) are<br />

addressed with the assistance of a private attorney or a legal aid lawyer.<br />

Iowa Legal Aid participated in that study and determined that 900 people are turned away<br />

each month, with another 700 being provided less service than they need due to limited staff.<br />

While the increases in funding Iowa Legal Aid received in 2005 will not allow Iowa Legal Aid<br />

to address all of the unmet legal needs, it will help to address more of the critical problems that<br />

confront low-income people.<br />

prIMary areas of practIce<br />

Family Law<br />

The greatest demand <strong>for</strong> civil legal services from Iowa Legal Aid is in the area of family law. Domestic<br />

violence survivors and their children have priority <strong>for</strong> representation in protection orders, dissolution,<br />

custody and support proceedings. Abuse permeates every aspect of victims’ lives including employment,<br />

housing, health and education. Iowa Legal Aid is committed to providing all the comprehensive services<br />

our resources allow to respond to the heightened needs of survivors.<br />

Housing<br />

The home is recognized as a family’s place of safety and security – a cherished possession in America.<br />

Availability of safe, decent, accessible and af<strong>for</strong>dable housing is a benchmark of a just society. However,<br />

every day, low-income Iowa families are destabilized by unsafe housing, illegal evictions, discrimination,<br />

utility shut-offs and <strong>for</strong>eclosure. Iowa Legal Aid works diligently to preserve housing, prevent<br />

homelessness and protect the interests of vulnerable people against unfair housing practices.<br />

Consumer Protection<br />

Iowa Legal Aid works <strong>for</strong> fairness <strong>for</strong> Iowans who have become the victims of unfair and abusive loan<br />

practices. It does so by defending against illegal loans, challenging unconscionable contract provisions<br />

and holding accountable predatory lenders.<br />

Income Maintenance<br />

Iowa Legal Aid provides a range of services to help ensure that clients receive the income supports they<br />

need and are available to them under federal, state and local laws. Advocates ensure that low-income<br />

Iowans are fairly represented in situations where their benefits are improperly denied or discontinued.<br />

Health<br />

It is a priority <strong>for</strong> Iowa Legal Aid to secure or maintain access to health care <strong>for</strong> low-income Iowans. To<br />

that end, legal aid advocates represent individuals in administrative proceedings, state and federal court<br />

and other human service settings to assert the basic right of access to quality, attentive and reliable health<br />

care. Additionally, Iowa Legal Aid assists numerous clients with preparing advance directives to allow<br />

low-income people to have personal involvement in decisions about care at the end of life.<br />

ways Iowa LegaL aId Leverages addItIonaL assIstance to cLIents<br />

Volunteer Lawyers Projects<br />

Volunteer Lawyers Projects work with lawyers in all 99 counties who will take pro bono cases. Volunteer<br />

Lawyers Projects operated by Iowa Legal Aid (serving 97 counties), the Polk County Bar Association<br />

(serving Polk County) and the Scott County Bar Association (serving Scott County) have over 2,700<br />

attorneys throughout the state providing free legal assistance to low-income people. In 2005, volunteer<br />

lawyers donated time valued at nearly $1.9 million to help meet the needs of Iowans who would<br />

otherwise be without access to counsel.<br />

Using the Internet in Working <strong>for</strong> Fairness<br />

Iowa Legal Aid continues to expand the resources available to clients on the Iowa Legal Aid Website at<br />

iowalegalaid.<strong>org</strong>. A major expansion of the website was introduced with the launch of probono.net/iowa,<br />

providing services to attorneys and other professionals assisting clients through volunteer lawyers projects<br />

and other advocacy <strong>org</strong>anizations.<br />

2005 was a year of fIscaL progress<br />

For the first time since 2002, Iowa Legal Aid experienced an increase in revenue. Funding from the State<br />

of Iowa, IOLTA and several United Way agencies increased in 2005. Iowa Legal Aid was also awarded<br />

new grants from the United States Department of Justice Violence Against Women Act program and the<br />

Corporation <strong>for</strong> National and Community Service AmeriCorp Program. In addition, donations to the<br />

Annual Campaign <strong>for</strong> Equal Justice increased to $452,743.<br />

On the expense side, the hiring freeze adopted by the program’s board in 2003 continued into 2005 and<br />

was not lifted until mid-year when more was known about the status of state and IOLTA funding. The<br />

program continued to cut overhead costs with over 78% of total expenses devoted to personnel costs,<br />

which is reflective of the labor-intensive nature of providing legal services.<br />

Iowa Legal Aid recently concluded its annual fundraising campaign, the 2005 Campaign<br />

<strong>for</strong> Equal Justice. Lawyers, law firms and other supporters of equal access to justice<br />

contributed over $450,000 that will enable Iowa Legal Aid and volunteer attorneys<br />

to help low-income Iowans with critical legal issues involving abuse, housing, health<br />

care, utilities, public benefits and other basic necessities. More than $135,000 of<br />

the contributions were donated by Leadership Circle law firms, which distinguished<br />

J.J., a single mom, was<br />

living in an apartment<br />

with her 5 year old son and<br />

receiving a federal housing<br />

subsidy to assist with<br />

rental payments. While<br />

her landlord had been<br />

friendly at the beginning,<br />

he quickly began sexually<br />

harassing her after she<br />

entered into a lease. The<br />

landlord persisted in asking<br />

<strong>for</strong> sexual favors, and J.J.<br />

continually refused. Finally,<br />

the landlord became<br />

enraged by her rejections<br />

and refused to cash her<br />

rent check. He filed an<br />

eviction action <strong>for</strong> nonpayment<br />

of rent, which<br />

would also jeopardize<br />

her housing subsidy. J.J.<br />

came to Iowa Legal Aid<br />

asking <strong>for</strong> representation<br />

at the eviction hearing.<br />

Iowa Legal Aid agreed to<br />

represent her and helped<br />

to get the action dismissed.<br />

J.J. has since moved out of<br />

that abusive situation into<br />

a safer apartment and has<br />

been able to maintain her<br />

housing subsidy.


L.L. had been divorced<br />

<strong>for</strong> two years and shared<br />

joint custody of two<br />

children with her abusive<br />

ex-husband. He was<br />

named as the primary<br />

caretaker. L.L. had been<br />

paying child support even<br />

though, after the first year,<br />

the children lived with<br />

her and only visited their<br />

dad on weekends. One<br />

weekend during visitation,<br />

the children witnessed<br />

their father abuse his new<br />

fiancee, and one of the<br />

children was consequently<br />

injured. Iowa Legal Aid<br />

represented L.L. in a divorce<br />

modification. The judge<br />

ordered primary physical<br />

care to L.L., child support<br />

to be paid by the children’s<br />

father, and his visitation<br />

was restricted based on<br />

the continued abuse and<br />

danger to the children.<br />

S.J. was terminated<br />

from employment <strong>for</strong><br />

insubordination after<br />

her supervisor gave<br />

S.J. a verbal directive,<br />

which S.J. did not hear<br />

because of her hearing<br />

deficiency. After losing<br />

her job, S.J. applied<br />

<strong>for</strong> unemployment<br />

benefits and was denied<br />

benefits by Work<strong>for</strong>ce<br />

Development. S.J.<br />

appealed the decision<br />

and Iowa Legal Aid<br />

assisted with an<br />

administrative appeal.<br />

The Administrative Law<br />

Judge ruled in favor of<br />

S.J., finding there was no<br />

willful disregard of the<br />

employer’s interest. S.J.<br />

was awarded her muchneeded<br />

unemployment<br />

benefits.


B.L., a stay-at-home<br />

mother, was left to<br />

single parent when the<br />

father of her children<br />

died unexpectedly and<br />

violently in the family<br />

home. Un<strong>for</strong>tunately,<br />

he died with an unpaid<br />

utility bill in his name. The<br />

utility company, without<br />

authorization, transferred<br />

the bill to B.L.’s name and<br />

refused her service until<br />

the bill was paid. Iowa<br />

Legal Aid advocated on<br />

her behalf and succeeded<br />

in convincing the utility<br />

that its own regulations<br />

prohibited the transfer<br />

from the decedent to B.L.,<br />

who was never married<br />

to her children’s father.<br />

Eventually, the bill was<br />

put back in the decedent’s<br />

name to be paid by the<br />

estate, and B.L. was able to<br />

set up new housing with<br />

utilities <strong>for</strong> her family.<br />

but the clothes they were<br />

wearing. They properly<br />

requested assistance from<br />

FEMA <strong>for</strong> their losses and<br />

<strong>for</strong> emergency assistance.<br />

Through a series of<br />

administrative errors,<br />

FEMA failed to send F.K.<br />

her emergency assistance<br />

check. FEMA also denied<br />

“other needs assistance”<br />

<strong>for</strong> loss of property based<br />

on the agency’s wrongful<br />

assertion that the<br />

couple had not lost any<br />

property. An Iowa Legal<br />

Aid attorney assisted the<br />

couple with successfully<br />

appealing these errors,<br />

resulting in the couple<br />

getting the assistance they<br />

desperately needed.
