recent developments by UNCITRAL.
9.40am – 9.50am Delegate discussion
10.00am – 11.00am Breakout Sessions
11.00am – 11.15am Delegate discussion
A1 OVER regulated or laissez-faire?: Role of the regulators
Was the credit crisis caused by the financial sector being over regulated?
Why is it that the regulatory authorities could not prevent the credit crunch from
happening? Join this lively discussion led by market experts and suggest your
thoughts on how to develop a sound model for the future.
B1 Operational restructuring in the MENA region
In this session the findings of a survey carried out jointly by Hawkamah/World
Bank/ OECD/ and INSOL International will be revealed. The panellists will also
highlight issues that practitioners will encounter when carrying out restructurings
– cultural difficulties, issues related to ownership, sectorial and technical issues
such as lay offs, contract renegotiations, asset based financing and asset sales.
The impact of Shariah laws on restructurings in the region will also be covered.
C1 Effect of the credit crunch on personal insolvency
This will be an interactive session where the panellists will discuss a number of
current issues that are important to smaller practitioners – attitude of lenders to
the consumer market; how IPs are coping with the increase in personal insolvency
cases; and lessons that have been learnt. They will also invite the delegates to
make suggestions that the authorities can consider to make the existing system
more effective.
role of DIP funding: A case study
This session will be based on a case study that will highlight important valuation
issues such as the basis and assumptions of valuations and the importance of
value breaks.
B2 Corporate failure – Poor governance or flawed business plans?
Join this interesting session where the panellists will discuss some of the
major international collapses where fraud was not a cause of failure but the
failure stemming from mismanagement practices. Or could the causes be due
to poor business decisions? The session will also cover how legal and
regulatory oversight has affected management conduct during and after a
restructuring.
C2 Practice management in a recession – How have we coped?
The panellists are planning an interactive session with the delegates to learn
from each others experiences the difficulties of managing an IP practice in the
current economic climate, and find out how everyone has coped so far. Some of
the issues for discussion are – has the attitude of the lenders changed and how
practitioners have dealt with insolvency issues? Did practitioners recognise the
recession was coming and are they working harder for the same money due to
depressed asset values? IT and training issues will also be covered.
1.00pm – 2.15pm Networking Lunch, Pre-Function Area A & Water Terrace
2.15pm – 3.15pm Breakout Sessions
3.15pm – 3.30pm Delegate discussion
A3 Real estate in distress: Bankruptcy and restructuring cases
Leading experts dealing with international real estate collapses will speak to the
delegates on the implications of the world-wide downturn in real estate values.
How are banks, borrowers, and distressed investors handling the problems and
opportunities of the bubble bursting? Capital adequacy implications for lenders
for thus far failing to fully mark to market coming commercial real estate losses;
and comparative issues in prime/sub-prime real estate lending-particularly in
Spain, UK, China, Australia, and USA are some of the topics to be discussed.
B3 Ponzi schemes: A recent discovery?
What is a typical Ponzi scheme? How can Ponzi schemes endure for so long?
What safeguards can be introduced to avoid Ponzi schemes from re-occurring?
Should the regulators play a much greater role to ensure that appropriate
safeguards are implemented by banks? Can the liquidator “claw-back” dividends,
repaid capital and/or interest from the investors? How will the liquidator be
funded to claim “claw-backs” from the investors? Discuss and debate these
interesting issues with our panel of experts.
C3 Surgeon or undertaker? Dealing with turnaround and burial issues in a
credit crunch
This session will cover practical dilemmas that arise when dealing with an
insolvent company. Getting the client to take early advice; pressure on lenders to
give adequate consideration to small lends; the lack of sources of new finance;
the attitude of the tax authorities and the capabilities of small practitioners to
deal with turnarounds will be some of the discussion points.
3.30pm – 4.00pm Networking Coffee Break, Joharah Ballroom Foyer
4.00pm – 5.00pm Plenary – Storms of the recent past and managing future challenges
Our panel of experts will highlight and debate several controversial questions.
Has all the work in relation to cross-border protocols and law change been in
vain? Have we spent the last two years propping up lame duck businesses?
Do we confuse what insolvency and restructuring is? How do we deal with the
spiralling costs of restructuring and are the professions really providing value?
Should we have done anything differently?
