Note that <strong>the</strong> Buy American provision applies only to public works and public buildings. Private<br />

projects are exempt from <strong>the</strong> provision. If applicants <strong>for</strong>m a public‐private partnership (e.g., a<br />

corporation partnering with a local government), <strong>the</strong>y will be treated as “public” and subject to<br />

<strong>the</strong> Buy American provision. If <strong>the</strong> applicant wishes to use iron, steel, or manufactured goods<br />

that are not covered by <strong>the</strong> Secretaries’ waivers, it may request a limited waiver, on a case‐bycase<br />

basis, as part of its application. The applicant’s request must provide <strong>the</strong> legal justification<br />

<strong>for</strong> receiving <strong>the</strong> waiver. The items not currently subject to <strong>the</strong> waiver include fiber optic<br />

cables, coaxial cable, cell towers, and o<strong>the</strong>r facilities or goods that are produced in sufficient<br />

quantities in <strong>the</strong> United States.<br />

33. Choice of Service Provider: Does <strong>the</strong> project’s infrastructure and <strong>the</strong> company’s business<br />

plan allow more than one provider to serve end users in <strong>the</strong> proposed funded service area?<br />

The applicant should discuss whe<strong>the</strong>r more than one service provider will be able to offer<br />

services using <strong>the</strong> funded network facilities, and, if so, how such access would be facilitated<br />

from both a business and technical perspective. This question asks whe<strong>the</strong>r more than one<br />

service provider will be able to provide service to end users using <strong>the</strong> funded facilities. This<br />

answer should be consistent with <strong>the</strong> description of non‐discrimination and interconnect <strong>for</strong><br />
