1) Agent J. Becovitz advised me that he had located what appeared to be unlawful<br />

purchases <strong>of</strong> restricted use pesticides (RUPs) while performing an inspection at<br />

Advanced Turf Solutions. Agent Becovitz found a sale <strong>of</strong> “Bifenthrin Pro”, EPA<br />

Reg#51036-391, active ingredient bifenthrin, to Balmoral Country Club. The<br />

sale listed Cliff Helvie as the certified applicator at Balmoral. OISC database<br />

showed Helvie as the certified applicator at The Bridgewater Club.<br />

2) On 6/15/05, I visited The Bridgewater Club (case 2005-0399) and spoke with Mr.<br />

Helvie. He stated that he knows the superintendent <strong>of</strong> Balmoral. He and the<br />

superintendent, Eric Miller, are friends. Mr. Helvie stated that he has never given<br />

permission for anyone to use his license to purchase RUPs. He also stated that he<br />

does not supervise the use <strong>of</strong> RUPs at any golf course other than The Bridgewater<br />

Club. I obtained a written statement from Helvie.<br />

3) On 6/16/05, I visited the above location. Agent G. Saxton <strong>of</strong> OISC accompanied<br />

me. I explained the purpose <strong>of</strong> the visit to Eric Miller, the superintendent. Mr.<br />

Miller immediately admitted using his friend’s license number to purchase the<br />

RUPs. Mr. Miller stated that he did not think Mr. Helvie knew he (Miller) was<br />

using the number to purchase RUPs. Mr. Miller stated that he had been licensed<br />

previously, while working for another golf course. He also stated that he has a<br />

turf degree. Mr. Miller stated that he would immediately take steps to become<br />

certified again. Mr. Miller provided a written statement.<br />

4) It should be noted that Mr. Miller made the purchases in 2003 and 2004. He<br />

stated that he ceased in 2005, as he knew it was wrong and he did not want to<br />

compound the problem.<br />

DISPOSITION: Eric Miller was cited for two counts <strong>of</strong> violation <strong>of</strong> section 14(10) <strong>of</strong><br />

the <strong>Indiana</strong> Pesticide Use and Application Law for using a restricted use pesticide<br />

without having an applicator certification. A civil penalty in the amount <strong>of</strong> $500.00 was<br />

assessed for this violation. By rule, this violation is not subject to mitigation.<br />
