2.5 Competiti<strong>on</strong> rules<br />
In additi<strong>on</strong> to compliance with the provisi<strong>on</strong>s of the REACH Regulati<strong>on</strong>, potential registrants must ensure<br />
that they comply with other applicable rules and regulati<strong>on</strong>s. This applies in particular to competiti<strong>on</strong> rules,<br />
as specified in Recital 48 and in Article 25 (2) of the REACH Regulati<strong>on</strong> which refers to the noti<strong>on</strong> of restricti<strong>on</strong><br />
of certain market behaviours.<br />
Recital 48 specifies that “This Regulati<strong>on</strong> should be without prejudice to the full applicati<strong>on</strong> of the<br />
Community competiti<strong>on</strong> rules”.<br />
Article 25(2) menti<strong>on</strong>s that “(…) Registrants shall refrain from exchanging informati<strong>on</strong> c<strong>on</strong>cerning their<br />
market behaviour, in particular as regards producti<strong>on</strong> capacities, producti<strong>on</strong> or sales volumes, import<br />
volumes or market shares.”<br />
As discussed in secti<strong>on</strong> 7 of the present <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> Document, in the c<strong>on</strong>text of REACH and informati<strong>on</strong><br />
exchange, the most relevant provisi<strong>on</strong> is Article 101 of the Treaty <strong>on</strong> the Functi<strong>on</strong>ing of the European Uni<strong>on</strong><br />
(TFEU), which prohibits agreements and practices that restrict competiti<strong>on</strong>. For more details, please c<strong>on</strong>sult<br />
