SICK LEAVE BANK ENROLLMENT PERIOD<br />

Please inform all employees (CTA/Classified Unit, and CWA) of the enrollment period for their respective<br />

<strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong>s. Each school year the open enrollment window runs for the first twenty (20) days of<br />

each semester. The second enrollment period for the 2010 – 2011 school year is:<br />

– January 24 through February 18, 2011<br />

Any full-time member of a bargaining unit is eligible for membership in the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> after one (1)<br />

full year of employment provided they have accrued a minimum of four (4) days of unused sick leave. In<br />

addition, through agreement with the CTA/CU, administrators and other non-bargaining unit employees<br />

(such as school executive secretaries) are eligible to join the CTA/CU <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> under the same<br />

conditions.<br />

Forms for enrollment in the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong>s are available at each work site. Please ask your secretary to<br />

ensure that an interested employee receives the correct application form for their bargaining unit. If<br />

additional forms are needed, please obtain these from the publications center or go to the Personnel Web<br />

page through the <strong>School</strong> District’s web site and click on forms from the Personnel Web page,<br />

http://www.stlucie.k12.fl.us/departments/personnel/index.aspx<br />

Enclosed are notices to affected employees regarding the conditions for use of their <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong>.<br />

Please post these in a location easily accessible to your staff.<br />

The Personnel Department will verify applicants’ eligibility for enrollment in the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> as soon<br />

as the enrollment period ends. At that time the initial two (2) day contribution will be deducted by the<br />

payroll department.<br />

Annual Contribution of One (1) <strong>Sick</strong> Day<br />

As provided in the CWA contract, Article 27, each continuing member of the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> shall<br />

contribute one (1) day of his/her accrued sick leave to the bank at the end of the fall enrollment period.<br />

This donation will be taken in the month of October. This contribution of one (1) day per active member<br />

will serve to keep the bank healthy and available for use by its members.<br />

New Members for this school year will contribute their initial two (2) days and will not be assessed another<br />

day at this time.<br />

The second sick leave bank enrollment period for the 2010-2011 school year will be from January 24<br />

through February 18, 2011. Persons meeting the criteria and wishing to join at that time should obtain an<br />

enrollment form from the secretary at their site, the Personnel Department, the forms page of the Human<br />

PROCEDURES FOR USE OF THE SICK LEAVE BANK<br />

The following conditions as stated in the contract between the <strong>School</strong> <strong>Board</strong> of <strong>St</strong>. <strong>Lucie</strong> <strong>County</strong> and the Classroom<br />

Teachers Association & Classroom Teachers Association Classified Unit shall control the operation of the <strong>Sick</strong><br />

<strong>Leave</strong> <strong>Bank</strong> and the right of members of the unit to utilize the <strong>Bank</strong>:<br />

1. After a participant is a member of the pool for a minimum of sixty (60) calendar days and upon depletion of their<br />

sick and vacation leave, they shall be eligible to draw from the <strong>Bank</strong> with the following stipulations:<br />

a. Use of the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> is restricted to those members who have not used the <strong>Bank</strong> for at least three<br />

(3) years.<br />

b. Use of the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> will be restricted to no more than thirty (30) days per school year.<br />

c. Complete an “Application for Use of <strong>Sick</strong> <strong>Bank</strong>” form and turn into the Personnel office. Forms may be<br />

obtained by your school/work site Secretary or the Personnel Department web page.<br />

d. Complete and submit for approval a “Request/Reason for Absence”.<br />

2. An employee must have exhausted all individual accumulated sick and/or vacation leave and have been absent<br />

from employment without pay for four (4) consecutive working days as a consequence of the illness, accident or<br />

disability before being eligible for use of the <strong>Bank</strong>.<br />

3. A doctor’s statement certifying the illness and necessity for the protracted leave is required. Reapplication to the<br />

<strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> must be accompanied by a doctor’s certification that the current illness/injury is not the same or<br />

related to an illness/injury used for the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> benefits in the past.<br />

4. The employee shall not have to pay back in any manner the number of days used from the <strong>Bank</strong>.<br />

5. The use of the <strong>Bank</strong> shall be applicable to the illness, accident or injury of only the eligible employee. A<br />

member shall not use days from the <strong>Bank</strong> for maternity purposes and/or during the period they are receiving<br />

Workers Compensation.<br />

A participating employee who chooses to no longer participate in the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> must notify the Personnel<br />

Department using the “Withdraw Membership from <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong>” form – PER0161; they shall not be eligible to<br />

withdraw any sick leave already contributed to the <strong>Bank</strong>.<br />

Alleged abuse of the use of the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> shall be investigated by the Review committee and, on finding of<br />

wrong doing; the employee shall repay all of the sick leave credits drawn from the <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> and be subject to<br />

such other disciplinary action as determined by the <strong>Board</strong> to be appropriate.<br />

The <strong>Sick</strong> <strong>Leave</strong> <strong>Bank</strong> cannot be used retroactively.<br />

members of the unit to utilize the <strong>Bank</strong>:<br />

1. After a participant is a member of the pool for a minimum of sixty (60) days and upon depletion<br />

of their sick leave/vacation, they shall be eligible to draw days from the <strong>Bank</strong> not to exceed<br />

thirty (30) days in the course of a five (5) year employment period with the <strong>Board</strong>.<br />

2. An employee must have exhausted all individual accumulated sick leave and/or vacation and<br />

have been absent from employment without pay for four (4) consecutive working days as a<br />

consequence of the illness, accident or disability before eligible for use of the <strong>Bank</strong>.<br />
