(ii) Counter affidavit filed by the<br />

commission does not justify the action<br />

because neither the petitioner has committed<br />

any default nor has ever submitted a wrong<br />

report about his being Scheduled Tribe<br />

candid<strong>at</strong>e. Since it is pleaded consisting which<br />

has not been denied either by the commission<br />

or by the St<strong>at</strong>e th<strong>at</strong> the petitioner’s grand<br />

f<strong>at</strong>her had migr<strong>at</strong>ed to chhapra and thereafter<br />

to <strong>Allahabad</strong> and the certific<strong>at</strong>es obtained and<br />

used by the petitioner are valid in law, the<br />

result cannot be cancelled.<br />

(iii) Articles 341 and 342 <strong>of</strong> the<br />

Constitution <strong>of</strong> India as interpreted by the<br />

Hon’ble Supreme court, read with the<br />

provisions contained in the aforesaid St<strong>at</strong>e<br />

ACT I.S. U.P. PUBLIC services(Reserv<strong>at</strong>ion<br />

for SC/ST/OBC) act 1994,the petitioner<br />

cannot be denied appointment on having been<br />

declared successful by the commission.<br />

7. Reliance is being placed on four<br />

decisions reported in Action Committee Vs.<br />

U.O.I. (1994)5 S.C.C.,244, 1990(3)<br />

S.C.C.,130 M. Chandra Vs. Dean and others,<br />

Km. Manju Singh Vs. Dean and others,<br />

A.I.R., 1986 Gujr<strong>at</strong> and St<strong>at</strong>e <strong>of</strong> Gujr<strong>at</strong> Vs.<br />

R.L. P<strong>at</strong>el, A.I.R. 1992 Gujr<strong>at</strong> 42. It may be<br />

st<strong>at</strong>ed here th<strong>at</strong> the last case has no<br />

applic<strong>at</strong>ion to the facts <strong>of</strong> the case. The<br />

candid<strong>at</strong>e there was <strong>of</strong> Scheuled Tribe which<br />

was so described in Nagar Haveli as well as in<br />

Gujr<strong>at</strong>. The other 3 decisions required<br />

consider<strong>at</strong>ion.<br />

8. Sri Shiv Kumar Singh,. Learned<br />

counsel for the commission also placed<br />

reliance on the language <strong>of</strong> Articles 341 and<br />

342 <strong>of</strong> the Constitution <strong>of</strong> India and further<br />

argued th<strong>at</strong> except the St<strong>at</strong>e Government, no<br />

one can increase the list <strong>of</strong> either Scheduled<br />

Caste/Scheduled Tribes or Backward Castes<br />

and ,therefore, the present <strong>at</strong>tempt <strong>of</strong> the<br />

petitioner to include himself in the list <strong>of</strong> the<br />

Scheduled Tribe in St<strong>at</strong>e <strong>of</strong> U.P. just because<br />

he happens to belong to a Scheduled Tribe <strong>of</strong><br />

Assam is an <strong>at</strong>tempt in futility and the court<br />

also could not grant any relief to the petitioner<br />

th<strong>at</strong> score. He further contended th<strong>at</strong> in so far<br />

as the certific<strong>at</strong>e issued by the District<br />

Authorities <strong>of</strong> <strong>Allahabad</strong> to the petitioner is<br />

concerned, it will, <strong>at</strong> best come to indic<strong>at</strong>e<br />

th<strong>at</strong> the petitioner belongs to a Scheduled<br />

Tribe in Assam. Th<strong>at</strong> will, according to Sri<br />

Shiv Kumar Singh not entitle the petitioner to<br />

claim the privileges <strong>of</strong> reserv<strong>at</strong>ion to<br />

Scheduled Tribe candid<strong>at</strong>es in U.P.<br />

9. Lastly, he contended th<strong>at</strong> the petitioner<br />

is not qualified for the reason th<strong>at</strong> the Tribe<br />

which he claims to be Scheduled Tribe in<br />

Assam is not included in the recognised list in<br />

the St<strong>at</strong>e <strong>of</strong> U.P. and, therefore, placing<br />

reliance on the aforesaid Supreme <strong>Court</strong><br />

decisions, he said th<strong>at</strong> the writ petition should<br />

be dismissed.<br />

10. Sri S.C. Rai, learned Additional Chief<br />

Standing Counsel has said th<strong>at</strong> the petitioner’s<br />

S.T. certific<strong>at</strong>e has been genuinely issued by<br />

the St<strong>at</strong>e <strong>of</strong>ficials on the basis <strong>of</strong> the<br />

documents which were produced by the<br />

petitioner and were available before the<br />

<strong>of</strong>ficials concerned. He further pointed out<br />

th<strong>at</strong> the District Magistr<strong>at</strong>e, <strong>Allahabad</strong> in his<br />

turn has gone to the extreme possible extent to<br />

find out whether or not the petitioner belongs<br />

to a Scheduled Tribe or not and the findings<br />

conveyed through the averments <strong>of</strong> the<br />

affidavit <strong>of</strong> Shri Alok Tandon, the District<br />

Magistr<strong>at</strong>e <strong>Allahabad</strong> indic<strong>at</strong>es th<strong>at</strong> the<br />

petitioner belong to Scheduled Tribe. Sri Rai,<br />

therefore contended th<strong>at</strong> whether the<br />

petitioner rightly applied for appearing <strong>at</strong> the<br />

said examin<strong>at</strong>ion has to be adjudged on the<br />

aforesaid factual position while it is true th<strong>at</strong><br />

the petitioner does not belong to Scheduled<br />

Tribe recognised as such by the St<strong>at</strong>e<br />

Government.<br />

11. In the instant case, no search for the<br />

principles behind carving out reserv<strong>at</strong>ion for<br />

Scheduled Castes, Scheduled Tribes or<br />

Backward Castes is involved. It is a simple<br />

issue <strong>of</strong> finding out whether or not the
