petitioner should be extended the benefit <strong>of</strong><br />

having been successful <strong>at</strong> the main P.C.S.<br />

examin<strong>at</strong>ion as Scheduled Tribe candid<strong>at</strong>e.<br />

The facts narr<strong>at</strong>ed above leave no manner <strong>of</strong><br />

doubt th<strong>at</strong> there was no falsehood or mis<br />

represent<strong>at</strong>ion in the action <strong>of</strong> the petitioner<br />

which prima facie showed th<strong>at</strong> he belongs to a<br />

Scheduled Tribe known as “NAGA” .The<br />

petitioner was permitted to appear <strong>at</strong> the<br />

examin<strong>at</strong>ion by the commission. He has<br />

successfully passed the written examin<strong>at</strong>ion in<br />

the mains P.C.S. examin<strong>at</strong>ion in the year<br />

1994. He successfully encountered the<br />

interview <strong>at</strong> the commission and was declared<br />

as a selected candid<strong>at</strong>e belonging to<br />

Scheduled Tribe c<strong>at</strong>egory. After this had<br />

happened, wisdom dawned on the<br />

commission to find out whether “NAGA”<br />

c<strong>at</strong>egory <strong>of</strong> Tribe is or is not a Scheduled<br />

Tribe in the St<strong>at</strong>e <strong>of</strong> U.P. No doubt, “NAGA”<br />

Tribe is not included in the list <strong>of</strong> Scheduled<br />

Tribes in St<strong>at</strong>e <strong>of</strong> U.P. but was there any<br />

provision which prohibited the petitioner from<br />

applying for the service on the strength <strong>of</strong> the<br />

aforesaid candid<strong>at</strong>es obtained from the<br />

collector <strong>Allahabad</strong>, which was based on the<br />

certific<strong>at</strong>es issued by the relevant authorities<br />

<strong>of</strong> Nagaland The answer shall have to be th<strong>at</strong><br />

the petitioner’s claim <strong>of</strong> Scheduled Tribe was<br />

based on genuinely issued certific<strong>at</strong>es and<br />

there was nothing which persevered the<br />

petitioner being selected if successful. In this<br />

connection, some provisions <strong>of</strong> the aforesaid<br />

U.P. Public Services (Reserv<strong>at</strong>ion for<br />

SC/ST/BC) Act, 1994 shall have to be<br />

considered and then the r<strong>at</strong>ion laid down by<br />

the Hon’ble Supreme court in the aforesaid<br />

two decisions has to be applied to one facts <strong>of</strong><br />

the present case.<br />

12. Section 2(b),” other backward classes<br />

<strong>of</strong> citizens as those specified in schedule –I<br />

appended to the Act and this all about the<br />

definition <strong>of</strong> Scheduled Castes, Scheduled<br />

Tribes and Backward classes. Section-9 says”<br />

For the purposes <strong>of</strong> reserv<strong>at</strong>ion provided<br />

under this Act, caste certific<strong>at</strong>e shall be issued<br />

by such authority or <strong>of</strong>ficer in such manner<br />

and form as the St<strong>at</strong>e Government may, by<br />

order, provide” Through Section-8, it is<br />

provided th<strong>at</strong> the St<strong>at</strong>e Government may grant<br />

such concessions in respect <strong>of</strong> fees for the<br />

candid<strong>at</strong>es mentioned in sub-section 1 <strong>of</strong><br />

section-3. It has been provided in Section 3(1)<br />

th<strong>at</strong> in public services and posts, there shall be<br />

reserved <strong>at</strong> the stage <strong>of</strong> direct recruitment,<br />

according to the roster referred to in subsection<br />

(5) there <strong>of</strong>;<br />

(a) in the case <strong>of</strong> Scheduled Castes 21%<br />

(b) in the case <strong>of</strong> Scheduled Tribes 2%<br />

(c) in the case <strong>of</strong> other backward<br />

classes <strong>of</strong> citizens 27%<br />

13. It has been provided th<strong>at</strong> the<br />

reserv<strong>at</strong>ion under clause © shall not apply to<br />

the c<strong>at</strong>egory <strong>of</strong> other backward classes <strong>of</strong><br />

citizens specified in Schedule-II. There are<br />

only two schedule in the Act. Schedule-1<br />

notifying certain castes under Section 2© to<br />

be included as OBC and Schedule-II describes<br />

the prohibitions <strong>of</strong> certain candid<strong>at</strong>es who will<br />

not get the benefit <strong>of</strong> reserv<strong>at</strong>ion. Th<strong>at</strong> is all<br />

about the reserv<strong>at</strong>ion in public services<br />

concering candid<strong>at</strong>es <strong>of</strong> Scheduled Tribe in<br />

the St<strong>at</strong>e <strong>of</strong> U.P<br />

Coming now to the decision <strong>of</strong> the<br />

Hon’ble Supreme <strong>Court</strong> in the case <strong>of</strong> M.<br />

Chandra (Supra),it should be <strong>at</strong> once st<strong>at</strong>ed<br />

th<strong>at</strong> the said decision was considered in detail<br />

by the Hon’ble Supreme <strong>Court</strong> in the l<strong>at</strong>er<br />

decision <strong>of</strong> Action committee (Supra),<br />

consequently, the r<strong>at</strong>ion in the l<strong>at</strong>ter case shall<br />

have to be applied to the facts <strong>of</strong> the present<br />

case.<br />

14. It has been held on a reading <strong>of</strong> the<br />

language used under Articles 341 and 342 <strong>of</strong><br />

the Constitution <strong>of</strong> India th<strong>at</strong> the Parliament is<br />

empowered to include or exclude by law from<br />

the list <strong>of</strong> Scheduled Castes and Scheduled<br />

Tribe specified in the notific<strong>at</strong>ion issued<br />

under clauses- I there<strong>of</strong>. Article 342<br />

specifically deals with any tribe or tribal<br />

community in the same fashion as scheduled
