Firstly, in terms of the MPRDA, the holder of a prospecting or mining
right is responsible for any environmental damage, pollution or
ecological degradation arising from the prospecting or mining
operations and occurring inside and outside the area to which the right
relates. Liability for environmental damage, pollution or degradation
continues until such time as a closure certificate is issued by the
Minister of Mineral Resources.
Further, directors of a company or members of a close corporation are
jointly and severally liable for any unacceptable impact on the
environment irrespective of whether such damage was done
intentionally or through negligence.
