According to the Home Minister, a large number of IPC cases registered in the state are for petty crimes like negligent and rash driving and unlawful assembly and obstruction of public roads which are highly incident in the state of Kerala, known for its political vibrancy. The Kochi Police has issued a table which shows that out of 25,715 IPC cases registered in Kochi, 24,227 were for rash driving, traffic obstruction, traffic accidents etc. Compared to this, Delhi has registered only 7093 cases under these heads. Kochi Police has also issued a table which shows cities like Delhi, Mumbai, Chennai, Kolkata and Bengaluru reporting much higher numbers compared to Kochi when it came to violent crimes like murder, rape, kidnapping, theft etc. 18 There are many reasons for the high rate of crime in the state; the first and the foremost being literacy level. High degree of awareness among citizens, about their rights and privileges make them fight for the cases in court or at least register the cases in police stations. Kerala is a popular tourist destination and many tourists come to Kerala through out the year. The annual count of foreign tourists to Kerala during the year 2011 is 7,32,985. It shows an increase of 11.18 % over the previous year’s figure of 6,59,265. Domestic tourist arrival to Kerala during the year 2011 is 93,81,455. It shows an increase of 9.15 % over the previous year’s figure of 85,95,075. 19 Incidence of crimes committed against tourist women is very high in Trivandrum compared to many cities in other states. State Crime Record Bureau statistics show high rate of incidence of crimes against women in Malappuram, followed by rural Trivandrum. Ernakulam city registered lowest crime rate in Kerala, followed by Pathanamthitta. As far as rape cases are concerned, Malappuram topped with 70 cases, followed by rural Trivandrum with 66 cases. The Hindu reports: “Crime statistics with the Kozhikode police show that instances of offences committed against women are reported more from the rural areas than from the city. Senior police officials say that while this trend shows a rise in rural Kozhikode, it also reflects that citizens are approaching the police to officially lodge complaints when it comes to crime in which women are the victims. A total of 452 cases of crime against women were reported with the Kozhikode rural police while only 392 cases were filed with the city police as on September 2012. The highest number of cases is under the 16
head ‘cruelty by husbands and relatives.’ A total of 236 cases of cruelty were lodged by women with the rural police against their own husbands and family, while 114 were filed with the city police. These statistics correspond with those released by the Kerala State Women’s Commission, which shows that in cases of crime against women, the aggressor is often a relative, and crime is usually committed at home. Of the 309 cases received from Kozhikode by the commission in 2011, 152 deal with domestic violence and harassment at home. Again in 2012, of the 253 cases received till November 30, 94 relate to violence at home. Incidentally, the police statistics clock zero cases of dowry deaths in rural and city police stations. Again, while 107 instances of molestation were reported with the rural police stations in the district, 73 were reported with the Kozhikode city police. While 29 cases of rape were reported from the rural side, only 12 complaints found its way into the case diaries of the city police. Here again, the police statistics are similar to the Women Commission’s. While 50 cases of heinous offences committed against women were filed in 2011, 37 were filed in 2012. These offences include rape, attempt to rape, threat to life, cases of suspicious deaths of women and battery.” 20 Kerala is a rapidly changing society and with the present consumerist culture, the value system is being eroded, which has resulted in a cancerous growth in Kerala’s once golden culture. In nearly every home, there is purposeful, ostentatious display of consumerism, paving the way for an unhappy, highly criminalized society with increasing levels of sexual harassment and violence against women. Domestic violence is a menace in Kerala. Assertion of one's individuality and rising awareness among women is the main reason for this. Domestic violence is rarely reported. One way to measure domestic violence is by looking at the divorce rate in Kerala. The 18 family courts of the State had a total of 38,231 cases filed last year. Thiruvananthapuram and Kollam districts account for nearly one-third of the total cases. A total of 10,243 cases have been filed in the four family courts in the two districts. Violence against women can be reduced by the collective effort of law enforcing agents, the public and women themselves. The present study is to search for answers and to find solutions. The main question which comes to the mind is as to why the incidence of crime against women is very high in Kerala inspite of being a 17
