UK Chlorinated Solvent Working Group Solvent Emissions Regulations for Surface Cleaning with Chlorinated Solvents Purpose As a result of the new Solvent Emissions Regulations 2004 1 (the “SED Regulations”), which came into force on 20 January 2004, a number of manufacturers and suppliers of chlorinated solvents and cleaning equipment using chlorinated solvents who have been involved with the consultation process, have agreed to issue the following simplified interpretation of the SED Regulations. This interpretation is intended to assist users of chlorinated solvents for surface cleaning in compliance with this complex regulation. This information should not be used without reference to the regulations 1 and guidance issued by DEFRA 2,3,4,5 or similar regulations in Scotland. 6,7,8 Actions for surface cleaning users: Trichloroethylene is not banned by the SED Regulations – however, because of its Category 2 Carcinogen classification, it needs to be managed so as to minimise exposure and emissions Below a 1 te/yr Consumption threshold, as defined by the SED Regulations, the SER does not apply, and therefore achievement of Emission Limit Values (ELVs) and substitution is not required. 9 Trichloroethylene (R45 risk phrase solvent) If you are currently unregulated and using > 1 te/yr trichloroethylene you must apply to your local authority for a variation notice and submit a proposed substitution plan by 20 May 2004. If you are already regulated and using > 1 te/yr trichloroethylene your substitution plan should have been submitted by 22 March 2003. According to DEFRA guidance 2 users must demonstrate that they have taken steps to substitute risk phrase substances like trichloroethylene in the shortest possible time. In determining the shortest possible time the user “will need to justify their timetable taking into account of the technical or economic feasibility of the substitution. In identifying the use of substitutes, operators and regulators must consider: fitness for use, potential effects on human health, potential effects on the environment, and the economic consequence, in particular the costs and benefits of the options available.” If substitution is not feasible then the Emission Limit Values of the SED Regulations need to be achieved within the shortest possible time and no later than 31 October 2007.
