REALTOR ® Tsunami Relief Project

The NATIONAL ASSOCIATION OF 

REALTORS®, 2005 NAR President Al 

Mansell announced on Jan. 4 the creation of 

the REALTOR® Tsunami Relief Project to 

aid the victims of the Dec. 26 earthquake 

and tsunami that has devastated dozens of 

countries in Southeast Asia and resulted in 

hundreds of thousands of casualties. 

In an effort to help rebuild the lives of the 

victims of December’s devastating tsunami 

in Southeast Asia, the monies raised by for 

the Realtor® Tsunami Relief Project will go 

toward the construction of “REALTOR® 

Villages” in the hard-hit countries of India, 

Thailand, Sri Lanka, and the Sumatra region 

of Indonesia, through a partnership with 

Habitat for Humanity International. 

NAR and Habitat have set a goal to build 

1,000 core housing units. To cover the full 

cost, NAR has set a $1 million goal for the 

REALTOR® Tsunami Relief Project. All 

contributions to the REALTOR® Tsunami 

Relief Project will be donated to Habitat to 

construct the REALTOR® Villages. 

The Association is reporting the receipt of 

more than 1,360 donations totaling $245,000 

as of Jan. 12. These contributions will be 

combined with NAR’s initial donation of 

$50,000 and all incoming gifts to the 

REALTOR® Tsunami Relief Project. 

During the January LIBOR Board of 

Directors meeting held January 19th, 

Directors approved the creation of a LIBOR 

Disaster Relief Fund. LIBOR President, 

Marian Fraker-Gutin, said that “The

the Multiple Listing Service of Long Island, 

Inc. (MLSLI) in 2004 have surpassed the 

previous record set in 2003, according to 

the West Babylon based organization. 

There were a total of 32,421 existinghome 

sales in 2004, up 13.4 percent from 

the previous record of 28,583 in 2003. 

The year ended with a reported sales 

volume of 14.4 billion for Queens, 

Nassau, and Suffolk counties combined, 

reflecting a 27 percent increase over the 

11.3 billion reported in December 2003. 

Housing inventory as reported by 

MLSLI was 8 percent higher at the end 

of December 2004 as compared to 

December 2003, with 13,398 available 

residential properties throughout Long 

Island, which also includes Queens. 

The average existing-home price for 

Long Island as reported by MLSLI for 

Directors of LIBOR felt it prudent to establish 

a general Disaster Relief Fund to streamline 

the process of approving contributions in 

the event of emergencies such as the recent

Co-Op Board Disclosure Law Will Prevent 

Discrimination 



Cooperative apartment corporations 

currently are not required to inform 

prospective purchasers of the reasons for 

their rejection. As a result, many prospective 

buyers are discriminatorily rejected. 

By requiring cooperative apartment corporations 

to provide a statement of reasons 

— this legislation would serve to 

reduce the incidence of such rejections. 

LIBOR and NYSAR are working to see 

that proposed legislation to eliminate these 

unfair rejections advances. LIBOR’s 

Common Interest Ownership Committee 

Chair Barbara Ford has made this a priority 

on the state level. If this Co-Op Board 

Disclosure bill is enacted, a Co-Op apartment 

corporation will not be able to create 

after the fact justifications when a rejected 

purchaser challenges the cooperation’s 

reasons for refusing to permit a sale. 

We are hopeful that this legislation will 

be reintroduced shortly in both the New 

York State Senate and the Assembly. 

LIBOR and New York City Councilman 

Hiram Monserrate (D-Corona) are working 

jointly to promote this legislation in 

the New York City Council as well. 

Suffolk County Legislator Concerned Over 

Absentee Landlords 



Suffolk County Legislator Peter 

O’Leary (R-Shirley) has a growing concern 

that absentee landlords are tarnishing 

our communities by neglecting the properties 

that they rent. 

According to Legislator O’Leary, “Many 

absentee landlords fail to monitor activity on 

their property. Landlords are not concerned 

what happens on their property as long as it 

does not result in a loss of revenue for them.” 

The areas of concern for landlords are 

the failure to obey state, county and town 

laws such as town rental permit laws, 

town waste management ordinances, and 

county health codes. 

Additionally, it is this failure to maintain 

the exterior of the property that worries 

O’Leary and many of his fellow lawmakers. 

O’Leary has already made it 

known that he intends to introduce legislation 

to require minimum maintenance 

requirements on these properties. With a 

law in place — lawmakers will be able to 

crack down on absentee landlords who 

fail to maintain these standards.

As I start 2005 as your 

President I want to thank all 

the members who have volunteered 

(an unprecedented 

number) for committees for 

the benefit of our 23,000 

member organization. I, 

together with the Executive 

Committee, have the following 

plans for 2005, 

some of which are already 

in the working stages. 

Increasing and upgrading 

the Professional Standards 

Committee with additional 

Realtors®, so as to increase 

education among our members 

and help facilitate 

cases. In the Legislative 

Committee, which includes 

RPAC, increasing lobbying 

efforts at our Federal, State 

and Local levels and contact 

teams. Meetings are already under way to 

continue our fight for “The Commission 

Escrow Act.” Furthermore, we need to 

defeat any legislation that imposes sanctions 

and fines on our members for their 

client’s homes that are not compliant with 

local zoning laws and regulations. 

The Education Committee this year will 

include more member services such as 

health insurance, long term insurance,

From Where I Sit

Each year we try to take a look at our 

facilities to see if we are making the best 

use of what we have and whether what we 

have is adequate for our members’ needs. 

The overwhelming success of our 

Realtor Service Center in West Babylon 

is one example of looking ahead and 

revising our use of resources. It provides 

Realtors with a “state of the art” facility 

for classes and programs which enables 

our members to enhance their capabilities. 

The heavy usage 

required us to rethink our 

staffing as well as our 

hours of operation. 

At the Queens Realtor 

Service Center we’re also 

experiencing heavy usage 

as our Queens members 

realize that it not only provides 

great offerings but 

great parking as well. We 

had to add a part timer to 

our staff to help with the 

volume. If space adjacent to our current 

classrooms becomes available, we would 

definitely consider adding to what we 

have so we could handle larger classes. 

In Riverhead, there’s another Realtor 

Service Center located 75 miles from 

Queens toward the eastern end of Long 

Island. We’ve also seen an increase in the 

usage of this facility but not to the same 

extent as Queens. In Suffolk the membership 

base is more spread out and less 

concentrated which effects usage. 

In our Headquarters Realtor Building, 

“Growth greatly 

increased the 

demands on our 

staff and 

facilities.” 

ANNETTES REAL ESTATE 

we are going to be undertaking some renovations 

primarily on the first floor. We 

are going to relocate and centralize the 

Professional Development Department 

there to enhance interaction with the 

Service Center next door. 

The General Education and Computer 

Education and Training staff will occupy 

the redesigned space. 

In addition, we will be renovating the 

entry and reception foyer to reflect the 

more efficient set up and 

décor of the Service Center. 

We are also planning to 

install an upgraded, integrated 

security system that 

will cover both buildings 

and better protect our personnel 

and material assets. 

Our goal for the second 

floor is to centralize the 

Information Systems staff 

and provide them with 

needed workspace. This 

will occasion the relocation of some current 

staff to other areas with the end result being 

the refining of the work environment for 

Communications/Marketing, Government 

Affairs and Professional Standards. 

The growth of the Board and the 

Multiple Listing Service has greatly 

increased the demands on our staff and 

facilities. Our aim is to provide the 

appropriate tools, facilities and staffing 

so we can maintain and increase the quality 

of our response time and our services 

for our members.

I am honored and humbled by the trust

your 2005 MLS President. I am excited as 

I look forward to this year in preparing to 

help steer this great organization. Last 

year was a great year in real estate and I 

am confident that 2005 will be a very 

prosperous year as well. 

I would like to take this time to thank 

Jane Salamon for an outstanding job as our 

2004 MLS President. It is comforting to 

know that Jane will continue to contribute 

to our Executive committee, as well as

Finding Properties Closed Between 

1991 and 2002 

To find a property that closed through 

MLS between the years 1991 and 2002, 

you must search through the archive that 

is separate from the current database. 

TIP: This can be a great way to find a 

quick property photo to use until you are 

able to get new photos uploaded. 

Using QUICK SEARCH, follow these 

steps: 

1. Select Residential, Unavailable 

2. Click on the ARCHIVE check box 

that appears below MLS/Private. 

3. Click on CONTINUE 

4. Choose a TOWN (you are limited to 

ONE town when searching in the archive) 

5. Enter a Title Date range OR a Street 

Name to further narrow your search. 

Other criteria can be used as well. Keep 

in mind that the archive contains closings 

all the way back to 1991, so you will 

want to limit your search with additional 

criteria.

Web Stats To Big To Ignore 

The MLS Advertising Committee is 

underway developing the 2005 Ad 

Campaign that will be geared this year 

toward driving traffic to the MLS website 

- MLSLI.com˙. The site currently averages 

close to 14,000 daily user sessions 

and receives an estimated 17 million hits 

a month. The site continues to grow in 

popularity as we have seen a measurable 

increase of over 30% in visitor sessions 

over the past year. 

In a recent study by NAR, they reported 

that over half of buyers (53 percent) used 

the Internet frequently during their search, 

and 90 percent reported using a real estate 

agent. Interestingly, Internet searchers 

were more likely to use a real estate agent 

than those who did not use the Internet to 

find a home. Ultimately, 38 percent of 

homebuyers first found out about the 

home they purchased through an agent. 

Closed Listings Now Retained For 

25 Months 

Effective January 9th, closed listings 

will no longer be moved to the Archived 

database on Stratus after 18 months. 

Instead, they will remain in the 

Unavailable database on Stratus for 25 

months. At the end of that time, they 

will be moved to the Archives. 

Since our current Unavailable database, 

only contains 18 months worth of 

Closed listings, it will take another 7 

months until the Closed listings grow to 

25 months. After that time, one advantage 

of this change will be that you can 

compare the current 12 months Closed to 

the prior 12 months. 

MLS Q&A 

INVENTORY CLEAN-UP FINES 

states: “The owner(s) name(s) must be on 

the listing agreement unless the owner 

specifically requests in a letter handwritten 

by the owner and signed by the owner that it 

is not to be published. (11/03).”

What Agents Need to Know: 

Why the Advertising Game is 

Different on the Web

For those agents who are just now jumping 

on the bandwagon to produce a Web 

site because they think they should, or 

they've heard that a Web site is a great way 

to build business, understanding some of 

the realities of Web-site marketing will 

help make the effort more worthwhile. 

A lot of confusion exists about the Web 

as a marketing tool even among seasoned 

professionals, beginning with "What is it 

How do I make an impact How is traffic 

generated What do consumers want 

How much will I make Does it add to or 

replace other forms of advertising" But 

those questions aren't as significant as the 

one age-old query: How do I attract consumers 

To answer those questions, the 

Web, for the purposes of this article, will 

be viewed as an advertising medium -- 

like TV, print, or radio. 

The Web is growing by leaps and bounds, 

attracting new viewers every day. At this 

time, more than 25 percent of American 

households are connected to the Web, with 

50 percent of households owning computer 

technology. Web TV and plummeting hardware 

prices are enticing new Internet surfers 

daily, and it is just a matter of time before 

every household is connected. 

The first lesson is that the consumers are 

already there, making the Web a perfect 

medium for advertising. But there are five 

key areas in which the Web is different than 

any other form of media, and that is why it 

has set the advertising/marketing world on 

its ear. Advertising models are changing 

daily, as marketers struggle to place advertising 

dollars where they are most effective. 

The Web has changed the marketing paradigm. 

It is not only inexpensive to produce, 

but it also clearly reaches consumers. 

1. Your marketing message is not only 

local; it's also worldwide. Target your 

pages appropriately. Most real estate 

advertising is localized and assumes the 

viewer knows all about your given area, 

but your market is the relocating customer. 

To appeal to them, you will want to 

emphasize the city, schools, neighborhoods, 

and other services, and your familiarity 

with all of these. To appeal to a seller, 

you will want to emphasize your track 

record of sales and your "bio." Write your 

copy as if you were telling complete 

strangers about you, your company, your 

listings, the area, and the community at 

large. Give them reasons to want to move 

there. Add a multilanguage link -- no one 

else is doing it, so you'll be the first. 

2. You can target buyers, sellers, investors, 

lenders, title companies, and other Realtors 

with the same marketing tool -- your Web 

site and its pages. You can send the URL of 

any page on your site as a hot link in an e- 

mail message to anyone with whom you do 

business. If you are showing new listings, 

send them to your contacts. If you want to 

market yourself, e-mail your "bio" page to 

title companies and lenders. No other marketing 

tool offers the ability to promote 

yourself, showcase your listings, communicate 

directly with the consumer, and maintain 

industry contacts all at the same time. 

3. Consumer traffic can be counted and 

qualified. The Web is the only advertising 

medium that can give you accurate results 

for your expenditures. 

4. The consumer is coming to you to 

learn about you and your product, instead 

of you going to the consumer. This fact is 

among the most significant. The Web consumer 

is smart, educated, and aggressive. 

They comparison shop. Be ready. 

5. Your content can be changed on a 

moment's notice. New listings, sold notices, 

breaking news, and general interest information 

may be added instantly. Remove 

any old features that aren't working for you. 

When you purchase an advertisement in 

any print medium, the sales representative 

will tell you that your market saturation is 

based on the number of subscribers and 

editions sold to vendors such as book 

stores, convenience stores, and so on. If 

you are targeting a certain demographic, 

they can tell you by zip code how many 

people in your target market are buying 

the publication. Then there is "pass-along" 

value, which is an estimated figure of how 

many other hands the publication passes 

through in waiting rooms, at libraries, and 

at the doctors' office, for example. 

The fact is that none of these figures can 

be proven. That's right -- none. There is no 

quantifiable method of tracking how 

many people actually saw, heard, or were 

even interested in your ad. Your advertising 

agency can't do it, the ad sales representative 

can't do it, and you probably 

can't, either. After placing an ad, have you 

ever asked every caller or open-house 

attendee how they heard about you Do 

your employees ask The only way you 

know is if you make a sale, and even then, 

you don't know what percentage of your 

sales were influenced by other factors or 

just plain dumb luck. 

But on the Web, the dynamics are completely 

different. Instead of passive viewers, 

who may or may not be interested in 

your message, you have interactive participants 

-- consumers who are aggressively 

seeking products, services, and information, 

and they are growing all the time. No 

one can be enticed onto your site unless 

they want to be there, and if they are, they 

are looking for something you have to 

offer. This is the single most important 

reason to put your Web address and e-mail 

address on all of your printed media. 

This proactive consumer trend represents 

a significant cultural event because it will 

change the way we do business in the nation 

and throughout the world. It means that 

businesses will have to compete not only for 

quality in product and delivery, but also in 

maintaining the attention and interest of the 

consumer. Why Because your competition 

is on the Web, too. Regardless of size, assets 

and distribution ability, all competitors are 

equal on the Web, and the consumer is 

doing side-by-side comparisons. Your competitors 

can get online for the same price as 

you, and there is no "positioning" such as 

getting the inside front cover of a magazine 

or the front page of the newspaper's real 

estate section. You consumers have only to 

type in your URL...or your competition's. 

Your Web site is essentially the creation 

of your own magazine. And you will have 

the same problems and concerns of any 

publication — namely, distribution and 

attractive content to retain viewer interest. 

How to get on every newsstand (search 

engines) and other highly trafficked sites 

(related real estate sites) is your biggest 

concern. To put it in perspective, your 

magazine is now on the newsstand with 

millions of other publications. To stand 

out, you will have to perform daily maintenance 

and actively work at building relationships, 

just like the rest of your business. 

A Web business won't just happen. 

As far as interesting content goes, you 

want to bring as many consumers to your 

site and have them stay there as long as 

possible. And you want them to come 

back again and again, so don't quit with 

posting your current listings and your 

biography. What you want is for consumers 

to look at you as the go-to site for 

information on real estate. Period. One 

way is to develop links with content 

providers such as online news services, 

columnists, and home improvement sites. 

Agent News, for example, is on as many 

as 150 sites. Get your local MLS on your 

site if you can. If you are not a writer, don't 

worry. Find out if you can link to sites you 

like whose content would be helpful to 

your business. 

Because of the mano y mano aspect of 

Web competition, the best sites are not limited 

to a one-page "online brochure." That 

is why Web sites are composed of multiple 

pages. Each page on the site serves a purpose 

-- whether it is a company or personal 

bio, new product or listing announcement, 

how-to/advice, or news and information 

-- and that is to keep the consumer 

interested. It is these pages that tell you the 

extent of the consumer's interest. 

How do you find out where your traffic is 

going When you create a Web site, your 

Web host should provide you with reports 

that detail your page views. Then you will 

know which pages are of most interest to 

consumers. The significance is that you can 

track how many people come to your site, 

which features they are interested in, and 

where they came from. Based on the information 

you obtain, you can improve service 

and product quality and delivery, consumer 

relations, and most of all, sales. A word of 

caution: Don't play the information withholding 

game with the consumer. Those 

days are over. Qualifying customers by 

making them fill in an e-mail reply before 

they can view homes will make them click 

you off faster than you can say "MLS." 

As a marketing tool, your Web site is 

the most inexpensive to develop and has 

the potential to offer the greatest yield. But 

don't let the Web's relative low cost mislead 

you into developing a cheap-looking 

site. Although you can develop a complete 

Web site for the world to see for less than 

the cost of a box of business cards, your 

message still needs to be attractive to consumers. 

Put some money behind developing 

traffic, strategic alliances, and quality 

content so your Web site will stand out. 

SITES TO SEE 

Sometimes the best real estate investments 

are the ones that need a little — or a 

lot — of work. If you or your clients are 

brave buyers who see fixer-uppers as 

exciting challenges to tackle on your own 

or simply want to try your hand at a 

remodeling project instead of hiring someone 

else to do it, here are three Web sites 

full of home improvement tips, design 

tools, and articles that will keep you on the 

right track. 

BobVila.com. Ultimate handyman Bob 

Vila has found a home on the Web, offering 

advice on all sorts of home improvement 

projects. The site has easy-to-use 

search functions that help you wade 

through the vast amount of information to 

zero in on your topic of interest. The 

Home Improvement Library provides 

everything you need to tackle a project, 

including articles, tips, and videos. The 

library lets you browse by subject, task, or 

location in the home where your project is 

based. If you need more guidance on home 

repairs, check out the step-by-step illustrated 

Fix-It Club, which explains how to 

diagnose problems and fix almost everything, 

from a toilet to a garbage disposal. 

The site also has a page devoted to online 

Design Tools to help plan out your new 

kitchen, patio, or garden. You can register 

on the site to save your designs and access 

them later. 

HGTV.com. The Internet home of the 

Home & Garden Television Network has 

free resources for decorating, remodeling, 

and gardening. The strength of this site is 

its interactive tools and online demos. In 

the section devoted to Decorating, for 

example, before-and-after slide shows 

provide ideas about how to spruce up two 

of the home's most important rooms: 

Kitchens and Bathrooms. Or you can use 

the Room Planner to create a customized 

floor plan for any room in your home and 

experiment with different furniture 

arrangements before trying it out for real.

you through projects like installing a 

handrail or decorating with wallpaper. 

HGTV.com's Gardening section, meanwhile, 

teaches gardening enthusiasts about

show syndicated on public television networks. 

The show's Internet site doesn't 

have the depth of information as the other

I just returned from an 

RPAC training session in Washington 

D.C. accompanied by Marian Fraker- 

Gutin, our LIBOR President and 

Audrey Livingstone, a National RPAC 

Trustee. The information and ideas we 

gathered there will be shared with our 

RPAC Committee. The main theme 

was using the T-E-A-M approach, 

which is something that I always make 

reference to. As the RPAC Chair I realize 

that very little could be accomplished 

if I didn’t have supportive Co- 

Chairs (Marie Costello, Liz English 

and Jose Valez); a strong committee 

already helped us to accomplish 

and how they are working for us now (keeping 

the banks out of Real Estate and working 

to protect our commissions). Also, we’d 

like to increase the number of Realtors that 

contribute. We’d love to have all LIBOR 

members contribute their fair share. If you 

could just approach one Realtor that has 

never contributed to RPAC and ask them to 

do so, this will become reality! Increasing 

participation and contributions will require 

a team effort. We need you. Invest in our 

industry....it’s your future!

LEGAL/GOVERNMENTAL 

When you sit down to read this article, 

the outside temperature will be hovering 

around the freezing mark and the 

Catskill and Adirondack ski areas will be 

bustling with activity. Potential real 

estate sellers will be thinking about listing 

their properties for sale in order to 

catch the late winter/early spring buyers, 

and you will be honing up on your listing 

presentation to capture those sellers. I 

know because I am in the process of listing 

my house and interviewing potential 

listing Realtors®. 

These Realtors® tell me that today’s 

Sellers know as much about the real 

estate market as the agents with whom 

they deal. By the time the Seller reaches 

your desk, they have searched available 

properties, often done their own CMAs 

and have visited your website and those 

of your competitors. The real estate 

experts predicted 13 years ago, that this 

situation would result in the depletion of 

the value of the listing broker driving 

listing commissions down to $1,000 or 

less. These experts were obviously 

wrong, but the question is what was their 

mistake 

Actually, their error resulted from the 

fact that they either ignored or did not 

know a basic principle of real estate brokerage. 

A real estate broker told me more 

than 20 years ago that sellers used brokers 

because the sellers believed the broker 

controlled the buyer pool. This ancient 

adage is truer today than ever before. 

Sellers expect that you will expose 

their property to the greatest number of 

potential buyers in an effort to obtain for 

them the highest price and best terms of 

sale. Indeed, as a seller’s agent, this is 

exactly the obligation which the law 

places upon you. Your fiduciary duty to 

the seller requires that you always act in 

furtherance of this goal. 

In fact, the homeowner does not 

expect you to personally sell the property, 

but rather to expose the seller’s property 

to the buyer pool. This is one of the 

reasons why the owner is obligated to 

pay the commission even if they sell the

property themselves. In his best selling 

book, “Linked” Professor Albert-Laszlo 

Barabasi explains such pools consist of 

hubs and links. Obviously certain hubs 

are more influential than others. For 

example, google.com is a much more 

important hub on the internet than the 

writer’s website. 

In terms of listing Long Island residential 

real estate, the most influential hub is 

the Multiple Listing Service of Long 

Island, Inc. With over 20,000 subscribers 

each of whom link to the Multiple Listing 

Service Stratus site once or more per day, 

there is no equal tool for accessing the 

buyer pool. Each of those 20,000 hubs 

have multiple links as well; i.e., family, 

friends, outside business associates and 

out of area brokers. When you consider 

the links of the multiple listing service 

subscriber hubs to other individual and 

business hubs, you realize that within two 

levels of separation, you have a potential 

audience numbering in the millions, 

maybe tens of millions. The Buyer pool 

is in these millions. 

So when you go on your next listing 

presentation and are thinking about taking 

an “office exclusive”, think about 

your fiduciary obligation and the connecting 

power of MLS. If you believe an 

office exclusive is still in the best interest 

of your client, make sure the client 

understands about how links and hubs 

work and that 20,000 MLS participant 

hubs will probably have links measured 

in the hundreds of thousands and hubs at 

the end of those links in the millions. 

Remember, failure to obtain informed 

consent to the listing agreement or a 

breach of your fiduciary duty to your 

client could result in disciplinary action 

by the Department of State, loss of your 

right to compensation, exposure to litigation 

or any combination of these three 

possibilities. 

So while you’re waiting for the snow 

to melt think about marketing in 2005 

and the duty you owe the seller. While 

you’re at it, I recommend you read 

Professor Barabasi’s book. 

New Sign Law in the Town of Southampton 

Attention All REALTORS® 

Conducting Business in the Town of 

Southampton — There is a new sign law 

in effect in the Town of Southampton. 

The regulations are as follows: one sign 

per property only; the sign must be on the 

property that is for sale; the sign must not 

be located in the right of way; residential 

sign size limit is 4 square feet and commercial 

sign size limit is 8 square feet. 

The Town of Southampton will be hiring 

an inspector to focus solely on this 

issue in the near future. In the meantime 

— they are sending a letter out to all of 

the real estate practitioners in the Town 

advising them of this new law and that the 

Town will confiscate signs that are not 

properly placed. 

It appears as if most of the violations 

are not in the size of the sign but rather the 

placement. 

FHA Announces Higher Maximum 

Mortgage Limits for 2005 

In Mortgagee Letter 2004-46 of 

December 23, 2004 the Federal Housing 

Administration (FHA) announced its new 

maximum mortgage limits for single-family 

loans FHA will endorse on or after January 

1, 2005. The National Housing Act provides 

that the mortgage limit for any area shall be 

set at 95% of the median house price for the

area, except that the FHA mortgage limit in 

any area cannot exceed 87% of the Freddie 

Mac limit. The Office of Federal Housing 

Enterprise Oversight (OFHEO) set 

$359,650 as the top single-family limit for 

Freddie Mac for the year 2005. The top 

FHA limit for a single-family home in 

“high-cost” areas will be $312,895 in 2005.

ETHICS...This Month’s Topics 

Case #2-6: Misrepresentation 

REALTOR® A, a cooperating broker, 

had shown four houses to Buyer B, and 

Buyer B’s wife had asked to see one of 

them a second time. There was a third 

inspection, and a fourth. They seemed at 

the point of decision but said they would 

like to “sleep on it.” When there was no 

word the next day, REALTOR® A called. 

Buyer B said he was a bit hesitant on the 

price; that some transfers of executives in 

his company had been rumored; that this 

would affect him within the year; that he 

hesitated to buy at a price that might mean 

taking a loss if he should be transferred 

within a year. 

REALTOR® A tried to reassure the 

prospect by telephone. Then he dictated a 

letter stating that the house was an exceptional 

bargain at the asking price and “our 

office guarantees to get your money out of 

it for you any time in the next year if you 

should need to sell.” Buyer B came in and 

signed the contract. 

Six months later, Buyer B came to 

REALTOR® A as a seller. He was being 

transferred. He would need to get his equity 

out of the house to be able to afford a 

purchase in the new community. REAL- 

TOR® A listed the house at the price buyer 

B had paid for it. After a month there had 

been no offers. Buyer B reminded REAL- 

TOR® A of his written assurance that his 

office had guaranteed he would get his 

money out of the house within the year. 

REALTOR® A explained that the market 

had become much less active and that 

Buyer B might have to reduce his price by 

$10,000 to $15,000 to attract a buyer. 

Whereupon, Buyer B filed a complaint 

with the Board of REALTORS® charging 

REALTOR® A with misrepresentation, 

exaggeration, and failure to make good a 

commitment. After examination of the 

complaint, the Grievance Committee 

referred it to the Professional Standards 

Committee for a hearing. 

In response to questioning by the 

Hearing Panel, REALTOR® A admitted 

that he had written the letter to Buyer B 

in good faith and, at the time the letter 

was written, he had been certain that his 

office could obtain a price for the property 

that would ensure Buyer B was “getting 

his money out of the house.” 

However, REALTOR® A explained that 

although he had held such an opinion in 

good faith, the market had softened and 

now the circumstances were different. 

The Hearing Panel reminded REAL- 

TOR® A that the pertinent fact being 

considered was not his opinion at the 

time of the previous sale as compared to 

his opinion now, but rather his written 

“guarantee” to Buyer B and his current 

failure to make good his written commitment. 

It was the conclusion of the 

Hearing Panel that REALTOR® A had 

engaged in misrepresentation and was in 

violation of Article 2. 

Case #16-1: Confidentiality of 

Cooperating REALTOR®’s Participation 

When Client a listed his home sale with 

REALTOR® B, he explained that he wanted 

the sale handled without advertising and 

without attracting any more attention than 

was absolutely necessary. He said he understood 

that he would have to have some contacts 

with prospective buyers and possibly 

with other REALTORS®, but that he did not 

want the property filed with the MLS, advertised, 

or in any way publicly announced as 

being on the market. He asked REAL- 

TOR® B to impress the same restrictions on 

any other REALTORS® who might become 

involved in the transaction. 

REALTOR® B, having reason to think 

that REALTOR® C was in touch with 

prospective buyers to whom the property 

would appeal, approached REALTOR® C 

to invite his cooperation, and explained 

fully the Client’s instructions. REAL- 

TOR® B discussed the matter with no 

other REALTOR® and refrained from any 

kind of advertising of the property. But a 

few days later, REALTOR® B learned that 

REALTOR® D was discussing the property 

with prospective buyers, knew that 

REALTOR® C was working on it, knew 

the price at which the property had been 

listed, and other details about it. 

Questioning revealed that REALTOR® C 

had told REALTOR® D that he was working 

on the sale of the property. 

On the basis of the information from 

REALTOR® D, REALTOR® B charged 

REALTOR® C with unethical conduct in a 

complaint to the Board of REALTORS® 

specifying that REALTOR® C’s breach of 

confidence under the circumstances was a 

failure to respect his, REALTOR® B’s, 

exclusive agency, and that his action had 

jeopardized his relationship with his client. 

The complaint was referred to the 

Board’s Professional Standards 

Committee, a hearing was scheduled, and 

REALTOR® C was directed to answer the 

charge of unethical conduct in violation of 

Article 16. 

At the hearing, REALTOR® B detailed 

the instructions of the client and the manner 

in which he had conveyed them to 

REALTOR® C in inviting his cooperation. 

REALTOR® D told the Hearing Panel that 

REALTOR® C had discussed the listing 

with him. REALTOR® C defended himself 

against the charge of violating Article 

16 by saying that while he had discussed 

the matter briefly with REALTOR® D, he 

had not expressly invited his cooperation, 

and, therefore, had not violated Article 16. 

At the conclusion of the hearing, the 

panel held that REALTOR® B’s complaint 

was valid; that proper respect for his exclusive 

agency and the circumstances under 

which it existed required REALTOR® C 

to observe the confidence entrusted to him 

and that REALTOR® C’s discussion of the 

matter with REALTOR® D was in violation 

of Article 16.

Hit The Ground Running In 2005

It’s what you do now that is going to 

determine whether you start 2005 from 

ground zero or with momentum and focus. 

If you are proactive this month, you will 

reap the rewards next year. 

Have a Productive December 

December is a perfect month to making 

warm calls or visits. G to as many functions 

and parties as possible to be high profile. 

Prospecting is not limited to the horrid cold 

calls but includes any activity that puts you 

in front of someone who wants to buy or 

sell. Statistics tell us this is probably about 

10% of the people. So one in every 10 people 

you see probably has a need. See more 

and have fun doing it. Several years ago, 

one of my coaching clients called and 

talked to each person in her past client database 

in December and had 6 new listings 

from those people in January. 

December is also a good time to focus on 

business. The buyers are more serious this 

time of the year. If you have a motivated 

seller, there is an advantage because there is 

less competition, the house looks prettier 

with decorations and the buyers are more 

likely to buy. Coach your sellers not to wait 

until after the holidays but to take advantage 

of this. There are agents whose best month is 

always December because they are working 

when others are not. It sure makes January 

nice to have a few checks coming in 

Get your Planning Done 

It is said the most productive day of the 

year is the day before vacation. On that day 

you are focused, you prioritize and you take 

lots of action. You may want to take lots of 

“vacations” in December-giving yourself 

plenty of time off to play, enjoy and visit. 

Take out your December calendar and 

schedule that time in on the calendar. Now 

schedule peak performance time to balance 

it out. The peak performance days are those 

days when you’ll focus 80% of your day on 

dollar productive activities. 

The 2005 planning must get done now if 

you want to hit the ground running in 2005. 

I recommend a full day to do a complete 

overview and creation session. Review your 

numbers from 2004. This should be in depth. 

Know where every listing or sale came 

from. Know how effective your advertising 

was in each media you used. Know what 

your gross was and how much your expenses 

ate it up. There deeper you delve here,

I offer a simple Awesome Year Planning 

Guide containing worksheets to help with 

all of this or there are a couple of Real 

Estate specific business planning tools that 

can help. An Internet-based program that is 

extremely detailed is called CreateAPlan, 

you’ll be able to track exactly what each 

listing or sale cost you as well as being able 

to do some “what ifs” with your business. 

These “what ifs” might include cutting your 

commissions by a half-percent or adding an 

assistant. Another program called 

Performitor is software for you to design 

your plan on your computer and generate a 

tracking sheet for the month that will keep 

you aware and on target with your goals. 

Review what worked and what didn’t. 

What was your hourly worth this year (you 

know, net divided by hours). How could 

you have used your time more effectively 

Should you have outsourced more, focused 

on a different target market, let go of some 

needy, high maintenance clients 

Review your net worth. Are you better off 

now than you were at the end of 2003 It 

astounds me to see agents making plans with 

no connection to a long term financial plan or 

goal. They just pick yearly figures that seem 

reasonable and think they have done planning. 

Without being part of an “escape” plan, 

you yearly figures don’t have much power to 

help you achieve financial independence. 

Okay, now you can start the planning for 

next year. What do you want to achieve in 

terms of net profit (the only number that 

really counts when it is all said and done!) 

Why do you want this Clarity on the 

WHY will motivate you and give passion to 

your actions. Do you want to fund a college 

education, a month long vacation, a new 

house 

If your date of financial independence is 

10 years away, is the net this year sufficient 

to create enough reserve to fund the retirement 

account sufficiently Your business is 

not your life. It is the means to be able to 

live your life. What are those areas of your 

life you want impacted this coming year 

and in the future through your business 

results in 2005 

Once you know how much you want to 

make, then you can decide where it will come 

from and what activities you need to do to hit 

those numbers. Be strategic in doing this. By 

that I mean that you should base what you are 

going to do from knowing where the business 

will come from, not simply picking figures 

that are, say, 20% above last year. From the

For 2005, segment three to five target 

markets from the above categories or from 

a new emerging niche you can grow and 

identify what share of your business will 

come from each of these areas. Then apply 

marketing budget and activities that will 

ensure that will happen. 

Leave at least 30 percent of your marketing 

budget uncommitted so you will have flexibility 

as the year unfolds to take advantage of 

new opportunities without going over budget. 

Review your technology needs (and 

wants) for 2005. Assign budget amounts 

here as well, with the same 30% unaccounted 

for. Make a list of those items that 

would be the best to buy or use next year 

and schedule when you will make the purchases. 

Start with the 3 things that would 

increase your productivity most. 

And, I don’t believe in the “reasonable” 

goals. It is better to aim high and miss than 

to aim low and make it. Don’t put a lid on 

it, but rather commit to something big that 

will stretch your thinking to doing things 

that might be riskier than the normal, but 

that also have the potential of a bigger payoff. 

Plan to be extraordinary in 2005 

instead of ordinary. If, each day, you start 

the day asking yourself, “How can I make 

today extraordinary” your 2005 will be a 

supremely prosperous one!
