amount deposited falls short of the charges payable under this clause, the purchaser shall<br />

immediately on requisition by BCCL pay the additional amount. The bidders may be<br />

required to pay the necessary cost & expenses incurred in availing the services <strong>for</strong><br />

dismantling and loading to BCCL concerned stockholder <strong>for</strong> the lot/s.<br />

The materials sold shall be removed by the buyer from any one side of the lot as per the<br />

sole direction of the BCCL and no segregation of items from the sold lots will be<br />

permitted. No pick and choose of the material will be allowed and the purchaser has to<br />

lift the entire lot from the designated place. Description against each lot given is not<br />

exhaustive.<br />

The description indicates the major content of the lot. bidder are requested to contact<br />

the respective areas' Staff Offices(MM)/Depot Officer of regional stores of the respective<br />

area(s)/Stock Holding Unit(s) <strong>for</strong> inspection of the lot(s) to assess the exact physical<br />

condition of the materials contained in each lot and satisfy themselves be<strong>for</strong>e<br />

submission of bid.<br />

b. In case of any hot work permission is required <strong>for</strong> dismantling operations, the same will<br />

have to be obtained by the buyers from the BCCL authorized representative be<strong>for</strong>e<br />

lifting it will be sole discretion of the BCCL to allow or not to allow such hot-work<br />

permission at buyers cost only to extent the facilitating the loading and transportation of<br />

the goods.<br />

c. For the purpose of removing the materials, the successful bidder shall employ only<br />

his/their own personnel and shall keep BCCL fully indemnified against any claims <strong>for</strong><br />

wage, injuries, compensation, death etc.<br />

d. While removing the materials, if any accident or damage to the property / life etc. arises<br />

by reason of any act of negligence / omission/ default or non-compliance with any of the<br />

Terms and Conditions of the statutory regulations or rules and regulations applicable<br />

within BCCL premises, on the part of the bidder’s / his representative or employees<br />

resulting in death or injury to any person or damages to the property of BCCL or any<br />

third party then in such an event the bidder will have to pay compensation to any such<br />

persons. The bidder shall in such an event keep the BCCL indemnified from any<br />

demand, claims or proceedings made.<br />

f. Crane charges to be borne by the purchaser whenever the materials are required to be<br />

loaded/ shifted by crane. Loading has to be done by the buyer at his own cost and<br />

arrangement. Cutting facilities will be given only to the extent of loading the materials on<br />

the truck/trailors whenever such operation is required and against specific remarks<br />

incorporated against the lot. However it will be not binding upon the SELLER(BCCL) <strong>for</strong><br />

making the provision of Cranes <strong>for</strong> dismantling or removing of goods from the site. Also,<br />

the bidder will be not entitled to ask <strong>for</strong> any claims <strong>for</strong> the waiver of Ground Rent, if<br />

seller is not able to provide any facility <strong>for</strong> dismantling or removal of goods from the lot<br />

site.<br />

16-b. Sale of Hazardous Waste <strong>Items</strong>: The sale of Hazardous waste items, namely Waste Oil<br />

and specified categories of Non- Ferrous metal waste will be governed by the<br />

Hazardous Waste (Management & Handling) Rules, 1989 and its amendments and the<br />

sale of Batteries will be governed by the Batteries (Management & Handling) Rules<br />

2001 and its amendments. For such items, only those parties shall be eligible to bid<br />

who have Valid Registration Certificates from the state as well as Central<br />

Pollution Control Board on the starting date of e-auction.The Bidders will have to<br />

produce the original certificates and pass book at the time of delivery of the<br />

material. BCCL personnel will update the passbook during delivery <strong>for</strong> as per<br />

MOEF norms.If the bidder had the said State PCB, or CPCB certificates which expired<br />

within 30 days be<strong>for</strong>e the date of starting of e-auctions, he should submit a copy of the<br />

expired certificates and a copy of his application <strong>for</strong> extension with a proof of submission<br />

of the application atleast one working day be<strong>for</strong>e the starting date of e-auction.
