(1) A regular member <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> shall<br />

a) qualify as a pers<strong>on</strong> performing an important and c<strong>on</strong>fidential job;<br />

b) exercise his/her citizen’s rights within <strong>the</strong> limits specified in this <str<strong>on</strong>g>Act</str<strong>on</strong>g> and in <strong>the</strong> separate law<br />

<strong>on</strong> service legal relati<strong>on</strong>ships;<br />

c) not be a member <str<strong>on</strong>g>of</str<strong>on</strong>g> a party, nor pursue any political activities;<br />

d) announce to <strong>the</strong> general director in advance his/her intent to enter a social organisati<strong>on</strong>; <strong>the</strong><br />

general director may forbid membership, if that is incompatible with <strong>the</strong> pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> or <strong>the</strong> duty<br />

roster, or if it violates /threatens <strong>the</strong> interests <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> service (c<strong>on</strong>flict <str<strong>on</strong>g>of</str<strong>on</strong>g> interest);<br />

e) not pursue an activity which is unworthy <str<strong>on</strong>g>of</str<strong>on</strong>g> a regular service relati<strong>on</strong>ship, or would threaten<br />

<strong>the</strong> impartial, uninfluenced fulfilment <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> service functi<strong>on</strong>s;<br />

f) establish ano<strong>the</strong>r work-related legal relati<strong>on</strong>ship with <strong>the</strong> advance permissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> general<br />

director; <strong>the</strong> permit shall be refused in <strong>the</strong> cases defined under Point e), and if <strong>the</strong> establishment<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> legal relati<strong>on</strong>ship c<strong>on</strong>cerned is incompatible with <strong>the</strong> pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> or <strong>the</strong> duty roster; if it may<br />

give an opportunity to abuse informati<strong>on</strong> acquired in c<strong>on</strong>necti<strong>on</strong> with <strong>the</strong> service legal<br />

relati<strong>on</strong>ship, or if it interferes with/threatens <strong>the</strong> interests <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> service.<br />

(2) A regular member <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> shall<br />

a) take an oath,<br />

b) fulfil his/her duties defined in <strong>the</strong> duty roster in accordance with <strong>the</strong> relevant legislative<br />

requirements,<br />

c) obey <strong>the</strong> instructi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> his/her superior, bearing in mind <strong>the</strong> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 27,<br />

d) assert <strong>the</strong> nati<strong>on</strong>al security interests <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Republic <str<strong>on</strong>g>of</str<strong>on</strong>g> Hungary by all legal means and<br />

protect <strong>the</strong>m, if necessary, at <strong>the</strong> risk <str<strong>on</strong>g>of</str<strong>on</strong>g> his/her life.<br />

Article 23<br />

(1) Civil servants perform jobs at <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> that do not require <strong>the</strong><br />

establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> a regular service relati<strong>on</strong>ship implying special requirements.<br />

(2) The Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> may establish a public employment legal relati<strong>on</strong>ship with a<br />

pers<strong>on</strong> who complies with <strong>the</strong> employment criteria specified under <strong>the</strong> <str<strong>on</strong>g>Act</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> legal status <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

civil servants, and c<strong>on</strong>sents in writing to security checks for <strong>the</strong> purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

establishment/maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> legal relati<strong>on</strong>ship.<br />

(3) Regular service jobs may be re-classified as civil servant jobs and civil servant jobs as<br />

regular service jobs. The legal relati<strong>on</strong>ship <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> re-classified staff is subject to <strong>the</strong> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

a separate law.<br />

Article 24<br />

The Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> staff shall exercise discreti<strong>on</strong> regarding <strong>the</strong> state and service<br />

secrets <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> and <strong>the</strong>ir activities having come to <strong>the</strong>ir knowledge, and<br />

<strong>the</strong>y shall keep and protect such secrets. Relief from this obligati<strong>on</strong> may be granted by <strong>the</strong><br />

Minister and <strong>the</strong> general directors <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong>. The secrecy obligati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> staff shall prevail after <strong>the</strong> terminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir employment.<br />

Article 25<br />

Regular members <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> may be granted an intelligence service<br />

b<strong>on</strong>us corresp<strong>on</strong>ding to a maximum <str<strong>on</strong>g>of</str<strong>on</strong>g> 25% <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir normal duty allowance. The jobs implying<br />

eligibility for <strong>the</strong> b<strong>on</strong>us shall be defined by <strong>the</strong> Minister, up<strong>on</strong> <strong>the</strong> proposal <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> general<br />

director. This b<strong>on</strong>us shall not be taken into account in <strong>the</strong> calculati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> service period<br />

supplement.<br />
