(1) Within <strong>the</strong> framework <str<strong>on</strong>g>of</str<strong>on</strong>g> intelligence informati<strong>on</strong> ga<strong>the</strong>ring, <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong><br />
may<br />
a) request informati<strong>on</strong>;<br />
b) ga<strong>the</strong>r informati<strong>on</strong> while c<strong>on</strong>cealing its nati<strong>on</strong>al security character;<br />
c) establish a covert relati<strong>on</strong>ship with a private individual;<br />
d) create and use informati<strong>on</strong> systems promoting informati<strong>on</strong> ga<strong>the</strong>ring;<br />
e) set traps, provided that <strong>the</strong>se cause no injury or health damage;<br />
f) prepare and use cover documents to protect <strong>the</strong>ir own staff and physical pers<strong>on</strong>s collaborating<br />
with <strong>the</strong>m, and to c<strong>on</strong>ceal <strong>the</strong> nati<strong>on</strong>al security aspect <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> activity;<br />
g) create/maintain a cover instituti<strong>on</strong>;<br />
h) keep under surveillance pers<strong>on</strong>s affected by <strong>the</strong>ir tasks; premises, buildings and o<strong>the</strong>r<br />
objects; terrain and route secti<strong>on</strong>s and vehicles which can be c<strong>on</strong>nected to <strong>the</strong>m, and record <strong>the</strong>ir<br />
observati<strong>on</strong>s by technical devices;<br />
i) with <strong>the</strong> excepti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> cases described under Article 56 below, wiretap c<strong>on</strong>versati<strong>on</strong>s and<br />
record <strong>the</strong>ir observati<strong>on</strong>s with technical devices;<br />
j) ga<strong>the</strong>r informati<strong>on</strong> from communicati<strong>on</strong>s systems and o<strong>the</strong>r data storage devices.<br />
(2) A law enforcement agency and its documents shall be used as cover instituti<strong>on</strong>/document<br />
<strong>on</strong>ly, if <strong>the</strong> competent minister and <strong>the</strong> nati<strong>on</strong>al head <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> organisati<strong>on</strong> c<strong>on</strong>cerned are informed<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> that fact.<br />
Article 55<br />
(1) With <strong>the</strong> preliminary approval <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> prosecutor designated by <strong>the</strong> chief prosecutor, <strong>the</strong><br />
Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> may agree <strong>on</strong> <strong>the</strong> disclosure <str<strong>on</strong>g>of</str<strong>on</strong>g> informati<strong>on</strong> with a pers<strong>on</strong> reas<strong>on</strong>ably<br />
suspected <str<strong>on</strong>g>of</str<strong>on</strong>g> having committed a criminal act, by <str<strong>on</strong>g>of</str<strong>on</strong>g>fering <strong>the</strong> latter <strong>the</strong> prospect <str<strong>on</strong>g>of</str<strong>on</strong>g> refusal or<br />
terminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> investigati<strong>on</strong>, if <strong>the</strong> nati<strong>on</strong>al security interest involved in collaborati<strong>on</strong> with <strong>the</strong><br />
pers<strong>on</strong> c<strong>on</strong>cerned overrides that <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> criminal law claim <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> state.<br />
(2) No agreement shall be c<strong>on</strong>cluded with a pers<strong>on</strong> having committed a crime involving<br />
voluntary manslaughter.<br />
(3) The license defined under (1) is not due to <strong>the</strong> Specialised Nati<strong>on</strong>al <strong>Security</strong> Service.<br />
(4) If <strong>the</strong> agreement is c<strong>on</strong>cluded, <strong>the</strong> Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> shall provide compensati<strong>on</strong><br />
for <strong>the</strong> damage which ought to have been borne by <strong>the</strong> perpetrator under <strong>the</strong> relevant civil law<br />
regulati<strong>on</strong>s. With regard to compensati<strong>on</strong> claim, <strong>the</strong> state shall be represented by <strong>the</strong> minister<br />
resp<strong>on</strong>sible for justice.<br />
Intelligence informati<strong>on</strong> ga<strong>the</strong>ring subject to external authorisati<strong>on</strong><br />
Article 56<br />
The Nati<strong>on</strong>al <strong>Security</strong> <strong>Services</strong> may, with external authorisati<strong>on</strong>,<br />
a) search residences in secret and record <strong>the</strong>ir observati<strong>on</strong>s with technical devices;<br />
b) observe and record what is happening <strong>on</strong> <strong>the</strong> residence with <strong>the</strong> help <str<strong>on</strong>g>of</str<strong>on</strong>g> technical devices;<br />
c) open letters and o<strong>the</strong>r postal items, inspect <strong>the</strong>ir c<strong>on</strong>tents and record <strong>the</strong>m with technical<br />
devices;<br />
d) learn communicati<strong>on</strong> through a public teleph<strong>on</strong>e line or some o<strong>the</strong>r telecommunicati<strong>on</strong><br />
service transmitting said communicati<strong>on</strong> and record <strong>the</strong> relevant observati<strong>on</strong>s by technical<br />
devices.<br />
Article 57<br />
(1) A moti<strong>on</strong> directed at obtaining authorisati<strong>on</strong> for intelligence informati<strong>on</strong> ga<strong>the</strong>ring as<br />
defined under Article 56 shall be submitted by <strong>the</strong> general director <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Informati<strong>on</strong> Office, <strong>the</strong>
