McDaniels advised the EDC Board of Directors approved the grant on January 25 th and the Kannapolis City Council approved a similar grant for the company on February 14th. He also responded to questions from the Board related . Chairman White opened the public hearing at 6 : 55 p.m . The Public Hearing Notice was posted on the County' s website (www . cabarruscounty . us ) on February 9, 2011 in accordance with Article 2 , Administration, Section 2 . 1 (Use of Electronic Means to Provide Public Notices) of the Cabarrus County Code of Ordinances . There was no one present to address the Board; therefore, Chairman White closed the public hearing . Commissioner development grant set forth above . Carruth MOVED to approve for Genuine Parts Company, a 3- year dba , S. P. 85 percent economic Richards Company as Commissioner Measmer expressed his intent to vote against the motion. He asserted that many of the 66 proposed jobs will likely be filed by Mecklenburg County residents since the company plans to relocate its Winston Salem and Mecklenburg locations and that only a few jobs will go to Cabarrus County residents. He also addressed the need for incentive reform at the Federal level and for a level playing field amongst all counties . Further, he advised that there are many local businesses employing more people that have never asked f or or received an incentive . However, he expressed support for an economic development grant for a very large company that could come to the Philip Morris site. Chairman White seconded the motion and expressed his intent to vote for the motion, citing the need for new jobs and more investment in Cabarrus County . After a general discussion, the MOTION Vice Chairman Poole and Commissioner Carruth Burrage and Measmer voting against . carried with Chairman Whi te , voting for and Commissioners (G-2 ) Commerce 2011-2012 HOME Program Public Hearing - 6: 30 P.M. and Participation in the Cabarrus/Iredell/Rowan HOME Consortium for 2011-2014 Kelly Sifford, Community Devel opment Manager, reported the current Cabarrus/Iredell/Rowan HOME Consortium participation agreement expires this year and the County will need to enter into a new 3- year Agreement for 2011- 2014 in order to continue to participate in the federally funded housing rehabilitation p r ogram for low- income families. She advised that a public hearing for the HOME Program is also required to participate in the grant program and estimated the County will receive approximately $113 , 000 . 00 in rehabilitation funds . She further advised, in response to questions from the Board, that the County must provide a 25 percent match, which is included i n the annual budget process. Chairman White opened the public hearing at 7 : 05 p.m. The Public Hearing Notice was published in THE INDEPENDENT TRIBUNE on February 9 and 11 , 2011. The Public Hearing Notice was also posted on the County' s website (www . cabarruscounty . us ) on February 8 , 2011 in accordance with Article 2 , Admi nistration, Section 2 . 1 (Use of Electronic Means to Provide Public Notices) of the Cabarrus County Code of Ordinances. Vice Chairman Poole MOVED to participate in the Cabarrus/Iredell/Rowan HOME Consortium for 2011- 2014 and to provide the 25 percent local match for the HOME program. Commissioner Carruth seconded the motion . Vice Chairman Poole commented on the importance of federal grant funds , leveraged locally, to rehabilitate substandard homes for the elderly and low-

(G-3) Emergency Management - Adoption of Ordinance Amending Chapter 34 , Fire Prevention and Protection of the Cabarrus County Code of Ordinances - Public Hearing 6:30 P.M. Steve Langer, Fire Marshal l, requested a public hearing required for adoption of an ordinance amending Chapter 34 , Fire Prevention and Protection of the Cabarrus County Code of Ordinances. Chairman White opened the public hearing at 7 : 08 p . m. The Public Hearing Notice was published in THE INDEPENDENT TRIBUNE on February 9, 2011. UPON MOTION of Commissioner Carruth, seconded by Commissioner Burrage and unani mously carried, the Board the following ordinance : ORDINANCE AMENDING CHAPTER 34 (FIRE PREVENTION AND PROTECTION) OF THE CABARRUS COUNTY CODE OF ORDINANCES Ordinance No . 2011-03 BE IT ORDAI NED by the Cabarrus County Board of Commissioners that Chapter 34 , Fire Prevention and Protection, of the Code of Ordinances , Cabarrus County, North Carolina, is hereby amended to read as follows : ARTICLE I . IN GENERAL Secs . 34 - 1--34 - 25 . Reserved . ARTICLE II. FINANCIAL ASSISTANCE TO FIRE DEPARTMENTS Sec. 34 - 26. Offer ed to qualified departments. The County will offer financial assistance for the maintenance and operation of any volunteer fire department of a fire district qualifying for financial assistance under the terms of this article in an amount determined by the county manager, consistent with the polic i es of the Cabarrus County Board of Commissioners , not to exceed $3 , 000 . 00 per year, and by revenue collected from the fire district tax, provided a tax district has been established in accordance with G. S . 69- 25 . 1 et seq . for the area served, and by revenues generated by sales tax when the County selects ad valorum sales tax calculation . (Ord . of 12- 2-85, § 1; Ord . of 4- 3- 86 , § t ; Ord . of 4- 7- 86 , § 1 ; Ord . of 6- 17- 96) Sec . 34 - 27 . Participating departments to file budgets with Cabarrus County Fire Marshal ' s Office . A fire department desiring financial assistance under this article shall file a budget with the Cabarrus County Fire Marshal's Office by April 15 each year for the following fiscal year . Budgets will be submitted on forms provided by the Fire Marshal's Office . (Ord. of 12- 2- 85 , § 2 ; Ord. of 4- 3- 86 , § 2 ; Ord. of 4- 7- 86 , § Q) Sec . 34 - 28 . Inspections of participating fire departments by the Cabarrus County Fire Marshal . The Cabarrus County Fire Marshal shall make regular inspections of each fire department receiving payments under this article . At least one inspection shall be made annually, but the Fire Marshal may make other such inspections as deemed necessary . During the course of such inspections, the Fire Marshal shall determine whether the department is continuing to meet the minimum standards as specified in this article, and the findings reported to the Cabarrus County Board of Commissioners .
