This resolution shall take effect immediately upon its Thereupon, upon motion of Commissioner Carruth, seconded by Vice Chairman Poole, the foregoing resolution entitled "RESOLUTION REGARDING ONE QUARTER CENT (1/4 ¢) LOCAL SALES AND USE TAX AND DIRECTING CABARRUS COUNTY BOARD OF ELECTIONS TO CONDUCT AN ADVISORY REFERENDUM THEREON," was adopted and passed by the following vote: AYES: NOES: Chairman White, Vice Chairman Poole and Commissioners Carruth and Burrage Commissioner Measmer After the vote, Commissioner Carruth and Vice Chairman Poole commented on the following issues: the possible loss of APFO (Adequate Public Facilities Ordinance) revenues, the perils of repeatedly using fund balance to balance the budget, public discussions are needed if services are to be cut or eliminated, unfunded mandates passed down from the Legislature and the need for more media coverage of the Legislature's daily activities. (G-5) BOC - Approval of Cabarrus County's 2011 Legislative Goals Chairman White reviewed the following Cabarrus County 2011 Legislative Goals: • Amend NCGS 14-399 to allow regulation of delivery of unsolicited telephone books • Reinstate sales tax exemption for public schools • Study the impact to local government finances of exempting nonprofits from the requirement of paying property taxes and review possible payment in lieu of taxes requirements. • Address unfunded mandates (DSS, Schools, Jail, etc.) by providing additional funding, or additional funding sources. • Review the use of local government incentives in business recruitment, in particular, the practice of local governments bidding against each other for projects. • Change NC Rural Center's grant/loan award criteria to more closely match the USDA Rural Development aid requirements (specifically, remove the prohibition against aid to municipalities in Tier 3 counties) . • NCACC's top five priority goals and policy statements UPON MQTION of Vice Chairman and unanimously carried, the Board goals for 2011. Poole, seconded by Commissioner Measmer adopted the aforementioned legislative (H) APPOINTMENTS (H-1) Appointment - Adult Care Home Community Advisory Committee The term of appointment for Elizabeth Ryan ends February 28, 2011. The Regional Ombudsman recommends Ms. Ryan be reappointed for an additional term and she is willing to do so. Ms. Teresa Dakins and Mr. A.L. (H-2) Appointment - Criminal Justice Partnership Program (CJPP) An appointment is needed to fill the "District Court the Criminal Justice Partnership Program Advisory Board. (H-3) Appointment - Juvenile Crime Prevention Council An appointment of a Chief District Court Judge or designee is needed to replace Judge Michael Knox. Chief District Court Judge William G. Hamby, Jr. designated newly elected district court judge, D. Brent Cloninger to fill this position. UPON MOTION of Commissioner Carruth, seconded by Commissioner Burrage and unanimously carried, the Board appointed D. Brent Cloninger, District Court Judge, to the Juvenile Crime Prevention Council to complete an unexpired term ending June 30, 2011. (H-4) Appointments Cabarrus County Youth Council The following students are recommended for appointment to the Cabarrus County Youth Council: Julianna Sirois (at-large [Cannon School]); Ryan Himes (Central Cabarrus); Taylor Furr and Ryan Essick (Hickory Ridge); Sydney San Jose and Alana Dean (J.M. Robinson); Ella Beth Wickliff and Seth Bollenbecker (Mt. Pleasant); Te' Shone Davidson and Daniel Hicks (A. L. Brown); and Drew Smith (Cox Mill). These students were selected after completing an application and interview process. Strategies are in place to address the vacant positions at Central Cabarrus, Concord High, Cox Mill High and Northwest. UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole and unanimously carried, the Board appointed Julianna Sirois (at-large), Taylor Furr (Hickory Ridge), Sydney San Jose (J.M. Robinson), Ella Beth Wickliff (Mt. Pleasant) and Te'Shone Davidson (A.L. Brown) to the Cabarrus County Youth Council for one-year terms ending February 21, 2012. UPON MOTION of Commissioner Carruth, seconded by Commissioner Burrage and unanimously carried, the Board appointed Ryan Himes (Central Cabarrus), Ryan Essick (Hickory Ridge), Alana Dean (J .M. Robinson), Seth Bollenbecker (Mt. Pleasant), Daniel Hicks (A.L. Brown) and Drew Smith (Cox Mill) to the Cabarrus County Youth Council for two-year terms ending February 21, 2013. (H-5) Appointments - Cabarrus County Parks Commission At its January 20, 2011 meeting, the Parks Commission voted to recommend the appointment of John DeVitto (Eastern Area) and Gina Lowery (Concord Area), and the reappointment of Clara Swallows (At-Large) to its membership. It is also recommended that Blake Kiger be appointed to represent the Cabarrus School Board planning area. UPON MOTION of Commissioner Measmer, seconded by Commissioner Burrage and unanimously carried, the Board appointed John DeVitto (Eastern) and Gina Lowery (Concord) to the Parks Commission for three-year terms ending January 31, 2014, appointed Blake Kiger (Cabarrus School Board) the Parks Commission to complete an unexpired term ending January 31, 2012 and reappointed Clara Swallows (At-large) to the Parks Commission for a three-year term ending January 31, 2014. (H-6) Appointments - Food Policy Council Due to resignations, appointments are needed to replace Linda Goodwin (physician) and David Soliday (marketing/nutrition) on the FPC (Food Policy Council) . The FPC Executive Committee recommends the following: Jane Henderson' s seat (alternate [florist/farmer]) be reclassified as a regular voting position; reclassify the vacant "physician" seat to an "alternate" position since there are two (2) "physician" seats on the Council; appoint Jessica Castrodale to fill the "marketing/nutrition" seat and appoint Shannon Johnson as an alternate. An exception to the "multiple service" provision of the Appointment Policy is needed for Ms. Castrodale. UPON MOTION of Vice Chairman Poole, seconded by Commissioner Burrage and unanimously carried, the Board reclassified the "alternate" (florist/farmer) seat to a regular voting seat representing "florist/farmer"; reclassified the "physician" seat vacated by Linda Goodwin to an "alternate"
