CLAUSES OF CONTRACT<br />

(c) hypothecated to the BSNL as specified by the Engineer-in-Charge, before the<br />
payment of advance is released. The Contractor shall not be permitted to<br />
remove from the site such hypothecated plant <strong>and</strong> equipment without the<br />
prior written permission of the Engineer-in-Charge. The contractor shall be<br />
responsible for maintaining such plant <strong>and</strong> equipment in good working order<br />
during the entire period of hypothecation failing which such advance shall be<br />
entirely recovered in lump sum. For this purpose steel scaffolding <strong>and</strong><br />
formwork shall be treated as plant <strong>and</strong> equipment.<br />
The contractor shall insure the Plant & Machinery for which mobilisation advance<br />
is sought <strong>and</strong> given, for a sum sufficient to provide for their replacement at site.<br />
Any amounts not recovered from the insurers will be borne by the contractor.<br />
iv) The mobilisation advance <strong>and</strong> plant <strong>and</strong> machinery advance, in (ii) & (iii) above,<br />
bear simple interest at the rate of 18 per cent per annum <strong>and</strong> shall be calculated<br />
from the date of payment to the date of recovery, both days inclusive, on the<br />
outst<strong>and</strong>ing amount of advance. Recovery of such sums advanced shall be made<br />
by the deduction from the contractor’s bills commencing after first ten per cent of<br />
the gross value of the work is executed <strong>and</strong> paid, on pro-rata percentage basis to<br />
the gross value of the work billed beyond 10 % in such a way that the entire<br />
advances recovered by the time eighty percent of the gross value of the contract<br />
is executed <strong>and</strong> paid, together with interest due on the entire outst<strong>and</strong>ing amount<br />
upto the date of recovery of the installment.<br />
v) If the circumstances are considered reasonable by the Engineer-in-Charge, the<br />
period mentioned in (ii) <strong>and</strong> (iii) for request by the contractor in writing for grant of<br />
mobilisation advance <strong>and</strong> plant <strong>and</strong> equipment advance may be extended at the<br />
discretion of the Engineer-in-Charge.<br />
vi) The said bank guarantee for advances shall initially be made for the full amount<br />
<strong>and</strong> valid for the contract period, <strong>and</strong> be kept renewed from time to time to cover<br />
the balance amount <strong>and</strong> likely period of complete recovery together with interest.<br />

If the prices of materials (not being materials supplied or services rendered at fixed<br />
prices by the BSNL in accordance with Clauses 10 & 34 thereof) <strong>and</strong>/or wages of<br />
labour required for execution of the work increase, the contractor shall be<br />
compensated for such increase as per provisions detailed below <strong>and</strong> the amount of<br />
the contract shall accordingly be varied, subject to the condition that such<br />
compensation for escalation in prices shall be available only for the work done during<br />
the stipulated period of the contract including such period for which the contract’s<br />
validity is extended under the provisions of Clause 5 of the contract without any<br />
action under Clause 2 <strong>and</strong> also subject to the condition that no such compensation<br />
shall be payable for a work for which the stipulated period of completion is 3 months<br />
or less. Such compensation for escalation in the prices of materials <strong>and</strong> labour, when<br />
due, shall be worked out based on the following provisions: -<br />
i. The base date for working out such escalation shall be the last stipulated date of<br />
receipt of tenders including extension, if any.<br />
ii. The cost of work on which the escalation will be payable shall be reckoned as<br />
below: -<br />
a) Gross value of Works done upto this quarter: (A)<br />
b) Gross value of Work Done upto the last quarter. (B)<br />
c) Gross value of work done since previous quarter (A-B) (C)<br />
