CLAUSES OF CONTRACT<br />

CLAUSE 31<br />

the number of coal mining or controlled area labourer <strong>and</strong> the number of days for<br />

which they worked shall be final <strong>and</strong> binding upon all parties to this contract.<br />

It is declared <strong>and</strong> agreed between the parties that the aforesaid stipulation in this<br />

clause is one in which the public are interested within the meaning of the exception in<br />

Section 74 of Indian Contract Act, 1872.<br />

Explanation:- Controlled Area means the following areas:-<br />

Districts of Dhanbad, Hazaribagh, Jamtara- a Sub-Division under Santhal<br />

Pargana Commissionery, Districts of Bankuara, Birbhum Burdwan, District of<br />

Bilaspur.<br />

Any other area, which may be, declared a Controlled Area by or with the<br />

approval of the Central Government.<br />

Water Supply<br />

<strong>and</strong> Power<br />

Supply<br />

The Contractor (s) shall make his/their own arrangements for water <strong>and</strong> power supply<br />

required for the work <strong>and</strong> nothing extra will be paid for the same. This will be subject<br />

to the following conditions:<br />

i) That the water used by the contractor(s) shall be fit for construction purposes to<br />

the satisfaction of the Engineer-in-Charge.<br />

ii) The Engineer-in-charge shall make alternative arrangements for water supply at<br />

the risk <strong>and</strong> cost of the contractor (s) if the arrangements made by the contractor<br />

(s) for procurement of water are in the opinion of the Engineer-in-Charge,<br />

unsatisfactory.<br />

iii) The contractor shall make his own arrangement for temporary electric connection<br />

<strong>and</strong> shall make necessary payment for it direct to the concerned authority. On<br />

completion of the work he shall furnish a no dues certificate from the concerned<br />

authority failing which the claims/dues of the concerned authority shall be settled<br />

by the Engineer-in-Charge at the contractor’s risk <strong>and</strong> cost.<br />

CLAUSE 31A<br />

power & water<br />

supply, if<br />

available<br />

Water <strong>and</strong> power supply if available may be supplied to the contractor by the BSNL<br />

subject to the following conditions:<br />

i) The water charges @ 1 % shall be recovered on gross amount of the work done.<br />

ii) The contractor (s) shall make his/their own arrangement of water connection <strong>and</strong><br />

laying of pipelines from existing main source of supply<br />

iii) The contractor shall make his own arrangement to extend the power supply from<br />

the tapping point <strong>and</strong> install a sub meter for recording consumption of power in<br />

the work. The consumption charges thereof shall be recovered from the<br />

contractor by deduction from his bills or from any other dues.<br />

iv) The BSNL do not guarantee to maintain uninterrupted supply of water <strong>and</strong> power<br />

<strong>and</strong> it will be incumbent on the contractor (s) to make alternative arrangements<br />

for water <strong>and</strong> power at his/their own cost in the event of any break down in the<br />

Government supply so that the progress of his/their work is not held up. No claim<br />

of damage or refund of water <strong>and</strong> power charges will be entertained on account<br />

of such break down.<br />

CLAUSE 32<br />

arrangements<br />

i) Where there is no piped water supply arrangement <strong>and</strong> the water is taken by the<br />

contractor from the wells or h<strong>and</strong> pump constructed by the Government no<br />

charge shall be recovered from the contractor on that account. The contractor<br />

shall, however, draw water at such hours of the day that it does not interfere with<br />

the normal use for which the h<strong>and</strong> pumps <strong>and</strong> wells are intended. He will also be<br />

responsible for all damage <strong>and</strong> abnormal repairs arising out of his use, the cost of<br />
