MESSAGE<br />
I am happy <strong>to</strong> release the <strong>Court</strong> News for the quarter <strong>April</strong>-<strong>June</strong>, <strong>2013</strong>.<br />
New Judgeships of Malkangiri, Deogarh and Jagatsinghpur were<br />
inaugurated during this quarter. 20 <strong>Court</strong>s of Addl. District & Sessions Judge at<br />
Puri, Cuttack, Jagatsinghpur, Athagarh, Bhubaneswar, Khurda, Nayagarh,<br />
Rourkela, Balasore, Bhadrak, Sambalpur, Aska, Koraput, Jharsuguda, Keonjhar,<br />
Jajpur, Baragarh, Dhenkanal, Berhampur and Baripada have been made functional<br />
during this period. That apart, two Family <strong>Court</strong>s at Dhenkanal and Jeypore and<br />
the court of the Senior Civil Judge at Kujanga have been inaugurated. I am sure<br />
that the new courts would definitely cater <strong>to</strong> the need of the litigant public.<br />
Elevation of three permanent Judges <strong>to</strong> the Bench of the <strong>High</strong> <strong>Court</strong><br />
during the period is definitely a remarkable addition <strong>to</strong> the justice delivery<br />
system.<br />

ODISHA PUBLIC DISTRIBUTION SYSTEM (CONTROL) ORDER, 2008 – CLAUSE-11<br />
Violation of Clause-11 (i) (b) of the PDS (Control) Order, 2008 would occur where even, after<br />
payment of cost of the commodities and on demand the wholesaler/s<strong>to</strong>rage agent failed <strong>to</strong> supply the<br />
commodities immediately – Unless there is material <strong>to</strong> show that the s<strong>to</strong>rage agent or the wholesaler<br />
deliberately refused or failed <strong>to</strong> supply the commodities on demand for which price has already been paid,<br />
there cannot be any violation of Clause-11 (i) (d) of the PDS (Control) Order, 2008.<br />
In this case the statement of the retailers show that the petitioner has neither refused nor deliberately<br />
failed <strong>to</strong> supply the rice and sugar <strong>to</strong> the retailers but the same was caused due <strong>to</strong> the difficulties of the<br />
retailers regarding transportation they failed <strong>to</strong> lift the entire quantity issued in their favour – Held, it can<br />
not be said that the petitioner has violated Clause-11(i) (b) of the PDS (Control) Order, 2008 and therefore<br />
he cannot be charged U/s.7 of the EC Act – Impugned order is set aside and the petitioner is discharged<br />
from the charge leveled against him.<br />

deposited money but not provided with plots in spite of repeated requests – Petitioners not even in<br />
possession of genuine transferable homestead land <strong>to</strong> sell the inves<strong>to</strong>rs as per their own promise –<br />
Petitioners with dishonest intention cheated the public and misappropriated their money knowing very well<br />
that they were not in a position <strong>to</strong> provide land <strong>to</strong> the applicants – It cannot be said that it is a case of<br />
breach of contract simplici<strong>to</strong>r and it would not constitute any offence U/ss. 420, 406 I.P.C. – In this case,<br />
although the dispute is Civil or Commercial in nature it contains ingredients of Criminal Offences and<br />
subsequent assurance of the petitioners <strong>to</strong> handover plots or <strong>to</strong> refund money with interest would not wash<br />
away the culpability of the petitioners – Held, the application for bail is rejected.<br />

Complaint Case U/s. 138 N. I. Act – In normal Case trial has <strong>to</strong> be conducted in summary<br />
procedure – Summary procedure may be dispensed with only if the Magistrate in terms of the Second<br />
proviso <strong>to</strong> Section 143 (1) N.I. Act after hearing the parties passes an order <strong>to</strong> the effect that the nature<br />
of the case is such that a sentence exceeding one year may have <strong>to</strong> be passed or for any other reason<br />
it is undesirable <strong>to</strong> try the case summarily and any departure from such procedure would vitiate the trial<br />
– The passing of an order not <strong>to</strong> follow the summary procedure of trial may be passed suo motu or on<br />
the application of either of the parties and both parties must be heard before such order is passed – But<br />
where ever evidence from both sides has already been closed or complaints already disposed of, the<br />
matter shall not be re-opened for fresh trial by the Magistrate or as the case may be by the appellate<br />
or revisional <strong>Court</strong>.<br />
In the present case since evidence from both sides has already been recorded by following summons<br />
procedure direction given by the learned JMFC, Khallikote in the impugned order for denovo trial is<br />
quashed – Learned JMFC is directed <strong>to</strong> hear arguments and dispose of the complaint case within two<br />
months.<br />

No finding before the Committee that the donor is being exploited and/or there has been any<br />
commercial transaction between the donor and the recipient – Since the donor did not have a pho<strong>to</strong><br />
identity card the Corporater of Ward No.36 of Cuttack Municipal Corporation identified the donor and<br />
issued a certificate <strong>to</strong> that effect – The donor and her daughter expressed before this <strong>Court</strong> <strong>to</strong> have<br />
donated the kidney out of own volition – Held, there was no justification by the Authorization Committee<br />
<strong>to</strong> refuse “No objection Certificate” <strong>to</strong> the donor and the recipient for transplantation of kidney – Direction<br />
issued <strong>to</strong> O.P.2 DMET (O) <strong>to</strong> issue “No objection Certificate” for performance of surgery for transplantation<br />
of kidney in Apollo Hospital, Bhubaneswar in favour of the husband of the petitioner who is <strong>to</strong> receive a<br />

In this Case defendant Nos.4 and 5 claim title and possession over Lot No.II property which were<br />
executed on 4.2.1986, 17.2.1997 and 7.3.2001 – In the mean time multi-s<strong>to</strong>ried buildings have been<br />
constructed on a part of the suit land and apartments of the building have been sold <strong>to</strong> a number of<br />
persons who are in possession – So in view of the sale made long back and entries made in the ROR<br />
and lands having been converted in OLR proceedings it cannot be held that the plaintiff has established<br />
a prima facie case – The entries in the ROR and construction of multis<strong>to</strong>ried building have titled balance<br />
of convenience in favour of defendant Nos.4 and 5 – Any interference with such balance shall result<br />
inconvenience and irreparable loss <strong>to</strong> the defendants 4 & 5 – Moreover the plaintiff has slept over her right<br />
for a long period and filed the suit in the year 2012 so her conduct does not permit any equitable relief<br />
in her favour – Held, the impugned order of status quo relating <strong>to</strong> the lands under suit Schedule Lot No.II<br />

147(1) of the Act, i.e., the driver and conduc<strong>to</strong>r of the vehicle – However the owner of the vehicle is free<br />
<strong>to</strong> secure a policy of insurance providing wider coverage and in that event the liability would cover beyond<br />
the requirement of the above provision.<br />
In this case policy issued in respect of the offending bus shows that additional premium of Rs. 50/<br />
- has been paid <strong>to</strong> cover the liability of W.C. <strong>to</strong> two employees. So here the liability of the Insurance

that in the insurance policy the liability of Helper is not covered – Learned Commissioner is justified <strong>to</strong><br />
fasten liability on the Insurance Company <strong>to</strong> pay compensation <strong>to</strong> the claimant-respondent No. 1 for the<br />
death of the Helper.<br />
(C) WORKMENS COMPENSATION ACT, 1923 : S. 4-A (3)<br />
Payment of Interest – No appeal filed by the claimant – Whether the insurere is laible <strong>to</strong> pay<br />

their claim – Learned trial <strong>Court</strong> has not at all discussed in the impugned order as <strong>to</strong> how their impletion<br />
would help the <strong>Court</strong> in proper adjudication of the suit – The impugned order is very cryptic and nonspeaking<br />
– Learned <strong>Court</strong> below did not apply its judicial mind and conscience while deciding <strong>to</strong> implead<br />
them which definitely has caused prejudice <strong>to</strong> the plaintiff – Held, the impugned order is set aside –<br />
Direction issued <strong>to</strong> the <strong>Court</strong> below <strong>to</strong> proceed with the suit if pleadings are complete.<br />

I of the Schedule so he could not get any right in the property of his grand father under the provision –<br />
The right of a son’s son on his grand father’s property during the life time of his father which existed under<br />
Hindu law as in force before the succession Act, was not saved expressly by the Act and therefore the<br />
earlier interpretation of Hindu law giving a right by birth in such property ceased <strong>to</strong> have effect.

Wife filed large number of cases against the appellant-husband and in one of such cases the parents of<br />
the appellant arrested and taken in<strong>to</strong> cus<strong>to</strong>dy – Such conduct of the wife proves mental <strong>to</strong>rture on the<br />
husband – since matrimonial bond between the parties ruptured, there is hardly any chance of reunion<br />
– No fruitful purpose will be served by refusing a decree of divorce by dissolving the marriage between<br />
the parties – Held, impugned judgement u/s 13 of the Act is set aside – Marriage between the parties<br />
stands dissolved and decree of divorce is passed – Order of permanent injuction against the appellanthusband<br />

1. The 13 th <strong>High</strong> <strong>Court</strong> Mega Lok Adalat was held on 06.04.13 in which Hon’ble Shri Justice P. K. Mohanty,<br />

Mishra and Hon’ble Shri Justice Raghubir Dash, Judges of the Hon’ble <strong>Court</strong> presided over the Lok Adalat<br />
Benches. In the above Lok Adalat 181 number of Cases were disposed of which includes MAC Appeals,<br />
Writ Petition and Land Acquisition cases by way of Compromise. The General Insurance Companies<br />
agreed <strong>to</strong> pay Rs.2, 76,61,000/- (Two crore Seventy Six Lakh sixty one thousand only) as compensation.<br />
2. During the period under report, 23 applicants have been provided with the benefit under the scheme of<br />
Legal Aid and Advice by the <strong>High</strong> <strong>Court</strong> Legal Services Committee <strong>to</strong> file and defend their cases in the<br />

INFRASTRUCTURAL DEVELOPMENT OF THE JUDICIARY<br />
DURING THE FINANCIAL YEAR <strong>2013</strong>-14<br />
The State Government in their Home Department have proposed <strong>to</strong> provide funds amounting <strong>to</strong><br />
Rs.75,00,00,000/- under State Plan for infrastructural development of the Judiciary during the financial year<br />
<strong>2013</strong>-14. Out of the said amount, a sum of Rs.69,00,00,000/- has been ear-marked for non-residential projects<br />
and the balance funds amounting <strong>to</strong> Rs.6,00,00,000/- for residential projects. The current year budget includes<br />
construction of 15 numbers of District <strong>Court</strong> Buildings for newly created Judgeships and two other District <strong>Court</strong><br />
Buildings.

e-<strong>Court</strong>s Project in Odisha<br />
In our State a Steering Committee under the chairmanship of Hon’ble Shri Justice M.M. Das and Hon’ble<br />
Shri Justice I. Mahanty, Hon’ble Shri Justice S.C.Parija and Hon’ble Shri Justice S.K. Mishra as members<br />
thereof, is moni<strong>to</strong>ring the implementation of the e-<strong>Court</strong>s project with the assistance of the Central Project<br />
Coordina<strong>to</strong>r, Shri R.K.Pattanaik.<br />
The scope of e-<strong>Court</strong>s project is <strong>to</strong> develop, deliver, install and implement au<strong>to</strong>mated decision making and<br />
decision support system in the district and subordinate courts of the state with the help of e-Committee Supreme<br />
<strong>Court</strong> of India.<br />
The objectives of the project are:<br />
To help judicial administrations of the courts in streamlining their day-<strong>to</strong>-day activities<br />
• To assist judicial administration in reducing the pendency of cases<br />
• To provide transparency of information <strong>to</strong> the litigants<br />
• To provide access <strong>to</strong> legal and judicial databases <strong>to</strong> the judges.<br />
The state judiciary, configured <strong>to</strong> 115 court complexes, consists of 423 courts situated in different parts<br />
of the state.<br />
The following progress have been achieved in the state under e-<strong>Court</strong>s project<br />
1. Site preparation of 115 <strong>Court</strong> complexes is completed.<br />
2. Delivery and installation of hardware have been progressively made.<br />
3. About 476 judicial officers are provided with lap<strong>to</strong>ps and printers.<br />
4. 41 nos. of Diesel Genera<strong>to</strong>r sets are already provided while further 48 nos. of Diesel Genera<strong>to</strong>r sets are<br />
ordered <strong>to</strong> be delivered.<br />
5. 14 nos. of System Officers and 28 nos. of System Assistants have been deployed at District level <strong>to</strong><br />
provide the technical support.<br />
6. Successful data entry is going on at 104 <strong>Court</strong> Complexes.<br />

ACTIVITIES OF ORISSA STATE LEGAL SERVICES AUTHORITY<br />
1. Lok Adalats<br />
(i) At State Level<br />
During the period from <strong>April</strong>, <strong>2013</strong> <strong>to</strong> <strong>June</strong>, <strong>2013</strong>, 04 State Level Lok Adalats were held one each<br />
at Bhubaneswar, Bhadrak, Puri and Balasore on 20.4.<strong>2013</strong>, 27.4.<strong>2013</strong>, 4.5.<strong>2013</strong> and 22.6.<strong>2013</strong> respectively,<br />
in which, 757 number of cases were disposed of which consisted Matrimonial -284 and MACT-473. A sum<br />
of Rs.9,25,73,147/- was awarded as compensation in the above MACT cases.<br />
Further, a Special State Level Lok Adalat for disposal of matrimonial and other cases was also held<br />
at Balasore on 20.4.<strong>2013</strong>, wherein, in <strong>to</strong>tal 2047 number of cases were disposed of on conciliation which<br />
comprised of Civil-440, Compoundable Criminal cases-1219, Matrimonial-385 and MACT-03. A sum of<br />
Rs.1,28,590/- <strong>to</strong>wards Criminal fine was realized in the above Criminal cases and Rs.6,45,000/- was<br />
awarded as compensation in the MACT cases.<br />
(ii) At <strong>High</strong> <strong>Court</strong> Level<br />
During the above period, the <strong>High</strong> <strong>Court</strong> Legal Services Committee has organized<br />
a Mega Lok Adalat on 06.4.<strong>2013</strong> in the <strong>High</strong> <strong>Court</strong> Premises in which, 181 number of cases have been<br />
disposed of which consisted of Mo<strong>to</strong>r Accident Claim Appeals-86, Land Acquisition Cases-14 and OJC/<br />
W.P.(c)-81. A sum of Rs.2,76,61,000/- has been awarded <strong>to</strong>wards compensation in the above Mo<strong>to</strong>r<br />
Accident Claim Appeals.<br />
(iii) At District & Taluk Levels<br />
During the above period, 186 no.of District and Taluk Level Lok Adalats have been organized in the<br />
State of Odisha by the field units i.e. 30 District Legal Services Authorities and 73 Taluk Legal Services<br />
Committees. In the above District and Taluk Level Lok Adalats, in <strong>to</strong>tal 35,304 no.of cases have been<br />
disposed of which consisted of Civil-563, Compoundable Criminal Cases-17,790, Revenue-14,463<br />
Matrimonial-14 Bank-2187, BSNL-180 , Labour-02, Consumer-02 and MACT- 103. A sum of Rs.25,05,033/<br />
- <strong>to</strong>wards Criminal fine and Rs.71,32,394/- as Revenue have been collected in the said Lok Adalats.<br />
Further, a sum of Rs.2,16,27,500/- has been awarded <strong>to</strong>wards compensation in the above Mo<strong>to</strong>r Accident<br />
Claim Cases.<br />
2. Permanent Lok Adalats(PUS)(U/s.22-B of the L.S.A.Act.,1987)<br />
During the above quarter, 359 number of cases relating <strong>to</strong> Public Utility Services were registered<br />
in the Thirteen Permanent Lok Adalats, out of which, 331 no. of cases were disposed of.<br />
3. Activities of Mediation Centres<br />
Training and Awareness Programmes<br />
With a view <strong>to</strong> evaluate the impact of mediation training and awareness programmes, the Mediation<br />
& Conciliation Project Committee, Supreme <strong>Court</strong> of India has selected Berhampur and Puri in Odisha<br />
for the pilot programme.<br />
A ‘one day discussion programme’ was held at Berhampur on 13.4.<strong>2013</strong> and Puri on 14.4.<strong>2013</strong><br />
respectively involving the Referral Judges, Advocate-Media<strong>to</strong>rs and Co-ordina<strong>to</strong>r and staff of Mediation<br />
Centre. The above programme was graced by Hon’ble Mr.Justice Madan B.Lokur, Judge, Supreme <strong>Court</strong><br />
of India & Member, MCPC.
Similarly, another ‘Awareness Programme and Refresher Course for the Referral Judges and<br />
Advocates-Media<strong>to</strong>rs’ was also held at Berhampur on 11.5.<strong>2013</strong> and at Puri on 12.5.<strong>2013</strong> by the<br />
Mediation Conciliation Project Committee involving Advocate-Media<strong>to</strong>rs, Referral Judges and Bar Members<br />
of Puri and Berhampur. Master Trainers of Delhi Mediation Centre deputed by Mediation & Conciliation<br />
Project Committee had attended as Resource Persons for both the programmes.<br />
Further, another Awareness Programme for Referral Judges Training and Refresher course<br />
for Advocate-Media<strong>to</strong>rs was also organised on 29.6.<strong>2013</strong> at Berhampur & on 30.6.<strong>2013</strong> at Puri involving<br />
the participants such as Advocate-Media<strong>to</strong>rs, Referral Judges and Bar Members of Puri and Berhampur<br />
Bar Associations. Mr.Alok Aggarwal & Mr.V.K.Bansal, Judicial Officers, Ms.Anupam Dhingra, Master<br />
Trainer of Delhi Mediation Centre deputed by Mediation & Conciliation Project Committee had attended<br />
as Resource Persons for both the programmes.<br />
During the above period, 239 no. of cases were referred by the different <strong>Court</strong>s <strong>to</strong> the Mediation<br />
Centres of the State for mediation, out of which, 183 no.of cases were disposed of and in 51 no.of cases<br />
mediation becomes successful.<br />
4. Legal Literacy/Awareness Campaign<br />
During the above quarter, the field units i.e 30 District Legal Services Authorities and 73 Taluk Legal<br />
Services Committees organized 282 no.of Legal Literacy/Awareness Camps in relation <strong>to</strong> Pre-Natal Sex<br />
Selection and Pre-Natal Diagnostic Technique (PNDT) Act, Women and Children in need of care and<br />
protection, MGNREGA Camps, awareness camps on the rights of women and on Protection of Women<br />
from Domestic Violence (PWDV) Act, awareness programmes against child labour and different social<br />
schemes of the Government, as per National Planof Action for <strong>2013</strong>-14 & Calendar of Activities of NALSA.<br />

1 A Special Session was addressed by Hon’ble Mr. Justice A. K. Patnaik, Judge, Supreme <strong>Court</strong> of India<br />
on 18.05.<strong>2013</strong>. His Lordship interacted with the newly recruited Judicial Officers on the <strong>to</strong>pic “ Judicial<br />
Decorum” and explained the necessity of quality required of a Judge and also explained the procedure<br />
for dispensation of justice. Finally, His Lordship reminded them of their oath and <strong>to</strong> go by the Rule of Law<br />
<strong>to</strong> uphold the majesty of Law by acting fearlessly.<br />
2. A Special Session was addressed by Hon’ble Mr. Justice V. Gopala Gowda, Judge, Supreme <strong>Court</strong> of<br />
India on 11.05.<strong>2013</strong> on the <strong>to</strong>pic “Constitution vis-à-vis Criminal Law”. It was basically an interactive Session<br />
with the newly recruited Judicial Officers wherein His Lordship deliberated on Social Justice <strong>to</strong> Common<br />
man in a welfare State.<br />
3. New Legislation like Protection of Child Rights Commission Act, 2005 and Protection of Children from<br />
Sexual Offences Act, 2012 have been deliberated in extra programmes on the request of State Government<br />
in Women & Child Development Department.
