C. NAGAPPAN,
Chief Justice
MESSAGE
I am happy to release the Court News for the quarter April-June, 2013.
New Judgeships of Malkangiri, Deogarh and Jagatsinghpur were
inaugurated during this quarter. 20 Courts of Addl. District & Sessions Judge at
Puri, Cuttack, Jagatsinghpur, Athagarh, Bhubaneswar, Khurda, Nayagarh,
Rourkela, Balasore, Bhadrak, Sambalpur, Aska, Koraput, Jharsuguda, Keonjhar,
Jajpur, Baragarh, Dhenkanal, Berhampur and Baripada have been made functional
during this period. That apart, two Family Courts at Dhenkanal and Jeypore and
the court of the Senior Civil Judge at Kujanga have been inaugurated. I am sure
that the new courts would definitely cater to the need of the litigant public.
Elevation of three permanent Judges to the Bench of the High Court
during the period is definitely a remarkable addition to the justice delivery
system.
(C. Nagappan)

OUTLINES OF SOME RECENT ORISSA HIGH COURT JUDGEMENTS
TIKI @ PRASANT BARIK-V- STATE OF ORISSA
BLAPL NO.29609 OF 2012 (Dt.03.04.2013)
CRIMINAL PROCEDURE CODE, 1973 – S. 439.
Bail – Offence U/ss.457, 395 I.P.C. – Petitioner prays bail on the ground of Parity as similarly
situated Co-accused released on bail – Factual difference between the two cases – Moreover since bail
granted to the Co-accused is not supported by reasons, the same cannot form the basis for granting bail
to the petitioner on the ground of parity – Petitioner involved in seven other Criminal Cases and accusations
against the petitioner are serious in nature – Held, bail petition is rejected.
(B. N. Mahapatra, J.)
KANHU CHARAN DASH -V- STATE OF ORISSA (VIG.)
CRL.REV. NO.763 OF 2012 (Dt.03.04.2013)
ODISHA PUBLIC DISTRIBUTION SYSTEM (CONTROL) ORDER, 2008 – CLAUSE-11
Violation of Clause-11 (i) (b) of the PDS (Control) Order, 2008 would occur where even, after
payment of cost of the commodities and on demand the wholesaler/storage agent failed to supply the
commodities immediately – Unless there is material to show that the storage agent or the wholesaler
deliberately refused or failed to supply the commodities on demand for which price has already been paid,
there cannot be any violation of Clause-11 (i) (d) of the PDS (Control) Order, 2008.
In this case the statement of the retailers show that the petitioner has neither refused nor deliberately
failed to supply the rice and sugar to the retailers but the same was caused due to the difficulties of the
retailers regarding transportation they failed to lift the entire quantity issued in their favour – Held, it can
not be said that the petitioner has violated Clause-11(i) (b) of the PDS (Control) Order, 2008 and therefore
he cannot be charged U/s.7 of the EC Act – Impugned order is set aside and the petitioner is discharged
from the charge leveled against him.
(B. K. Nayak, J.)
DR. TIRUPATI PANIGRAHI & ORS.-V- STATE OF ORISSA
BLAPL NO.2282 OF 2013 (Dt.04.04.2013)
CRIMINAL PROCEDURE CODE, 1973 – S.439.
Bail – Offence U/ss.341, 323, 294, 506, 420, 471 & 34 I.P.C. read with Section 3(1)(x) of the
SC & ST (P.A.) Act.
Petitioners induced public to invest money for residential plots – Complainant and many others
deposited money but not provided with plots in spite of repeated requests – Petitioners not even in
possession of genuine transferable homestead land to sell the investors as per their own promise –
Petitioners with dishonest intention cheated the public and misappropriated their money knowing very well
that they were not in a position to provide land to the applicants – It cannot be said that it is a case of
breach of contract simplicitor and it would not constitute any offence U/ss. 420, 406 I.P.C. – In this case,
although the dispute is Civil or Commercial in nature it contains ingredients of Criminal Offences and
subsequent assurance of the petitioners to handover plots or to refund money with interest would not wash
away the culpability of the petitioners – Held, the application for bail is rejected.
CRL.REV. NO.161 OF 2012 (Dt.04.04.2013)
NEGOTIABLE INSTRUMENTS ACT, 1881 – Ss.138, 143
Complaint Case U/s. 138 N. I. Act – In normal Case trial has to be conducted in summary
procedure – Summary procedure may be dispensed with only if the Magistrate in terms of the Second
proviso to Section 143 (1) N.I. Act after hearing the parties passes an order to the effect that the nature
of the case is such that a sentence exceeding one year may have to be passed or for any other reason
it is undesirable to try the case summarily and any departure from such procedure would vitiate the trial
– The passing of an order not to follow the summary procedure of trial may be passed suo motu or on
the application of either of the parties and both parties must be heard before such order is passed – But
where ever evidence from both sides has already been closed or complaints already disposed of, the
matter shall not be re-opened for fresh trial by the Magistrate or as the case may be by the appellate
or revisional Court.
In the present case since evidence from both sides has already been recorded by following summons
procedure direction given by the learned JMFC, Khallikote in the impugned order for denovo trial is
quashed – Learned JMFC is directed to hear arguments and dispose of the complaint case within two
