is stated as follows:
“To establish a non-profit medical model healthcare facility, imbedded
with ethnic-specific psycho-socio-emotional, religious and culturallysensitive
services for the Filipino-American aging population in the San
Francisco Bay Area and promote replication advocacy of said model
across the country.
C. POLICIES AND PROCEDURES: DEFINING THE STRUCTURES OF
PROGRAM DEVELOPMENT OF THE FOUNDATION
Policy Statement #1: Sine Quod Non Habet
Prior to determining the Policy and Procedural Statements that would
define the STRUCTURES of Program Development and effectively carry to
accomplish the mission of the Foundation, it should be made clear that the
following procedural statements are needed to be complied with:
1. Pre-requisite Procedural Statements:
1a. Organization and Management.
• Determine from among the Calantas Children on their commitment to come
on board and join the CRUSADE of the (1) Foundation, by being elected as
(2) members of the board, trustees and officers, (3) register the Foundation in
California and secure a tax-exempt status from the IRS (501.c3) and FTB,
(4) adopt the 3 Phases of Program Development and (5) conduct fundraising
activity for the Phases 1 and 2 Scholarship Program in the Philippines.
• Agree to meet at least once a year for Board Meeting, Election of Officers,
Board Members and Trustees;
• Write and adopt a Articles of Incorporation and By-Laws of the Foundation.
1b. Legal Requirements via Initial Agent for Service of Process
• Register the Foundation into a non-profit, non-stock corporation under the
Nonprofit Public Benefit Corporation Law (Title 1, Div. 2, Part 2, ss. 5110 et seq.
of the California Code of Regulations) through the Office of the Secretary of State
in California as: CYDF USA, Inc.
• Obtain State Tax Exempt Status under Section 23701d of the Revenue and
Taxation Code in California; and/or,
• Obtain Federal Tax Exempt status under Section 501.c3 of the IRS Code;
• Obtain a TIN (Tax Identification Number) from the IRS;
• Other legal papers, as determined and required (DOJ, BE, EDD, DIR, FTB and
City).
• Once the Foundation is registered as a nonprofit organization, it has to be registered
in the City where the main Office is located at: San Francisco, CA.
