PART 2 - STANDARD CONDITIONS<br />

1. MEANING OF WORDS<br />

"Booking"<br />

The date and time specified in Item 9 when you<br />

need the venue and the equipment (if any)<br />

"Bond" The bond specified in Item 1.<br />

5. CONDITIONS OF USE<br />

"Equipment" The equipment specified in Item 7.<br />

Use<br />

"Fee" The fee specified in Item 2.<br />

5.1 You and your employees, agents, visitors, and invitees must --<br />

"Activity" The activity specified in Item 8.<br />

(a) Use the venue and the equipment for the activity on the date<br />

"Premises" The venue and the land on which the venue is<br />

situated as shown on the plan in Part 4.<br />

(b)<br />

and between the times specified in Part 1;<br />

Not use the premises for any illegal purpose or, in our opinion,<br />

"Social function" An event or occasion to which persons are invited<br />

to by you or on your behalf.<br />

The venue specified in Item 6 and shown on the<br />

either the <strong>State</strong> of Queensland or the corporation<br />

Enter and exit the venue through the openings or gates and<br />

(g) Not smoke inside the venue, if the venue is a building;<br />

2. INTERPRETING THIS AGREEMENT<br />

2.1 This agreement consists of the following, which make up and govern<br />

the entire agreement between you and us --<br />

(a) Part 1 - the Application on page 1;<br />

(b) Part 2 - the <strong>Standard</strong> Conditions starting on page 2;<br />

(c) Part 3 - the Special Conditions starting on page 5;<br />

(d) Part 4 - the plan of the premises on page 6;<br />

(e) The written approvals referred to under clause 7.1.<br />

2.2 If two or more persons are named in Item 1 their responsibilities<br />

under this agreement binds them jointly and each of them<br />

separately. For example, we may ask one person to pay money owing<br />

to us under this agreement, without asking the other.<br />

2.3 A reference to --<br />

(a) A person includes a reference to an entity recognised by a<br />

law, for example, a corporation;<br />

(b) A clause is a reference to a clause in this agreement;<br />

(c) A numbered item is a reference to the item with that number<br />

in Part 1.<br />

2.4 A term in Part 2 overrides a term in Part 3 to the extent that they are<br />

inconsistent.<br />

2.5 The singular includes the plural and the plural includes the singular.<br />

3. BOND<br />

3.1 You must pay the bond at the time you sign this agreement.<br />

3.2 You may pay the fee --<br />

(a) At least 14 days before the booking; or<br />

(b) At the time you sign this agreement; if you need the venue<br />

within 14 days.<br />

4. CANCELLATION AND REFUNDS<br />

4.1 We will refund to you the bond and the fee paid if you cancel the<br />

booking at least 14 days before the booking.<br />

4.2 We may keep the bond and the fee paid if you cancel the booking<br />

within 14 days of the booking.<br />

4.3 We may cancel the booking and end this agreement --<br />

(a) If you do not pay the fee on time; or<br />

(b) At any time if --<br />

(i) In our opinion the venue has become unfit or unsafe for<br />

use for the activity;<br />

(ii) You do not keep to the conditions of this agreement;<br />

(iii) A person who we have refused entry to the premises<br />

under clause 5.7(a) enters it; or<br />

(iv) A person who we have directed to leave the premises<br />

under clause 5.7(b) fails to do so.<br />

4.4 We will refund to you the bond and the fee paid if --<br />

(a) We cancel the booking under clause 4.3(b)(i); and<br />

(b) In our opinion you or your employees, agents, visitors, or<br />

invitees have not caused the venue to become unfit or unsafe<br />

for use for the activity.<br />

4.5 We will refund the bond to you if you have left the premises in a<br />

condition to our satisfaction and you have kept to these conditions.<br />

4.6 We are not liable for any loss or damage because of any cancellation<br />

by us.<br />

(h) Not alter or make improvements to the premises;<br />

(i) Not move or remove any fixture or fitting of the venue;<br />

(j) Not bring animals on the premises;<br />

(k) Keep to any other conditions of use signed on the premises.<br />

Access<br />

5.2 We will give you a key for each lock to gain access to the venue.<br />

5.3 You must return all keys to us at the end of the booking.<br />

5.4 You must at the end of the booking --<br />

(a) Close and lock the venue's gates, windows and doors; and<br />

(b) Switch off the venue's lights, fans, air conditioners, and other<br />

electrical equipment used.<br />

5.5 You must provide security staff for the venue, if we so require.<br />

5.6 You do not have exclusive use of the venue and we may access the<br />

venue at any time even when you are using it.<br />

Entry and removal of persons<br />

5.7 We may at any time --<br />

(a) Refuse entry to you, or your employees, agents, visitors, or<br />

invitees to the premises;<br />

(b) Direct you, or your employees, agents, visitors, or invitees to<br />

leave the premises.<br />

Supervision<br />

5.8 You may supervise and control your employees, agents, visitors, and<br />

invitees on the premises.<br />

Liquor – Not applicable at <strong>Centenary</strong> <strong>State</strong> <strong>High</strong> <strong>School</strong><br />

5.9 You must apply for an appropriate liquor permit under the Liquor Act<br />

1992, if liquor will be supplied or sold at the venue.<br />

5.10 For more information about the supply and sale of liquor, and liquor<br />

permits, contact the nearest Liquor Licensing Division of the<br />

Department of Tourism, Racing and Fair Trading.<br />

5.11 No liquor is to be consumed, supplied, or sold at the venue unless --<br />

(a) The activity is a social function;<br />

(b) The Yes box in Item 10 has been ticked or crossed;<br />

(c) We have approved in writing that liquor may be consumed,<br />

supplied, or sold at the venue;<br />

(d) The Parents and Citizens Association referred to in clause<br />

7.1(b) has approved in writing that liquor may be consumed,<br />

supplied, or sold at the venue; and<br />

(e) You have shown to us the original of the permit referred to in<br />

clause 5.9 before the booking starts.<br />

5.12 We may take a copy of the permit shown to us under clause 5.11(e).<br />

5.13 You must adhere to the conditions of the permit referred to in clause<br />

5.9.<br />

Things to be left clean and tidy<br />

5.14 You must leave the premises and the equipment in a clean and tidy<br />

condition, and in the same condition they were in at the start of the<br />

booking. We may arrange for the cleaning of the premises and the<br />

equipment at your cost if you do not clean them.<br />

5.15 Furniture and equipment on or in the venue must not be moved,<br />

unless, before the booking, you have received our approval to do<br />

so. If we give our approval, you must put the furniture and<br />

equipment back to its original position at the end of the booking.<br />

5.16 You must remove from the premises all things, including rubbish,<br />

brought on to the premises because of this agreement, at the end<br />

of the booking. We may arrange for the things to be removed at<br />

your cost if you do not remove them.<br />

5.17 You must not use rubbish bins on the premises.

Responsibility for damage etc.<br />

5.18 You are responsible for --<br />

(a) Damage, loss, or injury to any person or property; and<br />

(b) The cost of any security or emergency call-out to the<br />

premises;<br />

arising from the activity and use of the venue and equipment.<br />

5.19 We are not responsible for the things mentioned in clause 5.18.<br />

5.20 You will indemnify us, our employees, and agents against all claims<br />

for damages, loss, costs, or injury arising from the activity and the<br />

use of the venue or equipment.<br />

5.21 You must pay, within the time set by us --<br />

(a) For any damage to or loss of our property arising from the<br />

activity and use of the venue or equipment;<br />

(b) The charges that we decide if --<br />

(i) You or your employees, agents, visitors, or invitees use<br />

any part of the premises other than the venue;<br />

(ii) You or your employees, agents, visitors, or invitees use<br />

the premises outside the booking.<br />

Advertising<br />

5.22 No advertising material is to be erected or displayed on the<br />

premises unless you have received our written approval to do so<br />

before the booking.<br />

5.23 Advertising to promote the activity at the venue must not be used<br />

unless you have received our written approval to do so before the<br />

booking.<br />

5.24 As a guide, we will not approve advertising that --<br />

(a) Is of a nature that might imply that we are involved with or<br />

endorse the thing advertised;<br />

(b) Refers to the premises other than to show the location of the<br />

venue;<br />

(c) Is in our opinion objectionable.<br />

Warranties<br />

5.25 We do not warrant that the venue and the equipment are fit,<br />

suitable, or adequate for the activity and all warranties able to be<br />

excluded by law are excluded.<br />

5.26 You warrant that --<br />

(a) You have satisfied yourself that the venue and the equipment<br />

are fit for the activity;<br />

(b) The venue and the equipment are in good condition; and<br />

(c) You have been given adequate information about the venue<br />

and the equipment to ensure its use without risk to any<br />

person.<br />

No rehire<br />

5.27 You must not rehire the venue or give the benefit of this agreement<br />

to someone else without our written approval.<br />

6. SPECIAL CONDITONS<br />

You and your employees, agents, visitors, and invitees must keep to any<br />

special conditions specified in Part 3, as the context requires.<br />

7. AGREEMENT<br />

7.1 This agreements only comes into effect if --<br />

(a) We approve your application in writing; and<br />

(b) The Parents and Citizens Association has approved in writing --<br />

(i) The activity;<br />

(ii) Liquor being consumed, supplied, or sold at the venue;<br />

and<br />

(iii) The conditions of this agreement.<br />

7.2 Clause 7.1(b) only applies if --<br />

(a) The activity is a social function; and<br />

(b) Liquor is to be consumed, supplied, or sold at the venue;<br />

(c) The premises is a school and<br />

(d) The school has a Parents and Citizens Association.<br />

7.3 We will promptly let you know in writing whether --<br />

(a) We have approved your application; and<br />

(b) If applicable, the Parents and Citizens Association has<br />

approved the things mentioned in clauses 7.1(b)(i), 7.1(b)(ii)<br />

and 7.1(b)(iii).<br />

7.4 We will give this agreement to the Parents and Citizens Association<br />

for their approval.<br />

PART 3 - SPECIAL CONDITIONS<br />

PLEASE OBSERVE OUR SAFETY RULES &<br />

IN ORDER TO PRESERVE THE SURFACE AREAS IN PAC AND SRC<br />

PLEASE NOTE THE FOLLOWING<br />

1. Public risk liability or personal accident insurance to<br />

the value of $10,000,000 must be held by the hirer, a<br />

copy to be presented to <strong>Centenary</strong> <strong>State</strong> <strong>High</strong> <strong>School</strong>.<br />

No responsibility for injury or accident will be accepted<br />

by the school.<br />

2. Facilities and equipment are to be treated with due<br />

care.<br />

3. <strong>Centenary</strong> SHS encourages players and coaches only on<br />

the playing area in the Sport and Recreation Centre.<br />

This is a safety issues. Spectators are welcome to view<br />

from the mezzanine level, foyer area or outside the<br />

back doors.<br />

4. All children must be appropriately supervised at all<br />

times, particularly on the mezzanine level of the Sport<br />

and Recreation Centre. No running, climbing or<br />

wrestling on the mezzanine please.<br />

5. Intoxicating liquor, drugs and smoking are prohibited<br />

on the school premises.<br />

6. Vehicles that enter the school grounds are to travel<br />

only on designated roads and to park only in<br />

designated parking areas.<br />

7. All vehicles are to keep to the speed limit of 15km per<br />

hour.<br />

8. The roundabout outside the PAC and SRC buildings is<br />

for drop off purposes only. This is a no parking zone<br />

and no cars are to be here for longer than two minutes.<br />

9. Advertising on <strong>Centenary</strong> <strong>State</strong> <strong>High</strong> <strong>School</strong> property or<br />

premises for private, commercial or propaganda<br />

purposes is not permitted.<br />

10. Food and drink may only be consumed in areas<br />

designated for this purpose.<br />

11. No food or drink is allowed within the Performing Arts<br />

Centre or the playing courts of the Sports and<br />

Recreational Centre.<br />

12. Only joggers and flat shoes (no black soles) are to be<br />

allowed on the playing court area of the Sport and<br />

Recreation Centre.<br />

13. Rubbish must be disposed of in the appropriate<br />

containers and/or removed from the premises at the<br />

end of each daily occupation.<br />

14. Any school apparatus/furnishing moved by the hirer or<br />

their members shall be replaced in the same order and<br />

condition by the hirer at the end of each daily<br />

occupation.<br />

15. No fixtures are to be moved from their places without<br />

the consent of the Principal.<br />

16. The hirer must observe and follow all noise regulations<br />

as per the Brisbane City Council, Queensland Police and<br />

Queensland <strong>State</strong> Government stipulations.<br />

17. The hirer agrees to the payment of any costs incurred<br />

by <strong>Centenary</strong> SHS on their behalf for failing to alarm a<br />

building/venue or that directly results in a site visit by<br />

security personnel.<br />
