payroll, the payroll company calculates the premium at the same time they calculate the insured’s payroll, and<br />

What kinds of complaints are covered<br />

Alleged sexual harassment and/or wrongful termination and/or (most often) discrimination based on sex, race,<br />

age, nationality, religion, etc. These complaints often arise because the plaintiff feels that they were turned<br />

down for a pay raise or unfairly treated, or as a direct result of being terminated. Often the claims will come<br />

from applicants who allege that discrimination was the main reason that they did not get the job.<br />

If I never discriminate against my employees why would I need insurance<br />

A large portion of disputes are frivolous, (something like 60%) and are eventually proved to be false. However,<br />

the employer must prove their innocence. It is important to note that <strong>AmTrust</strong> Workplace coverage is a ‘duty<br />

to defend’ coverage, so we are there to help our clients navigate these situations, frivolous or otherwise.<br />

The employee is unlikely to fully understand the law and will assume that their definition of unfair treatment<br />

on the limit and automatic roll-on coverage. Higher limit coverage options are available. Contact your agent for<br />

Do I have to complete long, complicated applications<br />

No, for the majority of insureds our application is only one page and is very straightforward. In fact, if the<br />

coverage is automatically rolled on by the company, no application is needed at all.<br />

What if I decide I do not want the coverage<br />

Although we strongly believe that all companies need this protection, if you decide you do not want the<br />

coverage when it has been automatically rolled on to your policy, just send us a signed rejection form and it<br />

can be removed.<br />

How are the claims handled<br />

CyberComp is a web-based workers’ compensation application and policy processing system that<br />

allows agency representatives to efficiently submit workers’ compensation policies without interaction from<br />

underwriters. This bind online workers’ compensation insurance product is available to select <strong>AmTrust</strong> agents<br />

upon approval.<br />

CyberComp policies with a WCX or WCA prefix were written prior to <strong>AmTrust</strong> acquiring the company.<br />

Submission Requirements<br />

For underwriting review, retain the following information:<br />

• Complete ACORD application including insured’s FEIN and a good description of operations<br />

• A completed questionnaire from our Web site<br />

• Any appropriate narrative that clarifies the operation and experience of the risk<br />

Underwriting Guidelines<br />

To be eligible for consideration, each risk must meet the following criteria:<br />

• One of more than 350 eligible classifications across all major industry groups, including manufacturing,<br />

construction, wholesale / retail, service, office / clerical<br />

• Max Annual Premium for all classes – $60K for new business; $100K for renewal cap<br />

• Competitive pricing through schedule rating program with credits up to 25%<br />

• New and renewal business experience mods of 1.35 or less are eligible<br />

• Multi-state availability, up to seven states per account<br />
