Re: Proposed Residential Development at <strong>Field</strong> <strong>Farm</strong>, Stapleford, Nottingham<br />
Site Investigation and Environmental Noise Assessment Reports<br />
Further to your recent enquiry, we have reviewed the status of the site investigation and<br />
environmental noise assessment reports relating to the above site, in line with the recent<br />
implementation of the National <strong>Planning</strong> Policy Framework (NPPF) document dated<br />
27 th March 2012. We would like to comment as follows:<br />
Site Investigation Work<br />
This work included the production of the following reports:<br />
• BSP Consulting Report entitled ‘<strong>Field</strong> <strong>Farm</strong>, Stapleford: Phase I & II Ground<br />
Investigation Report’, reference 10172, dated July 2010.<br />
• BSP Consulting Report entitled ‘<strong>Field</strong> <strong>Farm</strong>, Stapleford: Supplementary Phase II<br />
Ground Investigation Report’, reference 10172, dated December 2010.<br />
We would also note that other guidance in relation to Contaminated Land has also<br />
recently been issued, in particular the DEFRA publication ‘Environmental Protection<br />
Act 1990: Part 2A Contaminated Land Statutory Guidance (dated April 2012) and The<br />
Contaminated Land (England) (Amendment) Regulations 2012. These documents<br />
variously replace and/or update other statutory documents concerning the statutory<br />
Contaminated Land regime.<br />
The implementation of the NPPF replaced <strong>Planning</strong> Policy Statement (PPS) 23<br />
‘<strong>Planning</strong> and Pollution Control’, which was previously a key planning document for<br />
the management of pollution of the environment (including Contaminated Land).<br />
However, the key elements with regards to the requirement for appropriate site<br />
investigation, characterisation, assessment and remediation works (as necessary) remain<br />
integral to the NPPF document (detailed specifically within Section 121).<br />
We would additionally note that current industry best practice and guidance documents<br />
(including the 2004 Defra and Environment Agency issued CLR 11 publication; the<br />
model procedures for Management of Land Contamination) have not been withdrawn or<br />
replaced by the NPPF document or the Contaminated Land Statutory Guidance, and the<br />
works undertaken at the site were undertaken (and remain) in general accordance with<br />
industry best practice.<br />
Environmental Noise Assessment<br />
This work included the production of the following report:<br />
• BSP Consulting Report entitled ‘Noise Assessment’, reference 10172, dated 16<br />
September 2011.<br />
The NPPF replaced the previous guidance set out in PPG 24 ‘<strong>Planning</strong> and Noise’. To<br />
date, no detailed technical guidance regarding noise assessments has been published to<br />
support the NPPF.<br />
Paragraph 123 of the NPPF states that planning policies and decisions should aim to<br />
avoid noise from giving rise to significant adverse impacts on health and quality of life<br />
as a result of new development. The NPPF makes reference to the Noise Policy<br />
Statement for England (NPSE), however, no further criteria is provided within this<br />
document that could be used to ascertain the potential impact of noise on residents of<br />
the proposed dwellings. In light of this, it is still considered appropriate to use the<br />
guidance and methodologies set out in PPG24, and the Noise Exposure Categories<br />
(NEC’s) are still the most appropriate method to rate a site in terms of noise. We<br />
therefore consider that the previous Noise Assessment report is still valid in relation to<br />
the proposed residential development at <strong>Field</strong> <strong>Farm</strong>.<br />
