Pre-release access<br />

21. Pre-release access is defined in <strong>the</strong> Act as ‘access to <strong>the</strong> statistics in <strong>the</strong>ir<br />

final <str<strong>on</strong>g>for</str<strong>on</strong>g>m prior to publicati<strong>on</strong>’. Secti<strong>on</strong> 11 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Act specifically prevents <strong>the</strong><br />

<str<strong>on</strong>g>Code</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Practice</str<strong>on</strong>g> from dealing with ‘any matter relating to <strong>the</strong> granting <str<strong>on</strong>g>of</str<strong>on</strong>g> prerelease<br />

access to <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial statistics’, which will instead be determined by Orders<br />

(sec<strong>on</strong>dary legislati<strong>on</strong>) made under <strong>the</strong> Act. With this excepti<strong>on</strong>, <strong>the</strong>re are no<br />

specific c<strong>on</strong>straints <strong>on</strong> <strong>the</strong> c<strong>on</strong>tent <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g>.<br />

22. The Act states that ‘<strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g> shall apply in relati<strong>on</strong> to any <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial statistic<br />

as if it included any rules <strong>and</strong> principles provided <str<strong>on</strong>g>for</str<strong>on</strong>g> in relati<strong>on</strong> to those<br />

statistics’. This means that <strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g> has to be read as if <strong>the</strong> rules <strong>and</strong> principles<br />

relating to pre-release access were part <str<strong>on</strong>g>of</str<strong>on</strong>g> it – <strong>and</strong> thus <strong>the</strong> assessment process<br />

will take account <str<strong>on</strong>g>of</str<strong>on</strong>g> compliance with those rules, regardless <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> fact that<br />

<strong>the</strong>y are not set out in <strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g>.<br />

23. Because pre-release access is defined in <strong>the</strong> Act to refer <strong>on</strong>ly to statistics in<br />

<strong>the</strong>ir final <str<strong>on</strong>g>for</str<strong>on</strong>g>m prior to publicati<strong>on</strong>, <strong>the</strong> questi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> treatment <str<strong>on</strong>g>of</str<strong>on</strong>g> statistics<br />

be<str<strong>on</strong>g>for</str<strong>on</strong>g>e <strong>the</strong>y reach that final <str<strong>on</strong>g>for</str<strong>on</strong>g>m remains a matter <str<strong>on</strong>g>for</str<strong>on</strong>g> <strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>Practice</str<strong>on</strong>g>.<br />

Thus <strong>the</strong>re are references in Protocol 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> <str<strong>on</strong>g>Code</str<strong>on</strong>g> to principles governing<br />

access to statistics be<str<strong>on</strong>g>for</str<strong>on</strong>g>e publicati<strong>on</strong>. These references do not apply to statistics<br />

in <strong>the</strong>ir final <str<strong>on</strong>g>for</str<strong>on</strong>g>m.<br />

Administrative sources<br />

24. A large <strong>and</strong> growing proporti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial statistics are produced from<br />

data originally collected <str<strong>on</strong>g>for</str<strong>on</strong>g> administrative purposes, such as school records,<br />

hospital records <strong>and</strong> payment <str<strong>on</strong>g>of</str<strong>on</strong>g> benefits. The <str<strong>on</strong>g>Code</str<strong>on</strong>g> includes requirements<br />

(Protocol 3) <strong>on</strong> all public bodies that produce <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial statistics from<br />

administrative sources to observe certain practices <strong>and</strong> to prepare a Statement<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> Administrative Sources that should be subject to c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong><br />

Nati<strong>on</strong>al Statistician be<str<strong>on</strong>g>for</str<strong>on</strong>g>e finalisati<strong>on</strong>. These statements will set out how a<br />

range <str<strong>on</strong>g>of</str<strong>on</strong>g> practical matters are to be h<strong>and</strong>led. Fur<strong>the</strong>r advice <strong>on</strong> <strong>the</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g>m <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

statements will be issued by <strong>the</strong> Authority.<br />
