satisfied that the opposition was not vexatious.<br />

(3) If the circumstances disclosed in the Master's report or otherwise brought to the<br />

notice of the court are such that the court requires the Master to appear by counsel or to incur<br />

expenditure in making any inquiry or investigation, the costs of such appearance or investigation<br />

shall be borne by the insolvent and shall be a first charge upon the security furnished to the<br />

Registrar.<br />

(4) Among the conditions referred to in subsections (2) and (3) the court may for special<br />

reasons require the insolvent to consent to judgment being entered against him for any<br />

unsatisfied balance of the debt provable under the insolvency, or such lesser sum as the court<br />

may direct, but in such case execution shall not be issued on the judgment except with leave of<br />

the court and on proof that the insolvent has since his discharge acquired property or income<br />

available for the payment of his debts or the court may make any other condition with respect to<br />

any earnings or income which may afterwards become due to the insolvent or with respect to<br />

his after-acquired property.<br />

(5) Notwithstanding any written law requiring the officer in whose office is registered any<br />

obligation of the insolvent, upon notice of that insolvent's rehabilitation, to cancel that obligation,<br />

it shall be competent for the court where application for rehabilitation is granted in pursuance of<br />

an offer of composition, to order that any of the insolvent's registered obligations shall,<br />

notwithstanding the rehabilitation, remain of full force and effect.<br />

(6) The Registrar shall forthwith give notice to the Master of every rehabilitation of an<br />

insolvent granted by the court.<br />

113. Effect of order of rehabilitation<br />

(1) An order of rehabilitation shall not affect-<br />

(a) the rights of the trustee or creditors under any composition duly accepted by the<br />

creditors;<br />

(b) the rights, powers or duties of the Master or the duties of the trustee in regard to any<br />

such composition;<br />

(c) the right of the trustee or creditors to any part of the insolvent's estate which is vested<br />

in but has not yet been distributed by the trustee;<br />

(d) the liability of any surety for the insolvent; or<br />

(e) the liability of any person to pay any penalty or suffer any punishment under this <strong>Act</strong>.<br />

(2) Subject to subsection (1), and subject to such conditions as the court may attach to<br />

the order, an order of rehabilitation shall have the effect-<br />

(a) of putting an end to the sequestration;<br />

(b) of discharging all debts of the insolvent, not arising out of a fraudulent breach of trust,<br />

(c)<br />

which were due, or the cause of which had arisen, before the sequestration; and<br />

of relieving the insolvent of every disability imposed on him by the sequestration.<br />

(3) Notwithstanding anything contained in this section an order of rehabilitation granted<br />

on an application made in circumstances described in section 109(3) shall have the effect of<br />

re-investing the insolvent with his estate.<br />

114. Illegal inducements to vote for composition or not to oppose rehabilitation<br />

(1) Every benefit given or promised by the insolvent or on his behalf, and every<br />

agreement entered into with any person to obtain his consent to or induce him to abstain from<br />

opposing his rehabilitation, shall be void.<br />

(2) Any person who accepts any such benefit or promise or enters into any such<br />

agreement shall be liable to pay by way of penalty for the benefit of the creditors of the estate-<br />

(a) a sum equal to the whole of the claim (if any) which he originally proved against the<br />

estate;<br />

(b) the amount or value of any benefit given or promised; and<br />

(c) in the case of a composition, the amount paid or secured to him by the composition.<br />

115. Proceedings to recover penalty<br />
