4) Vendors have to quote as per description & specification mentioned in our Enquiry Sheet & in
Annexures & other enclosed specs / documents . Offer to be submitted strictly in two bid system
only and the offer submitted in single bid will not be considered. Deviation if any should be
brought out clearly in Techno-commercial bid – Part: 1.
5) The rates offered by vendors in Price Bid (Part – II) shall be applicable for part quantity also.
6) Vendors should indicate separately Basic Price, Duty & Cess, Tax (e.g.CST or VAT for indigenous
vendors) or any other factor affecting price in their quotation (in Price bid only).
7) Entry Tax as applicable shall be paid by BHEL and shall be loaded in the price quoted by
Vendors for deriving HESG price i.e. Landing Cost (at BHEL, Bhopal).
8) Vendor should clearly indicate their acceptance to BHEL’s Standard Payment Terms (refer
Annexure 2 for Indigenous Vendor & Annexure 2A for Foreign Vendor). Please note that to
evaluate the offers at par, offer of the bidders shall be loaded accordingly, if lower period of
credit is offered.
9) Please confirm the supply location from where dispatches will take place.
10) For Indigenous Vendors BHEL prefers supply of tendered item. on F.O.R. Destination (BHEL,
Bhopal) basis only, Refer Annexure – 2 & hence Transportation cost need not be mentioned
separately. Confirmation to this effect be clearly mentioned in techno-commercial Bid , i.e. in Part-I
Bid itself. Otherwise BHEL reserves the right to get the material transported on freight to pay basis
through its approved transporter and loading the freight charges as per BHEL transportation rate
contract will be done to arrive at HESG price i.e. Landing Cost at BHEL Bhopal. If vendors do not
include insurance in their scope, the same can be arranged by BHEL. For that purpose price
inclusive of freight shall be loaded by 0.065%.
11) For Foreign Vendors BHEL prefers supply of tendered item on F.O.B basis, Refer Annexure – 2A.
12) Quantity received & accepted at BHEL, Bhopal shall only be considered final and this quantity
shall only be taken for payment purposes.
13) Liquidated Damages / Penalty Clause: Please refer to Annexure: 3 ( For Indigenous Vendors) AND
Annexure: 3A resp ( For Foreign Vendors) – “General Terms & Conditions for Purchase Order”
attached herewith the Enquiry.
14) Tenders shall be evaluated on HESG price the total delivered cost to BHEL i.e. on F.O.R. BHEL,
Bhopal basis. In case of offer in foreign currency, exchange rate applicable on the date of
technical bid opening will be considered for price comparison.
15) Despite inspection by BHEL and or their authorized representative/customer at supplier
works, final inspection will be done at BHEL works. This condition is to be essentially
complied with.
16) The General Terms & Conditions of Enquiry & Purchase order for Vendors are attached herewith
as Annexure – 2 & 3 resp ( For Indigenous Vendors) AND Annexure – 2A & 3A resp ( For Foreign
Vendors) . Vendors have to confirm their acceptance / non-acceptance specifically clause-wise. If
nothing is written about it, it will be presumed that they have agreed to all the conditions therein.

17) In case of any contradiction between Special Terms & Conditions and General Terms &
Conditions, Special Terms & Conditions shall prevail.
18) Refer Annexure 4 for General Terms & Conditions Of REVERSE AUCTION.
19) All the new vendors, who are not registered with BHEL, Bhopal or Registered Vendor but
“Inactive”vendor code as per BHEL’s records should submit duly filled up Registration Form
[Details given in our website www.bhelbhopal.com] alongwith the techni-coomercial bid i.e. Part-I
bid. Based on the filled up Registration Form, BHEL shall assess the new / inactive vendors. If felt
necessary, BHEL may also collect business information about the vendor from other independent
agencies and BHEL’s representatives may visit to the vendor’s works for further assessment and
evaluation.
20) Validity of offers from the date of Techno commercial Bid opening, Refer Annexure – 2 ( For
Indigenous Vendors) AND Annexure – 2A ( For Foreign Vendors) .
21) Late / Delayed offers are not acceptable by BHEL. Hence, please ensure to submit the quotation
well in time.
22) Offer of Vendor(s) “DELISTED” or “BANNED” with BHEL shall not be considered.
23) The purchase order shall be issued according to BHEL’s requirement giving required lead time.
The vendor should ensure timely delivery as indicated in the purchase order.
24) Vendor should give clause by clause acceptance to all the above paragraphs and points mentioned
in all Annexures & other enclosed specs / documents. In case of any deviation the same may please
be brought out separately. BHEL reserves the right to accept or reject the deviations.
25) Vendor has to furnish & accept the above Technical, Commercial and General Terms & Conditions
as indicated in respective Clause / Para. If nothing is written about it, it will be presumed that you
have agreed to all the conditions therein.
26) BHEL reserves the right to accept or reject any of the bid / all the bids or cancel or withdraw the
invitation of tender without assigning any reason whatsoever and in such case no bidder / intending
bidder shall have any claim arising out of such action by BHEL.
