96. 84. From 1967 until 2000, SYSCO and Nova Scotia emitted Operational Emissions<br />

and Tar Ponds Contaminants from the Steel Works (except for 1968-1974 when<br />

Canada operated the Coke Ovens, and 1988-2000 when the Coke Ovens<br />

ceased to operate, during which periods Nova Scotia operated only the Steel<br />

Plant). These emissions we<strong>re</strong> deposited on the lands in the Neighbourhoods<br />

owned and/or occupied by the Plaintiffs and Class Members through the air in<br />

the form <strong>of</strong> vapour, particulate matter and dust, and through the earth and water<br />

migrating from the Coke Ovens Lands and the Sydney Tar Ponds.<br />

97. 85. From 1968-1974, Canada emitted Operational Emissions and Tar Ponds<br />

Contaminants from the Coke Ovens. These emissions we<strong>re</strong> deposited on the<br />

lands in the Neighbourhoods owned and/or occupied by the Plaintiffs and Class<br />

Members through the air in the form <strong>of</strong> vapour, particulate matter and dust, and<br />

through the earth and water migrating from the Coke Ovens Lands and the<br />

Sydney Tar Ponds.<br />

(ii) Domtar<br />

98. Until 1962, Domtar emitted the Domtar Contaminants from the By Products<br />

Operations. After Domtar abandoned the By Products Operations in 1962, the<br />

Domtar Contaminants continued to escape from the By Products Operations as a<br />

<strong>re</strong>sult <strong>of</strong> Domtar's, Ispat's (1962 1967), SYSCO's and Nova Scotia's (1967<br />

p<strong>re</strong>sent) failu<strong>re</strong> to <strong>re</strong>move the Contaminants <strong>re</strong>maining at the By Products<br />

Operations.<br />

(iii) (ii) CNR<br />

99. 86. Until 1994, CNR emitted the CNR Contaminants from its operations adjacent to<br />

the Sydney Tar Ponds. The CNR Contaminants we<strong>re</strong> deposited on the lands in<br />

the Neighbourhoods owned and/or occupied by the Plaintiffs and Class Members<br />

through the air in the form <strong>of</strong> vapour, and through the earth and water migrating<br />

from the land occupied by CNR and the Sydney Tar Ponds.<br />
