6. I submit this <strong>affidavit</strong> based on my experience, background and personal<br />
knowledge derived from my participation in this investigation and based on reports and<br />
information conveyed to me (as described herein) by other <strong>FBI</strong> Special Agents, <strong>FBI</strong> Intelligence<br />
Analysts and representatives of the Central Intelligence Agency (CIA). Because this <strong>affidavit</strong> is<br />
being submitted for the limited purpose of obtaining search warrants, I have not included each<br />
and every fact known to me concerning this investigation. I have only set forth the facts that I<br />
believe are necessary to establish probable cause to believe that evidence of the above criminal<br />
activity will be found in and on the locations, person and vehicle described in Attachments A<br />
through E.<br />
BACKGROUND OF HAROLD JAMES NICHOLSON<br />
7. On November 16, 1996, NICHOLSON was arrested in the Eastern District of<br />
Virginia and charged with Conspiracy to Commit Espionage after a comprehensive investigation<br />
revealed that NICHOLSON had been spying for the Russian Federation from June of 1994 until<br />
his arrest. At the time of his arrest, NICHOLSON was attempting to board a flight to Zurich,<br />
Switzerland, at Duiles International Airport. NICHOLSON was carrying a significant amount of<br />
classified material that he intended to provide to an agent of the Russian Federation in<br />
Switzerland.<br />
8. On March 3, 1997, NICHOLSON pleaded guilty to Conspiracy to Commit<br />
Espionage, in violation of Title 18, United States Code, 5 794(a) and (c). As part of his plea,<br />
NICHOLSON admitted that between June 1994 and November 16, 1996, he provided the<br />
Russian Federation documents, photographic negatives and information relating to the national
