The evidence <strong>of</strong> Patrick Cullen is <strong>the</strong> same as that <strong>of</strong> Fred Campbell and<br />

Daniel Cullen.<br />

Daniel Cullen made also made a statement on October 4, 1971 to Senator<br />

Claude Wilton.<br />

His evidence was <strong>the</strong> same as that <strong>of</strong> Fred Campbell and Patrick Cullen.<br />

David DOWNEY<br />

Mr Downey made a statement on October 4, 1971 to Senator Claude<br />

Wilton.<br />

He said that at 12.40am on September 15, 1971, he was standing at <strong>the</strong><br />

gable end <strong>of</strong> ‘Annie McGlincheys’ shop. He was in <strong>the</strong> company <strong>of</strong> a few<br />

friends who were not named in <strong>the</strong> statement.<br />

Mr Downey saw three men come over <strong>the</strong> top <strong>of</strong> <strong>the</strong> barricade that had<br />

been placed across Laburnum Terrace. The first two men turned to walk<br />

down New Road and <strong>the</strong> third walked out <strong>into</strong> <strong>the</strong> crown <strong>of</strong> <strong>the</strong> road.<br />

A shot was fired and <strong>the</strong> man who had gone <strong>into</strong> <strong>the</strong> middle <strong>of</strong> <strong>the</strong> road<br />

fell to <strong>the</strong> ground. On hearing <strong>the</strong> shot Mr Downey dived for cover. A<br />

companion <strong>of</strong> <strong>the</strong> shot man <strong>the</strong>n ran to his aid and dragged him by his<br />

feet to <strong>the</strong> side <strong>of</strong> <strong>the</strong> road.<br />

Mr Downey stated that <strong>the</strong> man who had been shot was definitely not<br />

armed.<br />
