observation post shouting, “Hurray, we’ve got one”.<br />

Mr McColgan also said that when Mr McGreanery was shot he was walking<br />

towards <strong>the</strong> roundabout with his hands in his pockets and was not armed.<br />

<strong>HET</strong> Comment: Mr McColgan is <strong>the</strong> only witness to have mentioned<br />

hearing soldiers from <strong>the</strong> observation post shouting “Hurray, we’ve got<br />

one”. Both <strong>of</strong> <strong>the</strong> soldiers involved in <strong>the</strong> shooting have told <strong>the</strong> <strong>HET</strong> that<br />

<strong>the</strong>y did not shout anything, and that <strong>the</strong>y did not hear anyone else within<br />

<strong>the</strong> base make any comment at all.<br />

Detective Sergeant Ruddell <strong>of</strong> <strong>the</strong> RUC interviewed Mr Gallagher on<br />

September 15, 1971.<br />

About 12.30am on September 15, 1971 he was with his girlfriend at 2,<br />

Westland Terrace, Derry. He heard a single shot. A few minutes later<br />

someone called at <strong>the</strong> house. When he got to <strong>the</strong> door he heard people<br />

shouting, “Phone a priest and an ambulance, <strong>the</strong>re is a man shot”. He asked<br />

what had happened and someone shouted out, “The army shot him, he<br />

wasn’t doing anything”.<br />

He was <strong>the</strong>n asked to drive his van towards <strong>the</strong> roundabout where <strong>the</strong><br />

injured man was lying in <strong>the</strong> road. The man was placed in <strong>the</strong> rear <strong>of</strong> his<br />

van. A priest and a woman also got <strong>into</strong> <strong>the</strong> back <strong>of</strong> <strong>the</strong> van. Mr Gallagher<br />

<strong>the</strong>n drove <strong>the</strong> injured man to <strong>the</strong> Altnagelvin hospital.<br />

On <strong>the</strong>ir journey to <strong>the</strong> hospital, <strong>the</strong> van was stopped at an army<br />

checkpoint on <strong>the</strong> Craigavon Bridge. Mr Gallagher does not say in his<br />

statement how long <strong>the</strong> army detained <strong>the</strong>m before <strong>the</strong>y were able to<br />

continue on <strong>the</strong>ir way.<br />

Additional Witness<br />

With <strong>the</strong> assistance <strong>of</strong> <strong>the</strong> Pat Finucane Centre in Derry, an additional<br />

witness has been identified and a statement was obtained from her by<br />

members <strong>of</strong> <strong>the</strong> <strong>HET</strong> on February 25, 2009. As stated earlier in this<br />

review document, for legal reasons, <strong>the</strong> witness cannot be named.<br />
