and died January 20, 1879. He married LAURA FITCH 85 . She was born February 04, 1808, and died<br />

December 09, 1886.<br />

Petition dated 18 Jan 1860:<br />

To the Surrogate <strong>of</strong> the County <strong>of</strong> St. Lawrence: The Petition <strong>of</strong> Rebecca Miller <strong>of</strong> the town <strong>of</strong><br />

Potsdam in said county respectfully showeth that your petitioner is the mother <strong>of</strong> Francis W. Clark a<br />

minor, that said minor is under the age <strong>of</strong> fourteen, and is aged 13 years last May and is a resident <strong>of</strong><br />

said County; that the only relatives <strong>of</strong> said minor residing in said County are your petitioner except the<br />

minors mentioned in and signing the preceding petitions who are said minor's brother and sisters; that<br />

said minor is entitled to personal property to the value <strong>of</strong> about one hundred and twenty five dollars as<br />

your petitioner is informed and verily believes ; and that to protect the legal rights <strong>of</strong> said minor, it is<br />

necessary that some proper person thence be appointed the guardian <strong>of</strong> his person and estate -- said<br />

petitioner therefore prays that you appoint Lyman Dayton <strong>of</strong> the town <strong>of</strong> Potsdam aforesaid farmer, the<br />

guardian <strong>of</strong> the person and estate <strong>of</strong> the said minor, until he arrives at the age <strong>of</strong> fourteen years and<br />

until another guardian shall be a appointed. And your petitioner will ever pray.<br />

George Clark, Philinda Clark and Mary Clark all <strong>of</strong> the town <strong>of</strong> Potsdam County <strong>of</strong> St. Lawrence<br />

aforesaid respectfully showeth that they are residents <strong>of</strong> said County and are minors over fourteen<br />

years <strong>of</strong> age and are aged as follows to wit: your petitioner George Clark aged 19 years; your<br />

petitioner Philinda Clark aged 17 years, and your petitioner Mary Clark aged 15 yearrs, that your<br />

petitioners are untitled to certain property and estate, and that to protect and preserve the legal rights<br />

<strong>of</strong> your petitioners, it is necessry that some proper person should be duly appointed the guardian <strong>of</strong><br />

their persons and estates during their minority. Your petitioners therefore nominate subject to the<br />

approbation <strong>of</strong> the surrogate Lyman Dayton <strong>of</strong> the town <strong>of</strong> Potsdam aforesaid, farmer to be such<br />

guardian, and pray his appointment accordingly pursuant to the statute in such case made and<br />

provided, and your petitioners will ever pray.<br />
