1. Introducti<strong>on</strong><br />

The Irish Aviati<strong>on</strong> Authority (IAA) in its role as an Air Navigati<strong>on</strong> Service Provider is tasked<br />

with providing Communicati<strong>on</strong>, Navigati<strong>on</strong> and Surveillance (CNS) services in the approach,<br />

En-route and Terminal envir<strong>on</strong>ment in Ireland. To enable it to carry out this role the IAA has<br />

facilities at various locati<strong>on</strong>s around the country and at the three state airports in Cork,<br />

Shann<strong>on</strong> and Dublin.<br />

Under the Planning and Development Regulati<strong>on</strong>s 2000 the Irish Aviati<strong>on</strong> Authority (IAA) is<br />

a prescribed Authority to be c<strong>on</strong>sulted “where it appears to the planning authority that<br />

development under the draft planning scheme would be likely to significantly endanger or<br />

interfere with the safety of aircraft or the safe and efficient navigati<strong>on</strong> thereof” (S.I.<br />

35/2000).<br />

Where, in a pre-planning query or in a planning applicati<strong>on</strong>, it is identified that a proposed<br />

development may have an adverse impact up<strong>on</strong> the safety of the CNS services provided by<br />

the IAA then, the Planning Authority c<strong>on</strong>sults with the IAA to obtain the Authority’s positi<strong>on</strong>.<br />

The IAA applies a two step approach for the c<strong>on</strong>siderati<strong>on</strong> of proposed developments that<br />

may adversely affect Communicati<strong>on</strong>, Navigati<strong>on</strong> and Surveillance facilities. The approach is<br />

based up<strong>on</strong> the applicati<strong>on</strong> of the Internati<strong>on</strong>al Civil Aviati<strong>on</strong> authority (ICAO) document<br />

ICAO EUR DOC 015: European Guidance Material <strong>on</strong> Managing Building Restricted Areas<br />

(BRAs).<br />

n Where the IAA c<strong>on</strong>siders that a planning proposal/planning query does not infringe the<br />

BRA surfaces as described in ICAO EUR DOC 015 then the Planning Authority is advised<br />

that the IAA has no objecti<strong>on</strong>s to the proposal<br />

n Where the IAA c<strong>on</strong>siders that BRA surfaces are infringed then the IAA will advise that<br />

further expert engineering analysis is required. This analysis is the resp<strong>on</strong>sibility of the<br />

planning applicant or developer.<br />

The planning applicant or developer is resp<strong>on</strong>sible for providing the IAA with assurance<br />

evidence that any proposed development will not have the potential to cause interference or<br />

adverse affects to any Communicati<strong>on</strong>, Navigati<strong>on</strong> or Surveillance facilities under the IAA’s<br />

c<strong>on</strong>trol.<br />

2. Scope<br />

The IAA policy <strong>on</strong> building in restricted areas is based up<strong>on</strong> ICAO EUR DOC 015: European<br />

Guidance Material <strong>on</strong> Managing Building Restricted Areas.<br />

ICAO EUR DOC 015 provides guidance <strong>on</strong> protecting Communicati<strong>on</strong>, Navigati<strong>on</strong> and<br />

Surveillance facilities from adverse affects <strong>on</strong> the availability and/or quality of signal in<br />

space that may be caused by the c<strong>on</strong>structi<strong>on</strong> of buildings in or close to a Building<br />

Restricted Areas (BRA).

The procedure applies to the following facilities/systems:<br />

n Distance Measuring Equipment (DME)<br />

n VHF Omni Range (VOR/DVOR)<br />

n Directi<strong>on</strong> Finder (DF)<br />

n N<strong>on</strong> Directi<strong>on</strong>al Beac<strong>on</strong>s (NDB)<br />

n Ground Base Augmentati<strong>on</strong> Systems<br />

n Instrument Landing Systems (Localiser, Glide-path & Markers, LDMEs)<br />

n Satellite based Augmentati<strong>on</strong> Systems (Ground m<strong>on</strong>itoring elements)<br />

n VHF Communicati<strong>on</strong>s<br />

n Primary surveillance Radar<br />

n Sec<strong>on</strong>dary Surveillance Radar<br />

Though the development of the guidance material is targeted primarily at buildings, other<br />

objects mobile or stati<strong>on</strong>ary, temporary or permanent which may interfere with CNS<br />

facilities are also embraced. These could include, building machinery, excavati<strong>on</strong> and spoil,<br />

including vegetati<strong>on</strong>. Permanent structures with rotati<strong>on</strong>al elements (wind turbines) are<br />

also embraced.<br />

3. Exclusi<strong>on</strong>s<br />

n Obstacle restricti<strong>on</strong>s that are given in this document and in ICAO EUR DOC 015 do not<br />

cover the effect of proposed buildings <strong>on</strong> Visual flight rule or Instrument Flight rule<br />

operati<strong>on</strong>s. The criteria for evaluating these is given in ICAO ANNEX 14 (Aerodromes)<br />

and in ICAO DOC 8168(PANS OPS)<br />

n Degradati<strong>on</strong> of Signal in Space Caused by Electromagnetic Interference (EMI)<br />

n Satellite up/down links<br />

n VHF/UHF Ground/Ground communicati<strong>on</strong>s<br />

n Microwave links<br />

n HF Communicati<strong>on</strong> facilities<br />

n Critical and Sensitive Areas based <strong>on</strong> Guidance covered in ICAO ANNEX 10<br />

4. Safeguarding C<strong>on</strong>sultati<strong>on</strong> by Planning Authorities<br />

with IAA<br />

Where it is identified, in pre-planning queries or planning applicati<strong>on</strong>s made to planning<br />

authorities that a proposal may adversely impact IAA facilities as detailed in the Appendices<br />

of this document then the Authority shall be c<strong>on</strong>sulted in the matter.<br />

Pre-planning queries or planning applicati<strong>on</strong>s shall be submitted to the Corporate Affairs<br />

Department within the IAA. This department will then submit the planning applicati<strong>on</strong> or<br />

pre-planning query to the appropriate engineering experts within the IAA for assessment.<br />

When they have assessed the proposed applicati<strong>on</strong> they will resp<strong>on</strong>d to the corporate<br />

affairs department and advise whether further assessment is required and/or whether<br />

after this further assessment the IAA should object to an applicati<strong>on</strong> or not.<br />

5. ICAO EUR DOC 015<br />

This is primarily a guidance document aimed at Air Navigati<strong>on</strong> Service Providers but the<br />

material provided within the document when read in c<strong>on</strong>juncti<strong>on</strong> with this procedure will<br />

provide assistance to planners and developers in deciding if a formal assessment/<br />

simulati<strong>on</strong> would be required by the IAA.<br />

The general procedure is a two step approach for the approval of buildings that may<br />

adversely affect Communicati<strong>on</strong>, Navigati<strong>on</strong> and Surveillance facilities.<br />

The two step approach that is applied is set out in figure 1 of this document.

6. The Two Step C<strong>on</strong>sultati<strong>on</strong> Process<br />

Fig. 1 below sets out the 2 Step Process.<br />

Step 1<br />

n Planning applicati<strong>on</strong>/pre-planning query is made. The planning authority pass this to the<br />

IAA Corporate Affairs Department for review.<br />

n IAA Corporate Affairs Department submit the applicati<strong>on</strong> to the appropriate engineering<br />

experts within IAA for initial analysis.<br />

n If the appropriate engineering experts c<strong>on</strong>sider that the planning proposal does not<br />

infringe the BRA surfaces as described in ICAO EUR DOC 015 then the Corporate<br />

Affairs Department of the IAA is advised that the appropriate engineering experts have<br />

no objecti<strong>on</strong>s to the proposal and step 2 is skipped.

Step 2<br />

n If the appropriate engineering experts c<strong>on</strong>sider that BRA surfaces are infringed then<br />

the appropriate engineering expert’s within the IAA will advise the Corporate Affairs<br />

Department that further expert engineering analysis is required. This analysis is the<br />

resp<strong>on</strong>sibility of the developer.<br />

n If it is shown from expert analysis that the interference effects are within acceptable<br />

limits as decided by the appropriate engineering experts within the IAA (following<br />

review of evidence provided) then the planning authority is advised that the IAA has no<br />

objecti<strong>on</strong> to the applicati<strong>on</strong>.<br />

n If the analysis shows that the interference affects are outside acceptable limits then the<br />

planning authority is advised that the IAA will object and outline the basis for the<br />

objecti<strong>on</strong>.<br />

n Following rejecti<strong>on</strong> of the building proposal it may be possible to modify and re-submit<br />

the planning proposal. A modified proposal will be subjected to the full review processes<br />

as described above.<br />

7. Buildings that must always be subject to assessment<br />

It is a requirement that the following types of c<strong>on</strong>structi<strong>on</strong>/ building be assessed even<br />

when outside the areas defined as restricted areas in ICAO EUR DOC 015:<br />

n Wind Turbine Generator (Excluding Micro-wind turbines.( See note 2 below)<br />

n Skyscrapers<br />

n Large excavati<strong>on</strong> works<br />

n TV towers<br />

n Other High Towers<br />

NOTE 1: The use of any large c<strong>on</strong>structi<strong>on</strong> equipment (tower cranes etc) used during the<br />

c<strong>on</strong>structi<strong>on</strong> of any building must also be assessed. This is because while the final<br />

proposed development may not impinge a restricted area the equipment used to c<strong>on</strong>struct<br />

or develop that building may.<br />

Note 2: Micro wind turbines: Wind turbines with a mast height not exceeding 10 metres<br />

and a rotor diameter of 6 metres or less. All turbine comp<strong>on</strong>ents shall have a matt, n<strong>on</strong>reflective<br />

finish and the blade shall be made of material that does not deflect<br />

telecommunicati<strong>on</strong> signals.<br />

These turbines were exempted from the Planning Laws in February 2007 by the Minister<br />

for Envir<strong>on</strong>ment, Heritage and Local Government. Further details of these are available<br />

from the Department.

8. Assurance Evidence<br />

There are independent organisati<strong>on</strong>s with the relevant Engineering expertise and computer<br />

modelling tools that can provide the appropriate level of assurance analysis that would be<br />

accepted by the IAA when assessing whether to object or not to a proposed development<br />

proceeding.<br />

C<strong>on</strong>tact details for such organisati<strong>on</strong>s will be provided <strong>on</strong> request to the IAA Corporate<br />

Affairs Department.<br />

9. IAA Sites/Facilities<br />

At the three state Airports and at other sites located around Ireland the IAA has facilities<br />

that are used to support the safe navigati<strong>on</strong> of aircraft in all phases of flight. The<br />

appendices c<strong>on</strong>tain a listing of the facilities used within the airport and en-route<br />

envir<strong>on</strong>ment together with the type of antenna system, the radiati<strong>on</strong> pattern and also the<br />

relevant ICAO EUR DOC 015 reference informati<strong>on</strong> that will be applied to protect that<br />

facility from unwanted interference.<br />
