7.) เงื่อนไขและกฏระเบียบทั่วไป (General Rules and Regulations) 

(1) สมาชิกภาพและรหัสสมาชิกนี้สมาชิกไมสามารถโอนหรือใหบุคคลใดใช และไมสามารถแลกเปนเงินหรือสิ่งอื่น (Member is not permitted to transfer, or allow any person to use, the Membership and 

User-ID hereunder, and cannot have them converted to cash or otherwise.) 

(2) สมาชิกภาพรายเดือนสําหรับแตละเดือนถัดไปจะมีผลใชบังคับอัตโนมัติเวนแตจะมีการเพิกถอนหรือยกเลิกตามใบสมัครนี้ (Monthly Membership for each subsequent month shall be automatically 

effective unless it is cancelled or terminated hereunder.) 

(3) ผูสมัครอาจบอกเลิกการเปนสมาชิกเมื่อใดก็ได และสมาชิกภาพจะสิ้นสุดทันที ณ วันสุดทายของเดือนสมาชิกภาพที่บริษัทฯไดรับหนังสือบอกเลิกลวงหนาอยางนอย 10 วันกอนวันสุดทายของเดือน 

สมาชิกภาพนั้นและกอนวันแจงหนี้ของเดือนสมาชิกภาพถัดไป (Applicant may terminate the Membership at any time and the Membership shall cease effect immediately at the end of the Membership 

Month, in which Company shall have received the written notice of termination in advance at least 10 days prior to the end of such Membership Month and to the date of the invoice for the following 

Membership Month.) 

(4) สมาชิกจะปฏิบัติตามนโยบายการตั้งพิกัดระยะคุมภัยของบริษัทฯ (Account Protection Policy) และจะตองแจงขออนุมัติบริษัทฯปรับพิกัดระยะคุมภัยนั้น โดยการกรอกแบบฟอรม Cap Re-adjustment 

Request Form สงใหบริษัทฯ หากสมาชิกประสงคจะใชงานอินเตอรเน็ตเกินพิกัดระยะคุมภัยของบริษัทฯซึ่งไดแก 200 ชั่วโมงตอเดือน สําหรับ Web1, Web2 และ 300 ชั่วโมงตอเดือน สําหรับ Web100 

(Member shall comply with the Account Protection Policy of Company, and shall request for Company's approval the adjustment of cap level of hours by submitting Cap Re-adjustment Request Form to 

Company if Member wishes to use internet more than the cap level of hours of Company which is 200 hours per month for Web1, Web2 and 300 hours per month for Web100.) 

(5) สมาชิกอาจขอเปลี่ยนแปลงประเภทสมาชิกเมื่อใดก็ไดโดยแจงใหบริษัทฯทราบเปนลายลักษณอักษรและจายสวนตางของคาสมัครสมาชิกซึ่งการเปลี่ยนแปลงประเภทสมาชิกจะมีผลในรอบบัญชีถัดไป 

(Member may change the type of his/her Membership at any time by notifying Company in writing of such change and paying the difference in Application Fee, upon which the change shall be 

effective as of the following billing cycle.) 

(6) ในทุกกรณีคาสมัครสมาชิกไมสามารถเรียกคืนไดเวนแตบริษัทฯไมอนุมัติรับใบสมัครนี้ (In all cases, Application Fee is non-refundable unless Company rejects this Application.) 

(7) สมาชิกตองชําระคาสมาชิกภาพรายเดือนเปนการลวงหนา คาบริการเพิ่มเติม และคาใชจาย (หากมี) ใหแกบริษัทฯภายในกําหนดเวลาตามใบแจงหนี้จนกวาสมาชิกภาพจะสิ้นสุดตามใบสมัครนี้ บรรดา 

หนี้เงินที่คางชําระแกบริษัทฯ จะคิดดอกเบี้ย 15 % ตอป (Member shall pay to the Company in advance within a period specified in the invoice the Monthly Membership Fee, Extra-Charge and, if any, 

the expenses until the Membership ceases effect pursuant hereto. All overdue payments to the Company shall bear the interest at 15% per annum.) 

(8) การใชสิทธิประโยชนของสมาชิกที่บริษัทฯบันทึกไวใหถือเปนที่สุดและใชในการคํานวณคาบริการเพิ่มเติม (Company's record on Member's use of the privileges is final and conclusive evidence for 

calculation of the Extra-Charge.) 

(9) บรรดาสิทธิประโยชนที่จัดใหไมสามารถโอนหรือเปลี่ยนเปนเงินหรือทรัพยสินใดไดและสิ้นผลทันทีในวันสุดทายของการเปนสมาชิกภาพ(All privileges provided herein in any month are not 

transferable nor changeable into cash or otherwise, and shall cease effect immediately on the last day of following membership.) 

(10) สมาชิกภาพจะเริ่มมีผลใชบังคับและการใหบริการการเปนสมาชิกของบริษัทฯถือวาแลวเสร็จนับตั้งแตวันเริ่มสมาชิกภาพที่ตองการหรือตั้งแตวันที่ผูสมัครไดรับรหัสสมาชิกและ รหัสผานที่บริษัทฯ 

ออกใหหากไดรับภายหลังวันเริ่มสมาชิกภาพที่ตองการ (Membership shall take effect and the Company's membership services shall be deemed fully rendered as of the Preferred Membership Date or 

upon the Applicant receiving User-ID and Password authorized by the Company in the event he/she receives them after Preferred Membership Date.) 

(11) สมาชิกตองใชความระมัดระวัง กํากับดูแล และตองไมใชระบบเครือขายอินเตอรเน็ตตามสัญญานี้ ไปในทางที่กอใหเกิดการลวงละเมิดสิทธิของบุคคลอื่น ไมวาบุคคลอื่นนั้นจะใชระบบความ 

ปลอดภัยของแฟมขอมูลปองกันหรือไมก็ตาม และสมาชิกจะตองไมเผยแพรขอมูล ภาพ ขอมูลหรือภาพของบุคคลอื่นกระจายออกไปในวงกวางโดยมิไดรับอนุญาตจากผูเปนเจาของ หากการกระทําใดๆ 

ของสมาชิกกอใหเกิดความเสียหายตอบุคคลอื่น สมาชิกตองรับผิดชอบแตเพียงฝายเดียว (Membership shall use reasonable care in the supervision and utilization of the Internet Access Services and shall 

not use such Service in such a way as stated to violate the other's rights, regardless of whether such other person employs security measure with respect to its database and Membership shall not publish 

the data or picture of other person without his/her permission. If any act of membership causes the loss or damages to the third party, the membership shall be solely responsible for such loss and 

damages.) 

(12) สมาชิกตองไมรับ-สงขอความ ขอมูล ภาพ หรือรหัสสัญญาณใดๆ ที่เปนการขัดตอกฎหมาย หรือเปนการขัดตอมติคณะรัฐมนตรี นโยบาย กฎ ระเบียบ คําสั่ง หรือประกาศ ของ 

การสื่อสารแหงประเทศไทย หรือที่ทางราชการกําหนด หรือเปนการขัดตอความสงบเรียบรอยและศีลธรรมอันดีของประชาชน หรือเปนภัยตอความมั่นคงของประเทศชาติ (Membership shall not 

transmit, receive any statements, data, picture or code which are contrary to the laws or the resolutions of the Council of Ministers or policies, rules, regulations, orders or notifications of the 

Communications Authority of Thailand, or official circulars which are against public order, good moral and the peace and security of the nation.) 

(13) สมาชิกจะตองไมนําระบบเครือขายอินเตอรเน็ตตามสัญญานี้ ไปใชในทางธุรกิจการคา หรือในเชิงพาณิชยใดๆ ไมวาจะโดยทางตรง ทางออม หรือใหบริการตอ (Resale) และไมวาจะมีวัตถุประสงค 

แสวงหากําไรหรือไมก็ตาม หรือการใหบริการตอ เชน การนําขอมูลไปขายตอ การฝาฝนเงื่อนไขดังกลาวถือวาเปนการละเมิดเงื่อนไขการใชบริการของบริษัท และละเมิดเงื่อนไขการใชวงจรสื่อสารของ 

การสื่อสารแหงประเทศไทย ซึ่งสมาชิกจะตองชดใชคาเสียหายอันเปนผลจากการฝาฝนนั้น (Membership shall not use the Internet network under this Contract for "Resale", regardless of whether or 

not profits are made. The breach of such condition shall be deemed a breach of condition of service and breach of the condition for the use of the communication circuit of the Communications 

Authority of Thailand. Any loss or damages, as a result of such breach , shall be the sole responsibility of the membership.) 

(14) สมาชิกตองใชความระมัดระวังและไมกระทําการใดๆ ตอเครือขายอินเตอรเน็ตเพื่อบุกรุกระบบคอมพิวเตอรอื่นๆ ไมวาทั้งในระบบเครือขายของบริษัทเอง และ/หรือระบบเครือขายคอมพิวเตอรอื่นๆ 

ที่สมาชิกไมไดรับอนุญาตใหเขาไปใชงาน และสมาชิกจะตองรักษาความลับของ Password ของสมาชิกเปนอยางดี ไมใหบุคคลภายนอกนําไปใช (Membership shall use reasonable care and shall not do 

any act to the Internet Network in order to gain access to other computer system regardless of whether such computer system belong to the Company or to other person to which the membership is not 

permitted to access, and the membership shall keep his password strictly confidential so that no nunanthorized person will be able to use it.) 

(15) บริษัทไมตองรับผิดชอบตอความเสียหายใดๆ อันเกิดจากระบบเคเบิ้ล หรือวงจรสื่อสารตางๆ ชํารุดบกพรอง ขัดของ หรือไมสามารถใชการได หรือ เกิดจากการที่ขอความ ขาวสาร ขอมูล ภาพ หรือ 

รหัสสัญญาณที่สมาชิกใชในการติดตอสื่อสารเกิดความลาชา เสียหาย หรือสูญหาย (The Company shall not be liable for any loss or damages caused by the defect, malfunction or unoperationable of the 

cable system or communications circuit, or the network system linkage causing the delay, loss and damages to statements, information, data, pictures or code used by the Membership in 

communication.)

(16) บริษัทไมมีหนาที่ในการควบคุม ตรวจสอบ ปองกัน เก็บรักษาหรือดําเนินการอื่นใด รวมตลอดทั้งไมรับประกันในคุณภาพ ขอมูล ภาพ เนื้อหาขาวสารที่สมาชิกรับ-สงผานระบบเครือขายของบริษัท 

และบริษัทไมตองรับผิดชอบในความเสียหายตอสมาชิกอันเนื่องมาจากความลาชา ผิดพลาด ขาดตกบกพรอง หรือการขัดของของวงจรสื่อสาร จานแมเหล็ก ที่สมาชิกรับ-สงผานระบบเครือขายของบริษัท 

แตอยางใด (The control, detection, protection, storing or any other acts, including the guaranty of the quality of Information , data or picture transmitted through the Company's network are not the 

Company's duties. Also, the loss or damages resulting from the delay, mistakes, defect or malfunction of the communications circuit or disk drive, the Membership used by for transmission purpose 

through the Company's network, are not the Company's responsibility.) 

(17) ขอกําหนดและเงื่อนไขในสัญญานี้ถือวาเปนสาระสําคัญของสัญญา ในกรณีที่สมาชิกไมปฏิบัติตามขอกําหนดและเงื่อนไขในสัญญานี้ บริษัทมีสิทธิระงับการใหบริการไดทันทีโดยไมตองแจงให 

ทราบลวงหนา และมีสิทธิบอกเลิกสัญญานี้ไดทันที โดยบริษัทไมตองรับผิดชดใชคาเสียหายใดๆใหแกสมาชิกทั้งสิ้น (Terms and conditions stated in the Contract are material conditions. The breach of 

such terms and conditions shall result the immediate service discontinuation, without giving notice in advance, and termination of the Contract.) 

(18) ในกรณีที่สมาชิกไมปฏิบัติตามขอกําหนดและเงื่อนไขในสัญญา เปนเหตุใหบริษัทหรือบุคคลภายนอกไดรับความเสียหาย สมาชิกตกลงจะเปนผูรับผิดชอบในความเสียหายที่เกิดขึ้นทั้งสิ้น (The extent 

that the loss or damages occur to the Company or the third party is the result of the Membership's noncompliance with the terms and conditions stated in the Contract, the User shall be fully responsible 

to such loss and damages.) 

(19) บริษัทฯไมตองรับผิดชอบตอผลหรือประโยชนทางการคาจากการใชบริการ สมาชิกรับทราบวาบริษัทฯไดรับสิทธิจาก กสท.ในการใหบริการ ในกรณีที่สิทธิดังกลาวถูกเพิกถอนหรือถูกยกเลิกหรือ 

ระงับไปไมวาดวยเหตุใดใหถือวาใบสมัครนี้ใชบริการนี้ระงับไปโดยอัตโนมัติทันทีโดยบริษัทฯไมตองรับผิดชอบใดๆบริษัทฯมีสิทธิมอบหมายและโอนบริการนี้รวมทั้งบรรดาสิทธิและหนาที่ใดๆทั้งปวง 

ตามใบสมัครนี้ และหรือสิทธิของบริษัทฯในการรับชําระบรรดาหนี้คาบริการใดๆทั้งปวงตามใบสมัครนี้จากสมาชิกที่ถึงกําหนดชําระแลวและหรือไดแจงใหทําการชําระและเงินอื่นใดใหแกบุคคลใดๆโดย 

ไมตองขอความยินยอมจากสมาชิกกอนสําหรับการมอบหมายและการโอนดังกลาวแตทั้งนี้บุคคลผูรับมอบหมายหรือรับโอนนั้นจะตองเปนผูที่ไดรับสิทธิในการใหบริการอินเตอรเน็ตจาก กสท. (Company
