GATES OF MCLEAN CONDOMINIUM UNIT OWNERS ASSOCIATION<br />

POLICY RESOLUTION NO. 8<br />

VEHICLE POLICIES<br />

Relating to Vehicle Parking; Rules, Regulations and Guidelines<br />

Revised and Amended – APRIL 19, 2011<br />

WHEREAS, Article 3, Section 3.1 <strong>of</strong> the Bylaws states that “The Board <strong>of</strong> Directors shall have all <strong>of</strong><br />

the powers and duties necessary for the administration <strong>of</strong> the affairs <strong>of</strong> the Unit Owners Association<br />

and may do all such acts and things as are not by the Condominium Act, or the Condominium<br />

instruments required to be exercised and done by the Association;” and<br />

WHEREAS, Article 5, Section 5.8 (a) (7) <strong>of</strong> the Bylaws establishes certain restrictions with regards<br />

to the parking and storing <strong>of</strong> certain vehicles; and<br />

WHEREAS, the Association has a limited number <strong>of</strong> unreserved Common Element and specifically<br />

designated Limited Common Element parking spaces; and<br />

WHEREAS, in order to assure equitable parking arrangements, as well as safe and attractive parking<br />

areas, the Board wishes to establish additional vehicle parking rules;<br />

NOW, THEREFORE, BE IT RESOLVED THAT the following parking policies be adopted by the<br />

Board:<br />

I. PARKING GUIDELINES<br />

A. Approved Vehicles: Only approved vehicles, which are described in this section, may be parked<br />

in Limited Common Element and Common Element parking spaces. An approved vehicle shall<br />

include any licensed conventional passenger vehicle, motorcycle, van or light truck that displays<br />

current State registration, current State inspection and local county regulations (if any), and<br />

which does not exceed eighteen (18) feet in length, eight (8) feet in width and is less than three<br />

(3) tons gross weight, except where otherwise prohibited by the terms <strong>of</strong> this Resolution.<br />

B. Unit Owner/resident parking is limited to the number <strong>of</strong> Limited Common Element reserved<br />

parking spaces assigned to a <strong>unit</strong> and Common Element unassigned parking spaces, with each<br />

vehicle being required to display a valid numbered, recorded and issued Gates <strong>of</strong> McLean<br />

parking decal. The issuance <strong>of</strong> a decal does not guarantee a parking space as there are a<br />

limited number <strong>of</strong> unreserved Common Element parking spaces. Residents must use the<br />

<strong>unit</strong>’s Limited Common Element space before using any unassigned parking space. No <strong>unit</strong><br />

owner, household member or tenant shall park more than two (2) vehicles on Common<br />

Element unassigned parking spaces.


C. Owner/Resident vehicles must be registered with the Management Office.<br />

i. Every resident vehicle must be registered annually between May 15 th and July 31 st .<br />

ii. The Management Office will issue one decal per vehicle registered. Limits on the<br />

number <strong>of</strong> decals issued per <strong>unit</strong> shall be as follows: One bedroom <strong>unit</strong>s – 1 decal, two<br />

bedroom <strong>unit</strong>s - 2 decals, three bedroom <strong>unit</strong>s – 3 decals. Resident requests for<br />

additional decals beyond the set limits will be reviewed by the Board <strong>of</strong> Directors on a<br />

case by case basis. Decals shall be recorded to each <strong>unit</strong> address and include the <strong>unit</strong><br />

owner’s name as well as the resident’s name if the <strong>unit</strong> is leased, vehicle description, tag<br />

number and assigned reserved parking space number (if applicable);<br />

iii. Decals shall be issued to <strong>unit</strong> <strong>owners</strong> or tenants <strong>of</strong> <strong>unit</strong> <strong>owners</strong>;<br />

A. Who have current and valid Lease Agreements & Lease Addendums on file with<br />

the Association Management Office;<br />

B. Whose vehicles are properly registered and insured. Valid, current vehicle<br />

registrations and pro<strong>of</strong> <strong>of</strong> insurance are required at time <strong>of</strong> decal issuance;<br />

C. Decals issued to <strong>unit</strong>s that are leased will expire on the date <strong>of</strong> expiration <strong>of</strong> lease<br />

agreement and can be renewed upon receipt <strong>of</strong> a confirmed copy <strong>of</strong> renewed<br />

lease agreement;<br />

iv. Any vehicle parked in a reserved space that is not assigned to their <strong>unit</strong> shall be subject to<br />

immediate towing by the parking space’s owner only, at the vehicle owner’s risk and<br />

expense. It is recommended that prior to towing, a warning notice be placed by the<br />

owner on the unauthorized vehicle requesting that the vehicle be moved immediately.<br />

v. Unit <strong>owners</strong>/residents will retain their current reserved parking space(s) assignments. A<br />

parking decal does not give <strong>owners</strong>/residents the right to park in a reserved parking space<br />

not assigned to their <strong>unit</strong>. A valid parking decal must be displayed, in a clearly visible<br />

location on the lower left portion <strong>of</strong> the rear window in resident vehicles at all times<br />

while parked on the property.<br />

vi. Each <strong>unit</strong> shall be issued two (2) hangtag parking permits. Possession <strong>of</strong> a permit does<br />

not guarantee the availability <strong>of</strong> a parking space; it merely provides authorization to park<br />

on the property. Parking permits will not be issued unless there is a current vehicle<br />

registration form on file for the <strong>unit</strong> in the Management Office. Parking permits will be<br />

renewed annually in conjunction with resident vehicle registration and stickers indicating<br />

the current year issued to <strong>owners</strong> for placement on the permits.<br />

vii. Once issued, parking permits are the responsibility <strong>of</strong> the <strong>unit</strong> owner. If the <strong>unit</strong> is<br />

leased, the <strong>unit</strong> owner will be responsible for providing the permits and parking policy to<br />

tenants. Tenants are subject to the parking policy in the same manner as <strong>unit</strong> <strong>owners</strong>.<br />

viii. Unit <strong>owners</strong> selling their <strong>unit</strong> must return the parking permits to the Management Office<br />

five (5) days prior to closing/transfer <strong>of</strong> <strong>owners</strong>hip. A temporary permit with a five (5)<br />

day expiration date will be issued to <strong>unit</strong>s <strong>owners</strong> in the case. New <strong>unit</strong> <strong>owners</strong> will be<br />

assessed $50.00 for their parking permits if they were not returned to the Management<br />

Office by the previous owner.<br />

ix. Parking permits shall be displayed on the back <strong>of</strong> the rearview mirror inside any<br />

unregistered vehicle parked on GoM property. Permit numbers must face and be visible<br />

from the front <strong>of</strong> the vehicle.<br />

x. If parking permits are lost or stolen, the permit number will become invalid and the <strong>unit</strong><br />

resident may acquire a new parking permit from the Management Office for a charge <strong>of</strong><br />

$100.00 per permit. Any vehicle displaying an invalid permit is subject to immediate<br />

towing. A parking permit can be exchanged without charge for a new permit if it<br />

becomes damaged and is returned to the Management Office.


xi. Any vehicle not displaying either a GoM decal or parking permit parked in an unreserved<br />

space will be subject to immediate towing at the vehicle owner’s expense. The Board <strong>of</strong><br />

Directors will NOT reimburse for towing costs for any reason.<br />

xii. Any duplication or facsimile <strong>of</strong> the original GoM parking decal or parking permit will be<br />

considered counterfeit and the vehicle will be subject to immediate towing. Counterfeit<br />

decals or permits will be confiscated and original parking permits revoked. Revoked<br />

permits will be reissued at a cost <strong>of</strong> $225.<br />

xiii. Office Parking: The Board shall designate Common Element parking spaces for<br />

exclusive use by property management staff during <strong>of</strong>fice hours, which will be marked as<br />

“Reserved Office”. The Board shall also designate a space for “Staff Only” for the use <strong>of</strong><br />

maintenance staff during <strong>of</strong>f-hour property visits. Office/staff parking spaces are located<br />

outside the front gate in front <strong>of</strong> the property Management Office. Residents may park in<br />

spaces designated as “Reserved Office” during weekends and evening hours, as well as<br />

on holidays for which the Management Office is closed. These spaces must be vacated<br />

during the following hours: Monday - Friday 8:00 a.m. – 5:00 p.m. Vehicles parked in<br />

these spaces during these hours are subject to towing without notice, at the owner’s<br />

expense, at the discretion <strong>of</strong> the Managing Agent. Residents and guests may not park in<br />

the space designated “Staff Only” at any time. All other spaces located outside the front<br />

gate will be limited to three hours during the previously mentioned business hour<br />

schedule for vehicles not displaying an Association decal or parking permit. Vehicles<br />

parked in these spaces between the hours <strong>of</strong> 7:00 p.m. to 7:00 a.m. are required to display<br />

either a decal or parking permit.<br />

Guest Parking: The Board may at any time select any number <strong>of</strong> unreserved Common<br />

Element parking spaces to be used for guest parking.<br />

xiv. ADA Accessible Spaces: ADA parking spaces are only for use as permitted by the<br />

Commonwealth <strong>of</strong> Virginia Traffic Code and county ordinances. Vehicles parked in these<br />

designated spaces must display valid, current governmental issued permits or tags as well<br />

as either a resident decal or parking permit.<br />

D. Use <strong>of</strong> Limited Common Element (LCE) and Common Element parking spaces is subordinate to<br />

all restrictions and requirements <strong>of</strong> the Condominium Documents and this Resolution.<br />

E. Parking Decals: Qualifying <strong>unit</strong>s as noted in “C” above will be issued parking decals, which<br />

will be assigned and recorded to each <strong>unit</strong> address. Issued decals are to be placed in a clearly<br />

visible location on the lower left portion <strong>of</strong> the rear window in the vehicle, so that it is in clear<br />

view at all times while the vehicle is parked on Condominium property.<br />

F. Replacement decals: In the event <strong>of</strong> a lost or stolen decal(s), replacement decals will cost<br />

$100 per decal with the lost issued decal(s) being recorded as invalid and void. In the event<br />

that a reported lost or stolen decal is subsequently found displayed in a vehicle parked on the<br />

property at any time, that vehicle is subject to towing without notice, at the owner’s expense.<br />

Damaged or mutilated decals will be replaced at no cost provided that 51% <strong>of</strong> the original<br />

decal is presented to the Management Office at the time <strong>of</strong> request <strong>of</strong> replacement.<br />

G. When <strong>unit</strong>s are sold, the decal(s) assigned to the <strong>unit</strong> prior to sale must be turned in to the<br />

Management Office.


H. Business/Contractor Parking: service providers or contractors conducting business on<br />

Condominium property for longer than 4 hours during regular business hours must register<br />

their vehicles with the Management Office. Prior to the service event, the owner/resident<br />

must notify the Management Office that the service provider/contractor will be on<br />

Condominium property. Upon arrival, the service provider/contractor will then need to pick<br />

up a Business/Contractor parking tag from the Management Office to display on the vehicle.<br />

I. The Board may at any time select any number <strong>of</strong> unreserved Common Element parking<br />

spaces for sale to current <strong>unit</strong> <strong>owners</strong> <strong>of</strong> the Condominium.<br />

J. The Board may at any time select any number <strong>of</strong> unreserved Common Area parking spaces<br />

for lease to current <strong>unit</strong> <strong>owners</strong> or residents. The following leasing program has been<br />

established:<br />

a. Leased parking spaces shall be available to current <strong>owners</strong> and residents only. Any<br />

owner/resident interested in leasing a space will contact the Management Office to<br />

execute a leasing agreement and provide payment for the first two (2) months <strong>of</strong> the<br />

agreement term. Once a signed agreement and payment are recorded, the space will<br />

be stenciled “RESERVED”. The resident’s Gates <strong>of</strong> McLean ID card will be<br />

updated to list the leased space.<br />

b. All spaces designated for leasing will be available on first-come, first-serve basis.<br />

Should a waiting list occur, current lease holders will have first right to renew.<br />

Leasing agreement terms and rates are as follows:<br />

i. 6 months @ $150 per month<br />

ii. 12 months @ $125 per month<br />

iii. 18 months @ $100 per month<br />

iv. 24 months @ $75 per month<br />

Rates and leasing periods are subject to change once the initial leasing agreement<br />

expires. Rates and leasing periods will be reviewed every six months and are subject<br />

to change at the discretion <strong>of</strong> the Board <strong>of</strong> Directors. Requests for lease terms other<br />

than those stated above will be considered on a case by case basis by the Board <strong>of</strong><br />

Directors.<br />

c. Monthly payment is due to the Management Office on the first <strong>of</strong> each month<br />

following the initial two months <strong>of</strong> the lease period. Non-receipt <strong>of</strong> payment by the<br />

fifth <strong>of</strong> the month shall result in a 10% late fee. If no payment is received by the<br />

tenth <strong>of</strong> the month, the lease holder shall be considered to be in default <strong>of</strong> the leasing<br />

agreement. Upon such default the Association may require immediate payment <strong>of</strong><br />

two times the monthly amount or terminate the agreement.<br />

d. Termination: If the lease holder chooses not to renew once the leasing term has been<br />

fulfilled, the lease holder has fourteen (14) days to have the space number deleted<br />

from their Gates <strong>of</strong> McLean ID card. Other than the sale <strong>of</strong> a <strong>unit</strong> or move out <strong>of</strong> the<br />

comm<strong>unit</strong>y, early termination <strong>of</strong> a lease shall incur a penalty in the amount <strong>of</strong> two (2)<br />

months lease payments. The Gates <strong>of</strong> McLean may terminate any lease without<br />

cause, provided fourteen (14) day notice to the lease holder. Lease holder shall be<br />

refunded a prorated amount for the unused portion <strong>of</strong> the month during which such<br />

termination occurs.


II. GENERAL RESTRICTIONS<br />

A. No vehicles, other than those which are defined as approved vehicles in accordance with Section<br />

I <strong>of</strong> this Resolution may be parked in Limited Common Element parking spaces. Prohibited<br />

vehicles include, but are not limited to:<br />

1. Any boat or boat trailer;<br />

2. Any motor home or self-contained camper, mobile home, travel trailer, motor coach,<br />

passenger coach, converted coach or fifth wheel vehicle, pop-up camp/tent trailer or similar<br />

recreation oriented portable vehicle or transportable facility or conveyance, slip-on where<br />

the back <strong>of</strong> the camper is higher than the ro<strong>of</strong> line <strong>of</strong> the cab <strong>of</strong> the truck;<br />

3. Any other vehicle not defined above which is not normally or regularly used for daily<br />

transportation, including antique vehicles, dune buggies, non-operational automobile<br />

collections or other automotive equipment not licensed for use on the highways <strong>of</strong> Virginia;<br />

4. Any vehicle defined in the Virginia Code as a commercial vehicle; Any vehicle with a rated<br />

carrying capacity <strong>of</strong> 1500 pounds (3/4 ton) or more, and any vehicle, regardless <strong>of</strong> capacity,<br />

which displays advertising lettered thereon or which is licensed as a 'for hire' vehicle or any<br />

vehicle that does not fit within the vertical boundaries <strong>of</strong> any parking space.<br />

5. Any vehicle with commercial signs, advertising or visible commercial equipment;<br />

6. Private or public school or church buses.<br />

B. No unlicensed vehicles, including but not limited to trailers, motorized bicycles, motorcycles,<br />

mini-bikes, go-karts, etc., shall be operated on or parked upon any common area <strong>of</strong> the<br />

Condominium.<br />

C. Vehicle repairs <strong>of</strong> any kind shall not be permitted upon the Condominium property, except<br />

emergency repairs and light maintenance. Washing <strong>of</strong> vehicles <strong>of</strong> any kind shall be permitted<br />

only at the designated car washing facility at the northwest corner <strong>of</strong> the parking lot adjacent to<br />

building 1571.<br />

D. Changing or draining <strong>of</strong> any automotive fluids is not permitted on Condominium property.<br />

E. Dumping or disposal <strong>of</strong> oil, grease, or any other chemical, residual substances, or any substance<br />

<strong>of</strong> particles from holding tanks <strong>of</strong> vehicles <strong>of</strong> any type (as a result <strong>of</strong> the repair, maintenance, or<br />

carelessness) is not permitted on common areas. Any fluid disposal must also conform to<br />

environmental regulations.<br />

F. The dumping <strong>of</strong>, or disposal <strong>of</strong> oil, grease or any automotive fluids, chemicals, petroleum<br />

products, antifreeze and transmission/power steering and brake fluid whether used or new on<br />

Common areas or into the storm sewers is prohibited. Such action is a direct violation <strong>of</strong> the<br />

State Water Control Law and may lead to civil penalties and clean-up costs for the responsible<br />

person(s).


G. All motor vehicles (including motorcycles) shall be operated on paved roads and parking lot<br />

areas only. All motor vehicles (including motorcycles) shall be parked in designated parking<br />

spaces only. Parking in the fire lanes and in areas where access to other common areas is<br />

impeded is prohibited, especially along curved curbs, handicap access ramps or in front <strong>of</strong> refuse<br />

collections centers. Vehicles in violation <strong>of</strong> this rule shall be subject to immediate towing at the<br />

owner’s expense.<br />

H. Owners <strong>of</strong> vehicles will be held liable for all costs to repair damages to common areas caused by<br />

negligence, repair operations on the vehicle or storage <strong>of</strong> any combustible, dangerous or<br />

otherwise hazardous material on common areas (regardless <strong>of</strong> the type <strong>of</strong> container). This<br />

includes any discharge, leak or dripping <strong>of</strong> oils, fluids or other compounds onto Association<br />

property.<br />

I. Resident and non-resident <strong>owners</strong> may not use the parking lots for storage <strong>of</strong> any vehicle,<br />

including but not limited to covered automobiles and motorcycles. No vehicle without an<br />

Association decal may be parked continuously in the same unassigned space for a period<br />

exceeding 72 hours without prior written permission <strong>of</strong> the Board <strong>of</strong> Directors. No vehicle with<br />

an Association decal may be parked continuously in the same unassigned space for a period<br />

exceeding 14 days. No vehicle may display a conspicuous “FOR SALE” sign. Motorcycles may<br />

be co-located in an owner’s reserved garage parking space, along with their approved motor<br />

vehicle, if such practice does not create a hazard or cause either vehicle to protrude beyond the<br />

painted lines <strong>of</strong> any parking space, over any curbing or protrude beyond the end <strong>of</strong> the painted<br />

lines <strong>of</strong> that space<br />

J. Any unlicensed person is prohibited from operating any motor vehicle anywhere on comm<strong>unit</strong>y<br />

property.<br />

K. All persons operating motor vehicles upon common area shall conform to all traffic control signs<br />

posted on the premises, and in accordance with the provisions <strong>of</strong> the traffic ordinances <strong>of</strong> Fairfax<br />

County and the Commonwealth <strong>of</strong> Virginia.<br />

L. Operation <strong>of</strong> any motor vehicle in violation <strong>of</strong> the 1950 Code <strong>of</strong> Virginia, as amended, is<br />

prohibited. Consent is hereby given by the Board <strong>of</strong> Directors to all appropriate law enforcement<br />

<strong>of</strong>ficers who are hereby empowered to enforce all motor vehicle laws in the streets and common<br />

areas <strong>of</strong> the Condominium.<br />

M. Resident vehicles parked on the property must display current license plates, current state<br />

inspection sticker, local county regulations (if any) and valid Gates <strong>of</strong> Mclean parking decal.<br />

Violations <strong>of</strong> this rule may result in the posting <strong>of</strong> notice on the vehicle, directing removal <strong>of</strong> the<br />

vehicle or correction <strong>of</strong> the violation within three (3) days. All actions shall be coordinated with<br />

the Fairfax County Police Department in accordance with the applicable requirements <strong>of</strong> the<br />

Code <strong>of</strong> Virginia as amended.<br />

N. All vehicles parked on common areas must be maintained in an acceptable state <strong>of</strong> repair and<br />

operating condition so as not to be a hazard by noise element, emission or otherwise to meet the<br />

following conditions:<br />

(1) Powered vehicles must be maintained in an operative condition. For this purpose<br />

operative condition means that all necessary parts <strong>of</strong> the vehicle, including, but not<br />

limited to, tires, wheels, intact windows, engine, brakes, etc., that are necessary for the


safe and lawful operation <strong>of</strong> the vehicle on public streets must be maintained at all<br />

times.<br />

(2) Tires supporting vehicles on common areas must be inflated at all times to within 10<br />

PSI <strong>of</strong> the manufacturer’s recommended pressure so that they can be moved in the<br />

event <strong>of</strong> an emergency.<br />

(3) Vehicles may not be maintained in hazardous condition including, but not limited to,<br />

the prohibited parking <strong>of</strong> vehicles on jacks or blocks.<br />

O. Motorcycles and other approved motor vehicles shall be parked only in regular or standard<br />

parking spaces. They are not to be stored or parked on balconies or patios.<br />

III. PARKING SPACES<br />

No signs, initials, numbers, storage containers or any other additions or alterations to parking spaces<br />

may be painted, displayed or erected by any owner without the prior written consent <strong>of</strong> the Board <strong>of</strong><br />

Directors. This restriction does not apply to a uniform numbering or lettering system used by the<br />

Association. Except for the limited exception for motorcycles, parking spaces are limited to one<br />

approved motor vehicle.<br />

IV. LIMITATION ON ASSOCIATION RESPONSIBILITY<br />

Nothing in this resolution shall be construed to hold the Condominium, the Board <strong>of</strong> Directors or the<br />

Managing Agent responsible for damage to vehicles or loss <strong>of</strong> property from vehicles parked on the<br />

Common Elements.<br />

V. ENFORCEMENT OF VEHICLE RULES AND REGULATIONS<br />

The Board <strong>of</strong> Directors or Managing Agent is empowered to have any vehicle which is parked on the<br />

property that is in violation <strong>of</strong> this Resolution; as amended from time to time, the Condominium<br />

Instruments or the Code <strong>of</strong> Virginia, removed from the Condominium property, at the risk and<br />

expense <strong>of</strong> the vehicle’s owner, provided that proper notice, is given. Proper notice shall include but<br />

is not limited to, any posted signage or marking <strong>of</strong> common property or posting <strong>of</strong> notice on vehicle.<br />

In addition to the towing provisions cited below, alleged or actual breaches <strong>of</strong> the above regulations<br />

are subject to appropriate action by the Board <strong>of</strong> Directors or Managing Agent under the provisions<br />

<strong>of</strong> Policy Resolution No. 5.<br />

A. All vehicles that are parked in the Common or Limited Common Element parking spaces are<br />

subject to the provisions <strong>of</strong> this resolution. Vehicles which are in violation <strong>of</strong> the provisions<br />

<strong>of</strong> this resolution will be subject to towing, in accordance with any applicable legal<br />

requirements.<br />

B. The Managing Agent shall have the authority to issue a warning notice to vehicles which are<br />

in violation <strong>of</strong> this parking policy during the normal hours <strong>of</strong> operation <strong>of</strong> the Management<br />

Office. Notice shall be placed on the vehicles front or rear window with a copy <strong>of</strong> such<br />

notice being retained by the Management Office.


C. Except for the provisions regarding parking spaces assigned to residential <strong>unit</strong>s, or as<br />

otherwise provided in this resolution, vehicles are subject to being towed at the owner’s risk<br />

and expense seventy-two (72) hours from the date <strong>of</strong> tagging, except that any vehicle<br />

previously posted for violation <strong>of</strong> any <strong>of</strong> these regulations shall be subject to towing without<br />

notice for a repetition <strong>of</strong> same violation.<br />

D. Any vehicle which is obstructing vehicular access or egress to, from or within the property,<br />

obstructing a fire lane or creating an emergency situation may be towed immediately, at<br />

owner’s expense, without regard to any other provision <strong>of</strong> this Resolution.<br />

E. Owners/residents must call the Association’s designated towing company for the removal <strong>of</strong><br />

a parked vehicle from their assigned reserved space only. Owners/residents may be required<br />

to show pro<strong>of</strong> <strong>of</strong> <strong>owners</strong>hip <strong>of</strong> the reserved parking space and may be responsible for all<br />

towing and all related costs resulting from having a vehicle towed illegally.<br />

Owners/residents may be responsible for tow charges if the tow truck arrives after the<br />

<strong>of</strong>fending vehicle has departed depending on the policy <strong>of</strong> the tow service.
