The criminal attempt, conspiracy, or solicitation to commit any <strong>of</strong> the acts listed above.<br />

Any person who was convicted on or after July 1, 1991, in another state or jurisdiction, including but not<br />

limited to a military or federal jurisdiction, <strong>of</strong> an <strong>of</strong>fense that, if committed in Colorado, would constitute<br />

one <strong>of</strong> the <strong>of</strong>fenses above.<br />

Any person who was released on or after July 1, 1991, from the custody <strong>of</strong> the department <strong>of</strong> corrections <strong>of</strong><br />

this state or any other state, having served a sentence for one <strong>of</strong> the <strong>of</strong>fenses above.<br />

A staff member convicted <strong>of</strong> violating C.R.S.A. § 18-7-01 “<strong>Sex</strong>ual Conduct in Penal Institutions,” must register as a<br />

sex <strong>of</strong>fender.<br />

Note, § 18-7-01, on its face, does not require a convicted staff member to register as a sex <strong>of</strong>fender. However, a<br />

staff member convicted <strong>of</strong> an “unlawful sexual behavior” is required to register as a sex <strong>of</strong>fender. See, § 16-22-103.<br />

Included in the enumerated <strong>of</strong>fenses <strong>of</strong> “unlawful sexual behavior” is “Engaging in sexual conduct in a penal<br />

institution under § 18-7-01”. See, § 16-22-102.<br />

A staff member convicted <strong>of</strong> sexual assault under § 18-3-402 is required to register as a sex <strong>of</strong>fender.<br />

A staff member who uses his position <strong>of</strong> authority to coerce the victim in custody <strong>of</strong> law to submit to a sexual act,<br />

has committed sexual assault under § 18-3-402. Assault as defined under § 18-3-402 is an enumerated <strong>of</strong>fense <strong>of</strong><br />

“unlawful sexual behavior” and a resulting conviction requires a staff member to register as a sex <strong>of</strong>fender.<br />

Relevant Statutes:<br />

** Denotes those states where sex <strong>of</strong>fender registration is required for convictions under the staff sexual misconduct laws <strong>of</strong> the states. Staff and<br />

inmates could also be required to register as sex <strong>of</strong>fenders if the <strong>of</strong>fense were charged under other registrable <strong>of</strong>fenses.<br />
