2. The provisions <strong>of</strong> this subsection (B) shall not apply to:<br />
a. Passengers, other than the driver or a front seat passenger, located in the<br />
passenger area <strong>of</strong> a motor vehicle designed, maintained, or used primarily for the<br />
transportation <strong>of</strong> persons for compensation;<br />
b. The possession by a passenger, other than the driver or a front seat passenger, <strong>of</strong> an<br />
open marijuana container in the living quarters <strong>of</strong> a house coach, house trailer,<br />
camper, motor home, as defined in Section 42‐1‐102(57), C.R.S., or trailer coach, as<br />
defined in Section 42‐1‐102(106)(a), C.R.S.;<br />
c. Possession <strong>of</strong> an open marijuana container in the area behind the last upright seat <strong>of</strong><br />
a motor vehicle that is not equipped with a trunk; or<br />
d. The possession <strong>of</strong> an open marijuana container in an area not normally occupied by<br />
the driver or a passenger in a motor vehicle that is not equipped with a trunk.<br />
3. Any person who violates the provisions <strong>of</strong> this subsection (B) commits a Class B<br />
municipal <strong>of</strong>fense.<br />
9.08.100 POSSESSION <strong>OF</strong> DRUG PARAPHERNALIA PROHIBITED<br />
A. “Drug paraphernalia” means all equipment, products, and materials <strong>of</strong> any kind which<br />
are used, intended for use, or designed for use in planting, propagation, cultivating,<br />
growing, harvesting, manufacturing, compounding, converting, producing, processing,<br />
preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing,<br />
injection, ingestion, inhaling, or otherwise introducing into the human body a controlled<br />
substance in violation <strong>of</strong> the laws <strong>of</strong> this State. “Drug paraphernalia” includes, but is not<br />
limited to:<br />
1. Testing equipment used, intended for use, or designed for use in identifying or in<br />
analyzing the strength, effectiveness, or purity <strong>of</strong> controlled substances under<br />
circumstances in violation <strong>of</strong> the laws <strong>of</strong> this State;<br />
2. Scales and balances used, intended for use, or designed for use in weighing or<br />
measuring controlled substances;<br />
3. Separation gins and sifters used, intended for use, or designed for use in removing<br />
twigs and seeds from or in otherwise cleaning or refining marijuana;<br />
4. Blenders, bowls, containers, spoons, and mixing devices used, intended for use, or<br />
designed for use in compounding controlled substances;<br />
