power to acquire land under the law, undertake any work in<br />

pursuance of any scheme or project; no master plan, planning or<br />

development scheme can be prepared by any local body or agency<br />

for the specified area without prior cons<strong>ul</strong>tation with, and approval<br />

of, the Executive Board (Section 9). The Authority through the<br />

Executive Board has the power to raise funds for the purpose of its<br />

working capital in a manner the Board may think proper, through<br />

loans or levy of any charges which may be prescribed by it under<br />

the R<strong>ul</strong>es (Section 10). The Administrator functions in accordance<br />

with the policy laid down by the Governing Body (Section 11). All<br />

schemes/projects/works carried out by the Authority are deemed<br />

under the law to be schemes for public purposes (section 12). The<br />

employees of the Authority are deemed to be public servants within<br />

the meaning of section 21 of the Pakistan Penal Code (Section 16).<br />

The Governing Body has the power to make R<strong>ul</strong>es by notification in<br />

the Official Gazette for carrying out the purposes of the<br />

Order/Statute. (Section 22). The Executive Board has the power to<br />

make Reg<strong>ul</strong>ations not inconsistent with the provisions of the Order<br />

and the r<strong>ul</strong>es as it may consider necessary or expedient for the<br />

administration and management of the affairs of the Authority.<br />

(Section 23).<br />

In Civil Appeal Nos. 1150 and 228-K of 2010,<br />

respondents were employees of Pakistan International Airlines<br />

Corporation. In Civil Appeal No. 117-K of 2010, respondents were<br />

employees of Housing Building Finance Corporation. In Civil<br />

Appeal No. 142-K of 2009, respondents were employees of N.E.D.<br />

University. In Civil Appeal No. 188-K of 2011, respondents were
