CCA Works To Protect Scope Of Practice
CCA Wins Retraction
from BCE and Reverses RHB
The BCE’s retraction of chiropractic scope limitation letter
and the RHB’s retraction of its DC x-ray enforcement practice
- at CCA’s urging – makes reimbursement that otherwise
would have been denied possible as well as upholds
for all doctors of chiropractic their scope of practice and
their patients to right to access chiropractic care.
CCA Wins Retraction of
DC Scope-Limiting BCE Letter
CCA won retraction of a 2004 letter penned by then-state
Board of Chiropractic Examiners’ (BCE) staff that misrepresented
Section 302 of the BCE regulations relating to chiropractic
scope of practice. The BCE has posted to its website
a notice stating the letter does not represent BCE policy.
The April 8, 2004, letter surfaced during CCA’s recent successful
advocacy to have the State Compensation Insurance
Fund reverse its policy prohibiting referrals to doctors
of chiropractic for any post-operative treatment regardless
of the circumstances. It was sent to SCIF in response to a
request for clarification of the BCE’s interpretation of Section
302. The BCE’s letter incorrectly stated:
• “…during most, if not all, chiropractic office visits manual
manipulation should be provided to the patient.”
• “For other conditions (i.e. post-surgical rehabilitation of
knee), manual manipulation will not be incorporated into
the treatment program at any point. This is perceived by
the Board as being a violation of the scope of chiropractic
practice.”
This is an important victory of the chiropractic profession.
If third-parties restrict your services using the BCE letter as
a basis, direct those third parties to the BCE website.
CCA thanks the BCE members for recognizing the impediments
the BCE letter could have on patient access to chiropractic
care and for its swift response to correct the situation.
CCA Reverses
RHB DC X-ray Limitation
Moving swiftly, CCA prevailed successfully on the state Radiologic
Health Branch (RHB) to reverse its enforcement
practice of prohibiting certain x-rays to be taken by doctors
of chiropractic.
Two members contacted CCA becasuse they were told by
RHB inspectors that doctors of chiropractic were not permitted
to take chest x-rays as they were outside the chiropractic
scope of practice; one was cited. CCA enlisted the
assistance of CCA member Cliff Tao, DC, DACBR, a CCArecommended
member of the RHB Radiologic Technology
Certification Committee, to educate RHB officials on the
chiropractic scope of practice. Given Dr. Tao’s credibility
and knowledge, the RHB reversed its enforcement practice
and rescinded the one member’s citation.
As doctors know, doctors of chiropractic are permitted to
take patient x-rays for diagnostic purposes without limitation.
Section 302 (a)(6) of the chiropractic regulations
states “…a duly licensed chiropractor may make use of X-
ray and thermography equipment for the purposes of diagnosis
but not for the purposes of treatment.”
CCA members who have been cited or told by the RHB that
they cannot take chest or other patient x-rays are urged to
contact Bill Howe at CCA.
CCA thanks Dr. Tao for his quick and professional assistance
in resolving the situation with the RHB and the RHB for its
DC enforcement practice reversal.
Recover Your Reduced Or Denied
Free Money!
If you happen to be one of those
rare individuals who can’t use some
free money, then you might want to
skip over to the next article. But for
the 99.999 percent of us who can
always find some good use for extra
cash, then you need to take a hard
look at the amazing services offered
by Advantage Claim Recovery Group
(ACRG), an endorsed partner of CCA.
Advantage Claims Recovery Group
was launched in 1995 by Pamela
Davis, a Registered Nurse. She was
working in the insurance cost containment
industry and quickly recognized
the need by medical and health
care professionals to recover denied,
uncollected and disputed workers’
compensation claims. After a little
research, she discovered that more
than 40 percent of all claims were
being denied.
found that doctors are just too busy
to spend a lot of time on paperwork.
They want to treat their patients.”
So the company evolved to provide
that specialized services doctors
need—making sure that everything
is fully and properly billed, and everything
the doctor is owed for the
services provided is paid by the insurance
company.
“We recover lost revenue,” Pamela
said succulently.
Statistics show that less than 50 per-
She tried to find a quality service to
research the denied claims and file
corrected paperwork to recover this
lost money, but was not able to find
one that met her high standards. So,
in typical American fashion, she started
her own company.
“When I started the company I wanted
to teach and train doctors to get
their billing right,” she said. “But I
there are viable claims buried in
the denied paperwork. Claims that
were denied for a variety of reasons,
many of which can be corrected, such
as incomplete or improperly coded
claims. And, often the doctor’s staff
doesn’t have the time or expertise to
analyze the rejected claims and resubmit
them for full payment. Poring
over claims paperwork takes a lot of
time, patience, and knowledge.
Advantage Claims Recovery Group
has the time and they absolutely
have the expertise. They have lived
up to their company motto: We put
your money where it belongs—back
in your business!
ACRG has established and maintained
a reputation of excellence within the
claims recovery industry – and with
good reason. ACRG is committed to
providing the highest level of client
care and customer service available.
Celebrating their 16th year in business,
ACRG is a family-owned American
success story, thanks to the hardwork
and dedication of Pamela Davis,
and her husband Richard, who joined
the firm in 1998.
“What happens a lot,” Pamela explained,
“is that the doctor’s office
staff is so involved in the day-to-day
operations and care of the patients—
and rightly so—that sometimes billing
collections follow-up can be delayed
or overlooked completely due
to the massive paper requirements
of the insurance industry.”
When that happens, ACRG steps in to
help. Where most collection companies
will just collect on the AR, ACRG
will not only collect the outstanding
accounts receivables, they will review
the patient file, including the
soap notes and ledger, to identify any
missed billing or collection opportunities.
“We analyze everything,” Pamela
noted. “We make sure the treatments
are billed properly, coded
properly and reimbursed properly.”
Recovering your lost reve
ACRG puts the money back where it belongs: in your
When they find a problem that has
caused a partial payment or a denied
claim, they file a rebilling, or provide
additional documentation to clarify
a course of treatment that enables a
reviewer to approve the claim. They
also check the fee schedules to make
sure that the paperwork correctly
identifies the proper fee scale and
that the insurance reviewer has applied
the proper schedule.
The staff employed by Advantage
Claims Recovery Service is experienced
and trained to spot problems
with files and correct them. Collectively,
they have several centuries
worth of experience. Even the most
experienced doctor’s office staff can’t
match that level of experience. Consider
ACRG a specialist that can find
free money for you.
And when we say free, we mean totally
free. There is no fee involved.
Doctors of chiropractic pay nothing
— perhaps one can get something
for nothing after all.
collect your documentation and review
it for free. They even pay for
the shipping. When they find treatment
that has not been billed, or was
billed incorrectly, or a claim that was
denied or underpaid, they file the appropriate
documents, appeals or paperwork
to get you paid. They take a
percentage of what they collect, and
the rest comes to you. This is truly
So, how does it work?
business
“free money” because it costs chiropractors
nothing to get it—Advantage
Claims Recovery Service does all
of the work—and because without
the hard work of ACRG this money
would have been lost forever.
Still not convinced? Okay, here’s
another service they offer that sets
them above their competition: After
ACRG has gone through your files,
and found money for you, they will
give back to you a “Practice Analysis”
that will help your staff avoid some
of the errors they discovered. This
means more money for you in the
future, and received by you sooner.
You’re working hard, shouldn’t you
get paid fully?
Do you need another reason to pick
up the phone and call them today?
Okay, how about $72 million, which
is the amount of money collected by
ACRG since they began helping doctors
of chiropractic and other medical
professionals. That’s a staggering
amount of money that would have
been lost forever because claims
were rejected or underpaid. $72 million
is how much free money ACRG
has recovered for health care professionals.
Finally, CCA members get these exclusive
benefits from ACRG: Your
files get priority status, and ACRG
waives the $150 PMB fee!
So now you need to ask yourself:
How much money is buried in your
files that could be found, obtained,
and returned to you by Advantage
Claims Recovery Group?
If you are not sure, or even just curious,
then pick up the phone and call
ACRG today. They will review your
files and let you know. And, chances
are, they will be able to recover money
for you and send you some free
money! Wouldn’t that be sweet!
According to Pamela, the work her
company does helps many doctors.
“It’s very exciting to recover funds for
physicians, particularly in this economy.
We have worked with physicians
who have indicated they are having
financial problems. They were treating
the patients, but simply not being
paid for it. So it gives us great pleasure
to see that we are truly making
a difference on the bottom line for
many small business owners.”
If you’re ready to have the experts at
ACRG review your files and send you
some free money, give them a call.
Naturally, the call is toll-free: 800-
If there’s anything doctors of chiropractic understand,
it’s the value of amazing service. Being a terrific chiropractor
is all well and good, but establishing a rapport
with your patients, learning to listen to them, and giving
them the personalized services they desire is mission
critical to running a successful practice.
Heartland Payment Systems, a professional affiliate
member of CCA and a major sponsor and supporter,
understands that the same is true for vendors to chiropractors.
“The bottom line for us,” said Chad Preuss, senior affiliate
relations manager, “is not just reducing expenses
and overhead for chiropractors—which we do. But
also giving chiropractors the individualized services
and support they need to flourish and grow.”
Heartland Payment Systems, established in 1997, is
one of the top five credit card processing companies in
America. But saving businesses money on their credit
card transactions is not all they do.
“Many people don’t realize that we also offer payroll
services,” noted Chad. “We often can save doctors 10
to 12 percent on their payroll.”
Heartland Pay
Continued from previous page
Heartland tailors every payroll program
to fit your practice’s individual
needs. You pay only for the features
you want. They offer a full suite of
value-added solutions including time
and attendance, workers’ compensation
programs, and prepaid payroll
cards. Once you have settled on the
features you want, and the price that
meets your budget, Heartland will
lock that price in for three years with
their “fixed-price agreement” that
guarantees your payroll processing
costs won’t arbitrarily increase.
“We recently quoted a business on
its payroll and credit card services together,”
Chad added, “and we were
able to save them a whopping 47%.”
While Heartland will happily quote
CCA members for either credit card
processing or payroll services, they
excel at bundling these services and
providing deeper savings.
“CCA members can call me,” said
Chad, “at 402-502-1514 and I will get
their local account representative to
contact them, set a convenient date
for a face-to-face meeting, followed
by a written analysis of the services
that fit into their business and how
much money we can save them.”
Heartland is a national company, with
all the resources that implies, but
they have local account representa-
tives throughout California to give
CCA members individualized service.
“What makes us different from most
other companies,” Chad said with
pride, “is that we have an extensive
network of representatives who are
available 24/7 to answer questions or
solve problems.”
In addition to the always-available
account representatives, Heartland
also offers gift cards, which is an excellent
word-of-mouth marketing
tool to help doctors obtain new patients
and practice members.
Gift cards work well because it’s a
personal endorsement from the card
giver to the recipient. Basically, your
customers are encouraging their
friends and neighbors to use your
chiropractic service. The recipient,
who otherwise may not be familiar
with you as a doctor of chiropractic,
now has the chance to become a
new, loyal patient or practice member
Gift cards are often successfully
used to generate loyalty by rewarding
patients and practice members
“We recently quoted a business on
its payroll and credit card services
together and we were able to save
them a whopping 47%.”
and motivating them to return. You
can also turn your gift cards into
stored-value cards and offer incentives
that entice patients to continue
loading money onto them.
Heartland works closely with each
chiropractor to determine the incentives
that resonate with your patient
base. When patients invest in your
business this way, they commit to
spending more money.
For more information on how a gift
card program can pump up your profits,
give Chad a call at 402-502-1514
and he’ll send out your local account
representative to meet with you and
explain all the ins and outs of this terrific
program.
“The bottom line,” said Chad, “is
value. Not just a reduction in what
chiropractors pay out of their pocket,
but a significant increase in the services
given to them so that they can
concentrate on their core business
and not worry that they are paying
too much to take their patient’s credit
card payments, or that their payroll
service is too complicated or too expensive.”
Founded in 1938 by Warren Bender, this CCA endorsed
partner and major supporter is one of the largest independently
owned insurance brokerage firms in Northern California.
Since the beginning there has been a focus that is
defined in their current mission of “providing protection,
superior service and education to those who matter most,
our customers.”
The family and their employees have worked diligently to
fulfill that mission. In 1982 Warren’s youngest son, Stephen,
took over the reins. Today, there are six family members
integrated into their 40+ organization. To those who
say the family-owned business in America is dying out,
we offer the Warren G. Bender Co. as a testament to the
health and strength of this cherished American dream.
The company’s steady growth over the past 75 years, despite
turbulent economic times, underscores their success
in protecting their customer’s businesses and assets, and
their unwavering commitment to superior service and education.
“Giving our customers the very best service that we possibly
can, and building vibrant working relationships, is what
this company is all about,” said Chris Bender, a grandson
of the founder.
While the company offers the entire range of insurance
products – including CCA-endorsed auto, home and workers’
compensation plans – it recently opened up group
health plans to CCA members. This should have you and
your staff leaping for joy, because you can lower your insurance
costs, and maintain or expand your coverages.
Essential Benefits
Have Your Say by Enrolling in ChiroVoice
As members are aware, a primary component of the Patient Protection and Affordable Care Act
– the health care reform law – is the requirement for all carriers and state exchanges to cover 10
specified “essential benefits.”
CCA is working with the Summit to ensure doctors of chiropractic will be eligible to directly treat
patients under many of the mandatory benefits.
If not included, given California’s beleaguered financial condition, it is widely believed that it will
be a steep uphill fight to include the services of chiropractic doctors within the state exchanges.
It is therefore critically important for doctors, their patients, family and friends to enroll for free
in ChiroVoice to participate in a national grassroots campaign to achieve this objective.
Stand Up for Your Chosen Profession by Enrolling in ChiroVoice
Here’s all you need to do:
1. Sign up for ChiroVoice for free
2. Get your patients to sign up for ChiroVoice.org at a computer terminal in your office or have
each patient fill out a sign-up form and have your staff enter them into the database. (Note: If
you don’t have staff or time, fax the competed forms to 916.648.2738 and CCA will enter them
for you.)
Getting You The Right Coverages
Continued from previous page
“CCA members should not assume
they have the health insurance coverage
that’s right for their organization
or their family. That’s a dangerous
assumption. It’s pays to investigate,
even if you only get back the assurance
that you actually have the right
coverage at the lowest price.”
Health plans are complicated, Chris
explained, and price is dependent on
the coverage desired, deductible levels,
size of the group and utilization
data.
“I had one chiropractor who was paying
about $30,000 a year to just for
his own family’s medical insurance,”
Chris recalled. “After reviewing his
needs, we offered him a plan that appropriately
covered him and also his
staff and cut his annual bill in half.”
Warren G. Bender Co. is offering a significant
bonus to CCA members who sign up for a costeffective
group health plan. With five or more
employees participating in the plan, you will
receive access to the California Chamber of
Commerce’s excellent Human resources program,
HRCalifornia Express.
HRCalifornia Express is the latest Web site
by CalChamber, designed for those new to managing
HR issues. It provides HR Basics, Forms & Templates, Wage
Order Wizard, Required Posters chart, and a glossary of the most
common terms. On HRCalifornia Express, you can get the basic information
you need with streamlined, step-by-step instructions on
how to stay compliant with California employment law.
If you think your office is too small to
qualify for a group plan, think again.
As few as two people—which could
be a husband and a wife, or a chiropractor
and a receptionist—can qualify.
And, group plans are usually less
expensive than individual plans.
“Some insurance agencies don’t like
to write small group health plans,
especially if they are combined with
high deductible plans” Chris explained,
“because there’s not a lot
of profit in them. But here at Warren
G. Bender Co. we are big enough to
have the economies of scale that enable
us to write this business. Plus,
it’s a tremendous service that we can
provide to our customers—so, naturally,
we want to offer this.”
As usual, Warren G. Bender Co. is going
the extra mile for their customers.
They have arranged with the
California Chamber of Commerce to
make available their excellent Human
Resource program, called HRCalifornia
Express, to every doctor’s office
with five or more people enrolled in
a group health plan. This is a $2,000
value, given to CCA members for
free. For doctors with less than 5 employees,
this service can be obtained
at the substantially reduced price of
$40 annually.
Affordable Group Health Plans W
Continued from previous page
Many doctors, while excellent at the
practice of chiropractic, may not be
human resource wizards, and, let’s
face it, running a business in California
can be complicated and expensive.
HRCalifornia Express takes the
Managing your insurance needs is
what the Warren G. Bender Co. can
help you with.
“The most important aspects of employee
benefits,” Chris said, “are to
get the coverages that best fit the
needs of the office, and to keep costs
different plans.” So, where to begin?
Start with a phone call. It’s toll-free:
800-479- 8558. Ask for an employee
benefits specialist.
“We’d be honored to help every CCA
member personally,” Chris said. “So,
for fast service, CCA members should
and can help keep your business
out of court. The program’s resources
and standardized templates
ease the process of managing your
personnel.
down. All the while, focusing on providing
superior service through each
transaction.”
When it comes to group health plans,
there are, in Chris’s words, “tons of
ask for an employee benefits specialist,
when contacting our office.”
That person will help you analyze
what types of coverages you want for
yourself and your employees, what
ith An Eye On Your Bottom Line
Getting the right coverages and deductible
levels helps keep the costs
down, and in this age of tight budgets,
anything that will help contain
the cost of doing business is a blessall
the right coverages, and that you
are paying the lowest rate. But, in
many cases, you will be pleasantly
surprised to find all that you can get
offering a group health plan.
The professionals at Warren G. Bender
Co. can also advise you about the
changes in the Health Reform law,
and help you to be compliant in a
cost-effective manner.
deductible level you are comfortable
with, and give you a number of options
to select from.
Warren G. Bender Co. offers everything
from basic catastrophic coverage
health plans that take care of
your major medical emergencies, to
full-coverage, low-deductible plans
that take care of all your medical
needs.
“One of the things we notice about
chiropractors as a group,” Chris
pointed out, “is that they tend to take
good care of themselves. So, often,
they don’t need an expensive group
medical plan because they would be
paying for services they might never
use.”
ing—and that’s what Chris Bender
and his team of specialists will do for
CCA members.
Give them a call and have your group
health plan checked over. As Chris
pointed out, at the very least you will
receive the assurance that you have
Journal Gets ‘Easy Print’ Feature
By Steve Berlin, Owner
C&S Publishing
Many people stopped by our booth at the 2011 CCA Annual
Convention & Exposition and said nice things about
the digital Journal magazine. For all the chiropractors who
took the time to come by and tell us they loved the Journal,
THANK YOU! We work diligently and assiduously on
each issue, and we appreciate the applause of the people
we do all the work for, which would be you, the readers.
Some asked if it would be possible to add a new feature,
where the major articles in each issue could be easily
printed out and saved for future reference. We are pleased
to say that not only is it possible, but we are adding that
feature beginning with this issue! Articles with the icon
below can now be easily printed. Clicking the icon will take
you to a PDF which is specifically formatted to make printing
that story easy and quick.
