Organisation, Insurance and Liability<br />

for Transports by Inland Waterway at<br />

the Centre of the CMNI Meeting<br />

The focus was on the “Contract de Transport Merchandise en Navigation Interiéur“ (CMNI) plus questions of<br />

liability and insurance in inland waterway shipping at an event arranged by Imperial Reederei GmbH on<br />

27th October 2007.<br />

The CMNI, in English the “Budapest<br />

Convention on the Contract for<br />

the Carriage of Goods by Inland<br />

Waterway Shipping”, has to date been<br />

ratified by Bulgaria, Croatia, Luxem -<br />

bourg, the Netherlands, Romania, the<br />

Russian Federation, Switzerland, the<br />

Czech Republic, France and Slovakia. It<br />

is also in effect on German waterways<br />

since 1st November 2007 and it changes<br />

the daily work of shipping and logistics<br />

companies. At the end of October 2007,<br />

more than 70 employees of Imperial<br />

Reederei GmbH and its subsidiaries<br />

found out about how the CMNI affects<br />

their work.<br />

The convention applies to all commer -<br />

cial, cross-border transports of goods<br />

when the loading harbour or place of<br />

takeover and the unloading harbour or<br />

point of delivery are situated in two<br />

different countries. The member states<br />

can nevertheless exclude individual<br />

waterways from the scope of the CMNI.<br />

The contract furthermore only applies<br />

to freight, yet not to towing and pushing<br />

contracts.<br />

The agenda for the event also included<br />

questions of liability and insurance in<br />

the organisation of transports by inland<br />

waterways. Among other things, Udo<br />

Griewatz and Stefan Rogge from Regent<br />

Insurance Brokers (Europe) GmbH in -<br />

formed the participants about the dif -<br />

ferent types of insurance and the costs<br />

to be expected in a case of damage.<br />
