Appointment of Dr <strong>Hasil</strong><br />

On 1 July 2005, Dr A wrote to Dr <strong>Hasil</strong>, via <strong>the</strong> recruitment agency, offering him <strong>the</strong><br />

position of Medical Officer, Department of Obstetrics <strong>and</strong> Gynaecology, under <strong>the</strong> terms<br />

<strong>and</strong> conditions set out in <strong>the</strong> letter <strong>and</strong> attached job description. The appointment was<br />

subject to Dr <strong>Hasil</strong>’s registration with <strong>the</strong> Medical Council <strong>and</strong> having a current annual<br />

practising certificate (APC), <strong>and</strong> was to commence on 2 August 2005.<br />

The position description for Medical Officer, Obstetrics <strong>and</strong> Gynaecology set out <strong>the</strong> key<br />

accountabilities, including <strong>the</strong> expected outcomes. The expected outcomes included<br />

assisting <strong>the</strong> specialist consultants in:<br />

• <strong>the</strong> operating <strong>the</strong>atre <strong>and</strong> carrying out procedures as directed by <strong>the</strong>m under <strong>the</strong>ir<br />

supervision,<br />

• <strong>the</strong> provision of outpatient care in antenatal, family planning <strong>and</strong> gynaecology<br />

clinics, <strong>and</strong><br />

• <strong>the</strong> management of patients in <strong>the</strong> Delivery Suite.<br />

It also stated that <strong>the</strong> medical officer is “to supervise <strong>the</strong> inpatient management of<br />

patients in <strong>the</strong> Obstetrics <strong>and</strong> Gynaecology Department under <strong>the</strong> direction of <strong>the</strong><br />

appropriate Specialist Consultant”.<br />

In relation to quality assurance <strong>and</strong> peer review, <strong>the</strong> expected outcome was that Dr <strong>Hasil</strong><br />

would attend <strong>and</strong> participate in regular departmental audit/peer review activities,<br />

including morbidity/mortality meetings, <strong>and</strong> would participate in an annual performance<br />

review.<br />

The letter of offer explained that Dr <strong>Hasil</strong> would be responsible to Dr A as Clinical<br />

Director, Surgical <strong>and</strong> Support Services <strong>and</strong> noted <strong>the</strong> frequency of call as 1 in 4, which<br />

would become 1 in 3 when cover was required during periods of leave or sickness.<br />

The offer stated that before <strong>the</strong> appointment was taken up “a set of performance criteria<br />

must be agreed between us in writing, against which you will be formally reviewed in<br />

writing every six months on <strong>the</strong> basis of <strong>the</strong> st<strong>and</strong>ard <strong>DHB</strong> performance review policy”.<br />

On 5 July 2005, Dr <strong>Hasil</strong> accepted <strong>the</strong> contract <strong>and</strong> signed <strong>the</strong> letter of offer.<br />

Registration of Dr <strong>Hasil</strong><br />

On 5 July 2005, <strong>the</strong> Medical Council received Dr <strong>Hasil</strong>’s application for registration. The<br />

application was for registration within a provisional general scope of practice via <strong>the</strong><br />

comparable health system pathway, based on Dr <strong>Hasil</strong>’s relevant <strong>and</strong> comparable<br />

experience in obstetrics <strong>and</strong> gynaecology in Australia. Dr <strong>Hasil</strong> signed a registration form<br />

on 1 August 2005. The answers he gave to <strong>the</strong> questions on <strong>the</strong> form regarding his<br />

conduct, character <strong>and</strong> professional competence did not give <strong>the</strong> Medical Council any<br />

cause for concern.<br />

The Medical Council received a certificate of good st<strong>and</strong>ing from <strong>the</strong> New South Wales<br />

Medical Board, dated 1 June 2005. It certified that <strong>the</strong> Board was not conducting any<br />

proceedings against Dr <strong>Hasil</strong> under <strong>the</strong> New South Wales Medical Practice Act 1992.<br />
