reference could be counted as one of <strong>the</strong> two, provided that she confirmed that she had<br />

verified it.<br />

References were <strong>the</strong>n provided from Referee G <strong>and</strong> Referee H, who had worked with Dr<br />

<strong>Hasil</strong> at Lismore Base Hospital. On 20 July 2005 Referee G, a consultant paediatrician,<br />

provided a referee’s report, which was satisfactory. Referee H, Consultant, Obstetrics<br />

<strong>and</strong> Gynaecology, Lismore Base Hospital, provided a reference. His reference, dated 31<br />

May 2005, indicated that he had known <strong>and</strong> worked with Dr <strong>Hasil</strong> for three years. He<br />

commented that Dr <strong>Hasil</strong>’s record-keeping was suboptimal, but <strong>the</strong> remainder of <strong>the</strong><br />

reference was satisfactory.<br />

The recruitment agent signed as referee for both <strong>the</strong> reports from Referee G <strong>and</strong> Referee<br />

H. In nei<strong>the</strong>r of <strong>the</strong> reports was <strong>the</strong>re an answer to <strong>the</strong> question, “What would you<br />

describe as <strong>the</strong> applicant’s weakness/limitations?”<br />

Dr <strong>Hasil</strong> met all <strong>the</strong> requirements for registration under <strong>the</strong> comparable health system<br />

pathway. On 27 July 2005 <strong>the</strong> Medical Council advised <strong>the</strong> recruitment agency that it<br />

had confirmed Dr <strong>Hasil</strong>’s eligibility for medical registration in New Zeal<strong>and</strong>, <strong>and</strong> that he<br />

must attend an interview with a Council agent, who needed to sight <strong>the</strong> necessary<br />

original documentation before registration could be approved.<br />

On 27 September 2005, <strong>the</strong> Medical Council wrote to Dr <strong>Hasil</strong> confirming that he had<br />

been granted registration within a provisional general scope of practice to work as a<br />

Medical Officer in Obstetrics <strong>and</strong> Gynaecology at Wanganui Hospital under <strong>the</strong><br />

supervision of Dr A between 8 August 2005 <strong>and</strong> 28 February 2006.<br />

A letter was also sent to <strong>Whanganui</strong> <strong>DHB</strong> confirming Dr <strong>Hasil</strong>’s registration with <strong>the</strong><br />

Medical Council. The Council explained that <strong>the</strong> conditions of his registration were<br />

noted on <strong>the</strong> certificate <strong>and</strong> that he was not to work outside <strong>the</strong> conditions. It also stated<br />

that Dr <strong>Hasil</strong> must practise under supervision, <strong>and</strong> that Dr A, as his supervisor, was<br />

required to report to <strong>the</strong> Council on Dr <strong>Hasil</strong>’s performance at three-monthly intervals.<br />

Undisclosed information<br />

A review of <strong>the</strong> documentation Dr <strong>Hasil</strong> provided to <strong>the</strong> <strong>DHB</strong> <strong>and</strong> <strong>the</strong> Medical Council<br />

revealed some obvious discrepancies <strong>and</strong> omissions. During this investigation, my Office<br />

made enquiries about Dr <strong>Hasil</strong> with his referees, <strong>the</strong> hospitals he had worked in,<br />

registration bodies <strong>and</strong> RANZCOG. 5 It appears that Dr <strong>Hasil</strong> had a chequered work <strong>and</strong><br />

medical registration history. A number of matters may well have caused concern about<br />

Dr <strong>Hasil</strong>’s suitability for appointment or registration, or at least warranted closer<br />

scrutiny, had <strong>the</strong>y come to light at <strong>the</strong> time of his employment by <strong>Whanganui</strong> <strong>DHB</strong>.<br />

The first issue of concern relates to Dr <strong>Hasil</strong>’s registration status with <strong>the</strong> Medical<br />

Council of Tasmania. Dr <strong>Hasil</strong> claimed (in his CV) that he had worked at <strong>the</strong> Royal<br />
