Driv<strong>in</strong>g on right side <strong>of</strong> roadway.(a) <strong>General</strong> rule.--Upon all roadways <strong>of</strong> sufficient width, a vehicle shall bedriven upon <strong>the</strong> right half <strong>of</strong> <strong>the</strong> roadway except as follows:(1) When overtak<strong>in</strong>g <strong>and</strong> pass<strong>in</strong>g ano<strong>the</strong>r vehicle proceed<strong>in</strong>g <strong>in</strong> <strong>the</strong> samedirection where permitted by <strong>the</strong> rules govern<strong>in</strong>g such movement.(2) When an obstruction exists mak<strong>in</strong>g it necessary to drive to <strong>the</strong> left <strong>of</strong><strong>the</strong> center <strong>of</strong> <strong>the</strong> roadway, provided <strong>the</strong> driver yields <strong>the</strong> right-<strong>of</strong>-way to allvehicles travel<strong>in</strong>g <strong>in</strong> <strong>the</strong> proper direction upon <strong>the</strong> unobstructed portion <strong>of</strong><strong>the</strong> roadway with<strong>in</strong> such distance as to constitute a hazard.(3) When <strong>and</strong> where <strong>of</strong>ficial traffic-control devices are <strong>in</strong> place designat<strong>in</strong>ga lane or lanes to <strong>the</strong> left side <strong>of</strong> <strong>the</strong> center <strong>of</strong> <strong>the</strong> roadway for <strong>the</strong>movement <strong>in</strong>dicated by <strong>the</strong> devices.(4) Upon a roadway restricted to one-way traffic.(5) When mak<strong>in</strong>g a left turn as provided <strong>in</strong> sections <strong>33</strong>22 (relat<strong>in</strong>g to vehicleturn<strong>in</strong>g left) <strong>and</strong> <strong>33</strong>31 (relat<strong>in</strong>g to required position <strong>and</strong> method <strong>of</strong> turn<strong>in</strong>g).(6) In accordance with section <strong>33</strong>03(a)(3) (relat<strong>in</strong>g to overtak<strong>in</strong>g vehicle on<strong>the</strong> left).(b) Vehicle proceed<strong>in</strong>g at less than normal speed.--(1) Upon all roadways any vehicle proceed<strong>in</strong>g at less than <strong>the</strong> normal speed <strong>of</strong>traffic at <strong>the</strong> time <strong>and</strong> place <strong>and</strong> under <strong>the</strong> conditions <strong>the</strong>n exist<strong>in</strong>g shall be


(b) Traffic-control devices at entrances.--The department, when adopt<strong>in</strong>g anyprohibition under this section, shall erect <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> <strong>of</strong>ficial trafficcontroldevices at <strong>the</strong> entrances to <strong>the</strong> limited access highway on which <strong>the</strong>prohibitions are applicable <strong>and</strong> when <strong>in</strong> place no person shall disobey <strong>the</strong>restrictions stated on <strong>the</strong> devices.(c) Motorcycles.--Except on busways <strong>in</strong> counties <strong>of</strong> <strong>the</strong> first or second class,motorcycles may be operated upon any limited access highway <strong>in</strong> an urb<strong>and</strong>istrict <strong>in</strong> a lane specified for multioccupant vehicles or car pools, exceptwhere <strong>the</strong> department can demonstrate that such use will create a safetyhazard.(d) Driv<strong>in</strong>g <strong>in</strong> right lane.--(1) Except as provided <strong>in</strong> paragraph (2) <strong>and</strong> unless o<strong>the</strong>rwise posted, upon alllimited access highways hav<strong>in</strong>g two or more lanes for traffic mov<strong>in</strong>g <strong>in</strong> <strong>the</strong>same direction, all vehicles shall be driven <strong>in</strong> <strong>the</strong> right-h<strong>and</strong> lanes whenavailable for traffic except when any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g conditions exist:(i) When overtak<strong>in</strong>g <strong>and</strong> pass<strong>in</strong>g ano<strong>the</strong>r vehicle proceed<strong>in</strong>g <strong>in</strong> <strong>the</strong> samedirection.(ii) When travel<strong>in</strong>g at a speed greater than <strong>the</strong> traffic flow.(iii) When mov<strong>in</strong>g left to allow traffic to merge.(iv) When prepar<strong>in</strong>g for a left turn at an <strong>in</strong>tersection, exit or <strong>in</strong>to a privateroad or driveway when such left turn is legally permitted.(2) Unless o<strong>the</strong>rwise posted, no vehicle or comb<strong>in</strong>ation over 10,000 pounds maybe driven <strong>in</strong> <strong>the</strong> left-h<strong>and</strong> lane <strong>of</strong> a limited access highway hav<strong>in</strong>g three ormore lanes for traffic mov<strong>in</strong>g <strong>in</strong> <strong>the</strong> same direction except when prepar<strong>in</strong>g fora left turn at an <strong>in</strong>tersection, an exit or <strong>in</strong>to a private road or drivewaywhen such left turn is legally permitted.(Apr. 29, 1994, P.L.148, No.25, eff. 60 days; June 25, 1999, P.L.164, No.23,eff. 180 days; June 26, 2001, P.L.734, No.75, eff. 60 days)2001 Amendment. Prohibit<strong>in</strong>g use <strong>of</strong> hear<strong>in</strong>g impairment devices.(a) <strong>General</strong> rule.--No driver shall operate a vehicle while wear<strong>in</strong>g or us<strong>in</strong>gone or more headphones or earphones.(b) Exception.--This section does not prohibit <strong>the</strong> use <strong>of</strong> hear<strong>in</strong>g aids oro<strong>the</strong>r devices for improv<strong>in</strong>g <strong>the</strong> hear<strong>in</strong>g <strong>of</strong> <strong>the</strong> driver, nor does it prohibit<strong>the</strong> use <strong>of</strong> a headset <strong>in</strong> conjunction with a cellular telephone that onlyprovides sound through one ear <strong>and</strong> allows surround<strong>in</strong>g sounds to be heard with<strong>the</strong> o<strong>the</strong>r ear, nor does it prohibit <strong>the</strong> use <strong>of</strong> communication equipment by <strong>the</strong>driver <strong>of</strong> an emergency vehicle or by motorcycle operators comply<strong>in</strong>g withsection 3525 (relat<strong>in</strong>g to protective equipment for motorcycle riders).(Mar. 29, 1984, P.L.159, No.31, eff. imd.; May 20, 1993, P.L.30, No.10, eff.60 days; July 6, 1995, P.L.315, No.48, eff. 60 days)§ <strong>33</strong>15. Pass<strong>in</strong>g <strong>and</strong> overtak<strong>in</strong>g streetcars.(a) <strong>General</strong> rule.--Notwithst<strong>and</strong><strong>in</strong>g any o<strong>the</strong>r provision <strong>of</strong> this subchapter, <strong>the</strong>driver <strong>of</strong> a vehicle may not overtake <strong>and</strong> pass to <strong>the</strong> left <strong>of</strong> a streetcarproceed<strong>in</strong>g <strong>in</strong> <strong>the</strong> same direction, whe<strong>the</strong>r <strong>the</strong> streetcar is actually <strong>in</strong> motionor temporarily halted to receive or discharge passengers, if overtak<strong>in</strong>g orpass<strong>in</strong>g requires driv<strong>in</strong>g <strong>in</strong> a lane normally used by traffic mov<strong>in</strong>g <strong>in</strong> <strong>the</strong>opposite direction.(b) Streetcar stopped to receive or discharge passengers.--The driver <strong>of</strong> avehicle may not overtake <strong>and</strong> pass a streetcar which has stopped to receive ordischarge passengers on <strong>the</strong> side on which passengers board or alight until<strong>the</strong> doors <strong>of</strong> <strong>the</strong> streetcar are closed <strong>and</strong> passengers who are discharged havereached <strong>the</strong> side <strong>of</strong> <strong>the</strong> highway.


(c) Applicability.--This section shall not be applicable to locations wherestreetcars are operat<strong>in</strong>g on tracks located with<strong>in</strong> a median section <strong>of</strong> <strong>the</strong>roadway separated from <strong>the</strong> roadway by curbs or o<strong>the</strong>r physical barriers.(May 11, 2006, P.L.159, No.37, eff. 60 days)2006 Amendment. Act 37 added section <strong>33</strong>15.§ <strong>33</strong>16. Prohibit<strong>in</strong>g text-based communications.(a) Prohibition.--No driver shall operate a motor vehicle on a highway ortrafficway <strong>in</strong> this Commonwealth while us<strong>in</strong>g an <strong>in</strong>teractive wirelesscommunications device to send, read or write a text-based communication while<strong>the</strong> vehicle is <strong>in</strong> motion. A person does not send, read or write a text-basedcommunication when <strong>the</strong> person reads, selects or enters a telephone number orname <strong>in</strong> an <strong>in</strong>teractive wireless communications device for <strong>the</strong> purpose <strong>of</strong>activat<strong>in</strong>g or deactivat<strong>in</strong>g a voice communication or a telephone call.(b) (Reserved).(c) Seizure.--The provisions <strong>of</strong> this section shall not be construed asauthoriz<strong>in</strong>g <strong>the</strong> seizure or forfeiture <strong>of</strong> an <strong>in</strong>teractive wirelesscommunications device, unless o<strong>the</strong>rwise provided by law.(d) Penalty.--A person who violates subsection (a) commits a summary <strong>of</strong>fense<strong>and</strong> shall, upon conviction, be sentenced to pay a f<strong>in</strong>e <strong>of</strong> $50.(e) Preemption <strong>of</strong> local ord<strong>in</strong>ances.--In accordance with section 6101(relat<strong>in</strong>g to applicability <strong>and</strong> uniformity <strong>of</strong> title), this section supersedes<strong>and</strong> preempts all ord<strong>in</strong>ances <strong>of</strong> any municipality with regard to <strong>the</strong> use <strong>of</strong> an<strong>in</strong>teractive wireless communications device by <strong>the</strong> driver <strong>of</strong> a motor vehicle.(f) Def<strong>in</strong>ition.--As used <strong>in</strong> this section, <strong>the</strong> term "text-based communication"means a text message, <strong>in</strong>stant message, electronic mail or o<strong>the</strong>r writtencommunication composed or received on an <strong>in</strong>teractive wireless communicationsdevice.(Nov. 9, 2011, P.L.406, No.98, eff. 120 days)2011 Amendment. Vehicle approach<strong>in</strong>g or enter<strong>in</strong>g <strong>in</strong>tersection.(a) <strong>General</strong> rule.--When two vehicles approach or enter an <strong>in</strong>tersection fromdifferent highways at approximately <strong>the</strong> same time, <strong>the</strong> driver <strong>of</strong> <strong>the</strong> vehicleon <strong>the</strong> left shall yield <strong>the</strong> right-<strong>of</strong>-way to <strong>the</strong> vehicle on <strong>the</strong> right.(b) Exception.--The right-<strong>of</strong>-way rule established <strong>in</strong> subsection (a) is notapplicable:(1) on through highways, where <strong>the</strong> traffic on <strong>the</strong> through highway shall have<strong>the</strong> right-<strong>of</strong>-way;(2) on limited-access highways, where <strong>the</strong> traffic on <strong>the</strong> limited-accesshighway shall have <strong>the</strong> right-<strong>of</strong>-way;


(3) <strong>in</strong> traffic circles, where <strong>the</strong> traffic <strong>in</strong> <strong>the</strong> traffic circle shall have <strong>the</strong>right-<strong>of</strong>-way; <strong>and</strong>(4) as o<strong>the</strong>rwise provided <strong>in</strong> this part.(Dec. 11, 1986, P.L.1530, No.166, eff. 60 days)Cross References. Vehicle turn<strong>in</strong>g left.The driver <strong>of</strong> a vehicle <strong>in</strong>tend<strong>in</strong>g to turn left with<strong>in</strong> an <strong>in</strong>tersection or <strong>in</strong>toan alley, private road or driveway shall yield <strong>the</strong> right-<strong>of</strong>-way to anyvehicle approach<strong>in</strong>g from <strong>the</strong> opposite direction which is so close as toconstitute a hazard.Cross References. Stop signs <strong>and</strong> yield signs.(a) Intersections controlled by signs.--Preferential right-<strong>of</strong>-way at an<strong>in</strong>tersection may be <strong>in</strong>dicated by stop signs or yield signs as authorized <strong>in</strong>section 6124 (relat<strong>in</strong>g to erection <strong>of</strong> traffic-control devices at<strong>in</strong>tersections).(b) Duties at stop signs.--Except when directed to proceed by a police <strong>of</strong>ficeror appropriately attired persons authorized to direct, control or regulatetraffic, every driver <strong>of</strong> a vehicle approach<strong>in</strong>g a stop sign shall stop at aclearly marked stop l<strong>in</strong>e or, if no stop l<strong>in</strong>e is present, before enter<strong>in</strong>g acrosswalk on <strong>the</strong> near side <strong>of</strong> <strong>the</strong> <strong>in</strong>tersection or, if no crosswalk ispresent, <strong>the</strong>n at <strong>the</strong> po<strong>in</strong>t nearest <strong>the</strong> <strong>in</strong>tersect<strong>in</strong>g roadway where <strong>the</strong> driverhas a clear view <strong>of</strong> approach<strong>in</strong>g traffic on <strong>the</strong> <strong>in</strong>tersect<strong>in</strong>g roadway beforeenter<strong>in</strong>g. If, after stopp<strong>in</strong>g at a crosswalk or clearly marked stop l<strong>in</strong>e, adriver does not have a clear view <strong>of</strong> approach<strong>in</strong>g traffic, <strong>the</strong> driver shallafter yield<strong>in</strong>g <strong>the</strong> right-<strong>of</strong>-way to any pedestrian <strong>in</strong> <strong>the</strong> crosswalk slowlypull forward from <strong>the</strong> stopped position to a po<strong>in</strong>t where <strong>the</strong> driver has aclear view <strong>of</strong> approach<strong>in</strong>g traffic. The driver shall yield <strong>the</strong> right-<strong>of</strong>-way toany vehicle <strong>in</strong> <strong>the</strong> <strong>in</strong>tersection or approach<strong>in</strong>g on ano<strong>the</strong>r roadway so closelyas to constitute a hazard dur<strong>in</strong>g <strong>the</strong> time when <strong>the</strong> driver is mov<strong>in</strong>g across orwith<strong>in</strong> <strong>the</strong> <strong>in</strong>tersection or junction <strong>of</strong> roadways <strong>and</strong> enter <strong>the</strong> <strong>in</strong>tersectionwhen it is safe to do so.(c) Duties at yield signs.--The driver <strong>of</strong> a vehicle approach<strong>in</strong>g a yield signshall <strong>in</strong> obedience to <strong>the</strong> sign slow down to a speed reasonable for <strong>the</strong>exist<strong>in</strong>g conditions <strong>and</strong>, if required for safety to stop, shall stop beforeenter<strong>in</strong>g a crosswalk on <strong>the</strong> near side <strong>of</strong> <strong>the</strong> <strong>in</strong>tersection or, if none, <strong>the</strong>nat <strong>the</strong> po<strong>in</strong>t nearest <strong>the</strong> <strong>in</strong>tersect<strong>in</strong>g roadway where <strong>the</strong> driver has a view <strong>of</strong>approach<strong>in</strong>g traffic on <strong>the</strong> <strong>in</strong>tersect<strong>in</strong>g roadway before enter<strong>in</strong>g. Afterslow<strong>in</strong>g down or stopp<strong>in</strong>g, <strong>the</strong> driver shall yield <strong>the</strong> right-<strong>of</strong>-way to anyvehicle <strong>in</strong> <strong>the</strong> <strong>in</strong>tersection or approach<strong>in</strong>g on ano<strong>the</strong>r roadway so closely asto constitute a hazard dur<strong>in</strong>g <strong>the</strong> time <strong>the</strong> driver is mov<strong>in</strong>g across or with<strong>in</strong><strong>the</strong> <strong>in</strong>tersection <strong>of</strong> roadways. If a driver is <strong>in</strong>volved <strong>in</strong> a collision with avehicle <strong>in</strong> <strong>the</strong> <strong>in</strong>tersection or junction <strong>of</strong> roadways after driv<strong>in</strong>g past ayield sign, <strong>the</strong> collision shall be deemed prima facie evidence <strong>of</strong> failure <strong>of</strong><strong>the</strong> driver to yield <strong>the</strong> right-<strong>of</strong>-way.(Dec. 21, 1998, P.L.1126, No.151, eff. 60 days)1998 Amendment. Vehicle enter<strong>in</strong>g or cross<strong>in</strong>g roadway.The driver <strong>of</strong> a vehicle about to enter or cross a roadway from any placeo<strong>the</strong>r than ano<strong>the</strong>r roadway shall yield <strong>the</strong> right-<strong>of</strong>-way to all vehiclesapproach<strong>in</strong>g on <strong>the</strong> roadway to be entered or crossed.

Duty <strong>of</strong> driver on approach <strong>of</strong> emergency vehicle.(a) <strong>General</strong> rule.--Upon <strong>the</strong> immediate approach <strong>of</strong> an emergency vehicle mak<strong>in</strong>guse <strong>of</strong> an audible signal <strong>and</strong> visual signals meet<strong>in</strong>g <strong>the</strong> requirements <strong>and</strong>st<strong>and</strong>ards set forth <strong>in</strong> regulations adopted by <strong>the</strong> department, <strong>the</strong> driver <strong>of</strong>every o<strong>the</strong>r vehicle shall yield <strong>the</strong> right-<strong>of</strong>-way <strong>and</strong> shall immediately driveto a position parallel to, <strong>and</strong> as close as possible to, <strong>the</strong> right-h<strong>and</strong> edgeor curb <strong>of</strong> <strong>the</strong> roadway clear <strong>of</strong> any <strong>in</strong>tersection <strong>and</strong> shall stop <strong>and</strong> rema<strong>in</strong> <strong>in</strong>that position until <strong>the</strong> emergency vehicle has passed, except when o<strong>the</strong>rwisedirected by a police <strong>of</strong>ficer or an appropriately attired person authorized todirect, control or regulate traffic. On one-way roadways a driver may complyby driv<strong>in</strong>g to <strong>the</strong> edge or curb which is nearest to <strong>the</strong> lane <strong>in</strong> which he istravel<strong>in</strong>g.(b) Duty <strong>of</strong> operator <strong>of</strong> streetcar.--Upon <strong>the</strong> approach <strong>of</strong> an emergency vehicle,<strong>the</strong> operator <strong>of</strong> every streetcar shall immediately stop <strong>the</strong> streetcar clear <strong>of</strong>any <strong>in</strong>tersection <strong>and</strong> rema<strong>in</strong> <strong>in</strong> that position until <strong>the</strong> emergency vehicle haspassed, except when o<strong>the</strong>rwise directed by a police <strong>of</strong>ficer or anappropriately attired person authorized to direct, control or regulatetraffic.(c) Defense.--It is a defense to prosecution under this section if <strong>the</strong>defendant can show by a preponderance <strong>of</strong> <strong>the</strong> evidence that <strong>the</strong> failure tostop immediately for a police <strong>of</strong>ficer was based on a good faith concern forpersonal safety. In determ<strong>in</strong><strong>in</strong>g whe<strong>the</strong>r <strong>the</strong> defendant has met this burden,<strong>the</strong> court may consider <strong>the</strong> follow<strong>in</strong>g factors:(1) The time <strong>and</strong> location <strong>of</strong> <strong>the</strong> event.(2) The type <strong>of</strong> vehicle used by <strong>the</strong> police <strong>of</strong>ficer.(3) The defendant's conduct while be<strong>in</strong>g followed by <strong>the</strong> police <strong>of</strong>ficer.(4) Whe<strong>the</strong>r <strong>the</strong> defendant stopped at <strong>the</strong> first available reasonably lighted orpopulated area.(5) Any o<strong>the</strong>r factor considered relevant by <strong>the</strong> court.(June 26, 2001, P.L.734, No.75, eff. 60 days)Cross References. Duty <strong>of</strong> driver <strong>in</strong> construction <strong>and</strong> ma<strong>in</strong>tenance areas or on highwaysafety corridors.(a) Areas <strong>in</strong>dicated by traffic-control devices.--The driver <strong>of</strong> a vehicleshall yield <strong>the</strong> right-<strong>of</strong>-way to any authorized vehicle or pedestrian actuallyengaged <strong>in</strong> work upon a highway with<strong>in</strong> any highway or utility construction orma<strong>in</strong>tenance area <strong>in</strong>dicated by <strong>of</strong>ficial traffic-control devices placed <strong>in</strong>accordance with department regulations, <strong>in</strong>clud<strong>in</strong>g advanced warn<strong>in</strong>g signs or avehicle hav<strong>in</strong>g flash<strong>in</strong>g or revolv<strong>in</strong>g yellow lights.(b) Work vehicles display<strong>in</strong>g flash<strong>in</strong>g lights.--The driver <strong>of</strong> a vehicle shallyield <strong>the</strong> right-<strong>of</strong>-way to any authorized vehicle obviously <strong>and</strong> actuallyengaged <strong>in</strong> work upon a highway whenever <strong>the</strong> vehicle displays flash<strong>in</strong>g lightsmeet<strong>in</strong>g <strong>the</strong> requirements <strong>and</strong> regulations promulgated by <strong>the</strong> department.(c) F<strong>in</strong>es to be doubled.--For any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g violations, when committed<strong>in</strong> an active work zone manned by workers act<strong>in</strong>g <strong>in</strong> <strong>the</strong>ir <strong>of</strong>ficial capacity oron a highway safety corridor designated under section 6105.1 (relat<strong>in</strong>g todesignation <strong>of</strong> highway safety corridors), <strong>the</strong> f<strong>in</strong>e shall be double <strong>the</strong> usualamount:Section 3102 (relat<strong>in</strong>g to obedience to authorized persons direct<strong>in</strong>g traffic).Section 3111 (relat<strong>in</strong>g to obedience to traffic-control devices).Section 3112 (relat<strong>in</strong>g to traffic-control signals).Section 3114 (relat<strong>in</strong>g to flash<strong>in</strong>g signals).Section <strong>33</strong>02 (relat<strong>in</strong>g to meet<strong>in</strong>g vehicle proceed<strong>in</strong>g <strong>in</strong> opposite direction).Section <strong>33</strong>03 (relat<strong>in</strong>g to overtak<strong>in</strong>g vehicle on <strong>the</strong> left).

The light or device shall <strong>in</strong>dicate that workersare present <strong>in</strong> <strong>the</strong> active work zone. The light or device shall be turned <strong>of</strong>fif no workers are present. Duty <strong>of</strong> driver <strong>in</strong> emergency response areas.(a) <strong>General</strong> rule.--When approach<strong>in</strong>g or pass<strong>in</strong>g an emergency response area, aperson, unless o<strong>the</strong>rwise directed by an emergency service responder, shall:(1) pass <strong>in</strong> a lane not adjacent to that <strong>of</strong> <strong>the</strong> emergency response area, ifpossible; or(2) if pass<strong>in</strong>g <strong>in</strong> a nonadjacent lane is impossible, illegal or unsafe, pass<strong>the</strong> emergency response area at a careful <strong>and</strong> prudent reduced speed reasonablefor safely pass<strong>in</strong>g <strong>the</strong> emergency response area.(b) Penalty.--Any person violat<strong>in</strong>g subsection (a) commits a summary <strong>of</strong>fense<strong>and</strong> shall, upon conviction, pay a f<strong>in</strong>e <strong>of</strong> not more than $250.(b.1) Suspension <strong>of</strong> operat<strong>in</strong>g privilege.--The department shall suspend <strong>the</strong>operat<strong>in</strong>g privilege <strong>of</strong> any person for 90 days upon receiv<strong>in</strong>g a certifiedrecord <strong>of</strong> <strong>the</strong> driver's conviction, adjudication <strong>of</strong> del<strong>in</strong>quency or admission<strong>in</strong>to a preadjudication program for a violation <strong>of</strong> subsection (a), if <strong>the</strong>certified conviction <strong>in</strong>dicates <strong>the</strong> violation resulted <strong>in</strong> serious bodily<strong>in</strong>jury to ano<strong>the</strong>r person. The license shall be surrendered <strong>in</strong> accordance withsection 1540 (relat<strong>in</strong>g to surrender <strong>of</strong> license).


(c) Mark<strong>in</strong>g.--An emergency response area shall be clearly marked with roadflares, caution signs or any o<strong>the</strong>r traffic-control device which lawenforcement <strong>of</strong>ficials may have at <strong>the</strong>ir immediate disposal or visual signalson vehicles meet<strong>in</strong>g <strong>the</strong> requirements <strong>of</strong> Subchapter D <strong>of</strong> <strong>Chapter</strong> 45 (relat<strong>in</strong>gto equipment <strong>of</strong> authorized <strong>and</strong> emergency vehicles).(d) Reports by emergency service responders.--(1) An emergency service responder observ<strong>in</strong>g a violation <strong>of</strong> subsection (a)may prepare a written, signed report which <strong>in</strong>dicates that a violation hasoccurred. To <strong>the</strong> extent possible, <strong>the</strong> report shall <strong>in</strong>clude <strong>the</strong> follow<strong>in</strong>g<strong>in</strong>formation:(i) Information perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> identity <strong>of</strong> <strong>the</strong> alleged violator.(ii) The license number <strong>and</strong> color <strong>of</strong> <strong>the</strong> vehicle <strong>in</strong>volved <strong>in</strong> <strong>the</strong> violation.(iii) The time <strong>and</strong> approximate location at which <strong>the</strong> violation occurred.(iv) Identification <strong>of</strong> <strong>the</strong> vehicle as an automobile, station wagon, motortruck, motor bus, motorcycle or o<strong>the</strong>r type <strong>of</strong> vehicle.(2) With<strong>in</strong> 48 hours after <strong>the</strong> violation occurs, <strong>the</strong> emergency serviceresponder shall deliver a copy <strong>of</strong> <strong>the</strong> report to a police <strong>of</strong>ficer hav<strong>in</strong>gauthority to exercise police power <strong>in</strong> <strong>the</strong> area where <strong>the</strong> violation occurred.If <strong>the</strong> police <strong>of</strong>ficer believes that <strong>the</strong> report established a sufficient basisfor <strong>the</strong> issuance <strong>of</strong> a citation, <strong>the</strong> <strong>of</strong>ficer shall file a citation <strong>and</strong> a copy<strong>of</strong> <strong>the</strong> report with <strong>the</strong> issu<strong>in</strong>g authority. (f) Def<strong>in</strong>ition.--As used <strong>in</strong> this section, <strong>the</strong> term "emergency response area"means <strong>the</strong> area <strong>in</strong> which emergency service responders render emergencyassistance to <strong>in</strong>dividuals on or near a roadway or a police <strong>of</strong>ficer isconduct<strong>in</strong>g a traffic stop or systematic check <strong>of</strong> vehicles or controll<strong>in</strong>g ordirect<strong>in</strong>g traffic as long as <strong>the</strong> emergency vehicle is mak<strong>in</strong>g use <strong>of</strong> visualsignals meet<strong>in</strong>g <strong>the</strong> requirements <strong>of</strong> Subchapter D <strong>of</strong> <strong>Chapter</strong> 45.(June 26, 2001, P.L.734, No.75, eff. 60 days; Sept. 30, 2003, P.L.120, No.24,eff. Unmarked police vehicles.(a) <strong>General</strong> rule.--The Pennsylvania State Police, <strong>in</strong> consultation with <strong>the</strong>department, shall promulgate regulations for <strong>the</strong> use <strong>of</strong> unmarked vehicles bypolice <strong>of</strong>ficers. The regulations shall:(1) establish <strong>the</strong> procedure to be used by a police <strong>of</strong>ficer <strong>in</strong> an unmarkedvehicle when stopp<strong>in</strong>g a motorist;(2) require <strong>the</strong> use <strong>of</strong> audible <strong>and</strong> visual signals which meet <strong>the</strong> requirements<strong>and</strong> st<strong>and</strong>ards set forth <strong>in</strong> this title <strong>and</strong> <strong>in</strong> regulations adopted by <strong>the</strong>department; <strong>and</strong>(3) establish requirements for <strong>the</strong> wear<strong>in</strong>g <strong>of</strong> an <strong>of</strong>ficial police uniform <strong>and</strong><strong>the</strong> display <strong>of</strong> <strong>of</strong>ficial police identification.(b) Public awareness.--The Pennsylvania State Police <strong>and</strong> <strong>the</strong> department shallprovide for <strong>the</strong> dissem<strong>in</strong>ation <strong>of</strong> <strong>in</strong>formation to <strong>the</strong> public regard<strong>in</strong>g <strong>the</strong> use<strong>of</strong> unmarked vehicles. Required position <strong>and</strong> method <strong>of</strong> turn<strong>in</strong>g.(a) Right turn.--The driver <strong>of</strong> a vehicle <strong>in</strong>tend<strong>in</strong>g to turn right shallapproach <strong>the</strong> turn <strong>and</strong> make <strong>the</strong> turn as close as practicable to <strong>the</strong> right-h<strong>and</strong>curb or edge <strong>of</strong> <strong>the</strong> roadway.(b) Left turn.--The driver <strong>of</strong> a vehicle <strong>in</strong>tend<strong>in</strong>g to turn left shall approach<strong>the</strong> turn <strong>in</strong> <strong>the</strong> extreme left-h<strong>and</strong> lane lawfully available to traffic mov<strong>in</strong>g<strong>in</strong> <strong>the</strong> direction <strong>of</strong> travel <strong>of</strong> <strong>the</strong> vehicle. Whenever practicable, <strong>the</strong> leftturn shall be made to <strong>the</strong> left <strong>of</strong> <strong>the</strong> center <strong>of</strong> <strong>the</strong> <strong>in</strong>tersection <strong>and</strong> so as toleave <strong>the</strong> <strong>in</strong>tersection or location <strong>in</strong> <strong>the</strong> extreme left-h<strong>and</strong> lane lawfullyavailable to traffic mov<strong>in</strong>g <strong>in</strong> <strong>the</strong> same direction as <strong>the</strong> vehicle on <strong>the</strong>roadway be<strong>in</strong>g entered.


(c) Compliance with traffic-control devices.--The department <strong>and</strong> localauthorities on highways under <strong>the</strong>ir respective jurisdictions may cause<strong>of</strong>ficial traffic-control devices to be placed <strong>and</strong> <strong>the</strong>reby require <strong>and</strong> directthat a different course from that specified <strong>in</strong> this section be traveled byturn<strong>in</strong>g vehicles <strong>and</strong> when <strong>the</strong> devices are so placed no driver shall turn avehicle o<strong>the</strong>r than as directed <strong>and</strong> required by <strong>the</strong> devices.(d) Two-way left turn lanes.--Where a special lane for mak<strong>in</strong>g left turns bydrivers proceed<strong>in</strong>g <strong>in</strong> opposite directions has been <strong>in</strong>dicated by <strong>of</strong>ficialtraffic-control devices:(1) A left turn shall not be made from any o<strong>the</strong>r lane.(2) A vehicle shall not be driven <strong>in</strong> <strong>the</strong> lane except when prepar<strong>in</strong>g for ormak<strong>in</strong>g a left turn from or <strong>in</strong>to <strong>the</strong> roadway or when prepar<strong>in</strong>g for or mak<strong>in</strong>g aU-turn when o<strong>the</strong>rwise permitted by law.(e) Interference with pedalcycles.--No turn by a driver <strong>of</strong> a motor vehicleshall <strong>in</strong>terfere with a pedalcycle proceed<strong>in</strong>g straight while operat<strong>in</strong>g <strong>in</strong>accordance with <strong>Chapter</strong> 35 (relat<strong>in</strong>g to special vehicles <strong>and</strong> pedestrians).(Feb. 2, 2012, P.L.27, No.3, eff. 60 days)2012 Amendment. Limitations on turn<strong>in</strong>g around.(a) <strong>General</strong> rule.--The driver <strong>of</strong> any vehicle shall not turn <strong>the</strong> vehicle so asto proceed <strong>in</strong> <strong>the</strong> opposite direction unless <strong>the</strong> movement can be made <strong>in</strong>safety <strong>and</strong> without <strong>in</strong>terfer<strong>in</strong>g with o<strong>the</strong>r traffic.(b) Turns on curves or grades.--No vehicle shall be turned so as to proceed <strong>in</strong><strong>the</strong> opposite direction upon any curve, or upon <strong>the</strong> approach to or near <strong>the</strong>crest <strong>of</strong> a grade, where <strong>the</strong> vehicle cannot be seen by <strong>the</strong> driver <strong>of</strong> any o<strong>the</strong>rvehicle approach<strong>in</strong>g from ei<strong>the</strong>r direction with<strong>in</strong> 500 feet.Cross References. Mov<strong>in</strong>g stopped or parked vehicle.No person shall move a vehicle which is stopped, st<strong>and</strong><strong>in</strong>g or parked unless<strong>and</strong> until <strong>the</strong> movement can be made with safety.§ <strong>33</strong>34. Turn<strong>in</strong>g movements <strong>and</strong> required signals.(a) <strong>General</strong> rule.--Upon a roadway no person shall turn a vehicle or move fromone traffic lane to ano<strong>the</strong>r or enter <strong>the</strong> traffic stream from a parkedposition unless <strong>and</strong> until <strong>the</strong> movement can be made with reasonable safety norwithout giv<strong>in</strong>g an appropriate signal <strong>in</strong> <strong>the</strong> manner provided <strong>in</strong> this section.(b) Signals on turn<strong>in</strong>g <strong>and</strong> start<strong>in</strong>g.--At speeds <strong>of</strong> less than 35 miles perhour, an appropriate signal <strong>of</strong> <strong>in</strong>tention to turn right or left shall be givencont<strong>in</strong>uously dur<strong>in</strong>g not less than <strong>the</strong> last 100 feet traveled by <strong>the</strong> vehiclebefore turn<strong>in</strong>g. The signal shall be given dur<strong>in</strong>g not less than <strong>the</strong> last 300feet at speeds <strong>in</strong> excess <strong>of</strong> 35 miles per hour. The signal shall also be givenprior to entry <strong>of</strong> <strong>the</strong> vehicle <strong>in</strong>to <strong>the</strong> traffic stream from a parked position.(c) Limitations on use <strong>of</strong> certa<strong>in</strong> signals.--The signals required on vehiclesby section <strong>33</strong>35(b) (relat<strong>in</strong>g to signals by h<strong>and</strong> <strong>and</strong> arm or signal lamps)shall not be flashed on one side only on a disabled vehicle, flashed as acourtesy or "do pass" signal to operators <strong>of</strong> o<strong>the</strong>r vehicles approach<strong>in</strong>g from<strong>the</strong> rear, nor be flashed on one side only <strong>of</strong> a parked vehicle except as maybe necessary for compliance with this section.(d) Discont<strong>in</strong>u<strong>in</strong>g turn signals.--Turn signals shall be discont<strong>in</strong>uedimmediately after complet<strong>in</strong>g <strong>the</strong> turn or movement from one traffic lane toano<strong>the</strong>r traffic lane.§ <strong>33</strong>35. Signals by h<strong>and</strong> <strong>and</strong> arm or signal lamps.


(a) <strong>General</strong> rule.--Any stop or turn signal shall be given ei<strong>the</strong>r by means <strong>of</strong><strong>the</strong> h<strong>and</strong> <strong>and</strong> arm or by signal lamps, except as o<strong>the</strong>rwise provided <strong>in</strong>subsection (b).(b) Required signals by signal lamps.--Any motor vehicle <strong>in</strong> use on a highwayshall be equipped with, <strong>and</strong> required signal shall be given by, signal lampswhen <strong>the</strong> distance from <strong>the</strong> center <strong>of</strong> <strong>the</strong> top <strong>of</strong> <strong>the</strong> steer<strong>in</strong>g post to <strong>the</strong> leftoutside limit <strong>of</strong> <strong>the</strong> body, cab or load <strong>of</strong> <strong>the</strong> motor vehicle exceeds 24<strong>in</strong>ches, or when <strong>the</strong> distance from <strong>the</strong> center <strong>of</strong> <strong>the</strong> top <strong>of</strong> <strong>the</strong> steer<strong>in</strong>g postto <strong>the</strong> rear limit <strong>of</strong> <strong>the</strong> body or load exceeds 14 feet. The latter measurementshall apply to any s<strong>in</strong>gle vehicle <strong>and</strong> to any comb<strong>in</strong>ation <strong>of</strong> vehicles.(c) Exception.--This section does not apply to a motor vehicle registered asan antique or classic vehicle which was not orig<strong>in</strong>ally equipped with signallamps.Cross References. Method <strong>of</strong> giv<strong>in</strong>g h<strong>and</strong> <strong>and</strong> arm signals.All signals given by h<strong>and</strong> <strong>and</strong> arm shall be given from <strong>the</strong> left side <strong>of</strong> <strong>the</strong>vehicle <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g manner except as <strong>in</strong>dicated for pedalcycles <strong>and</strong>motorcycles <strong>and</strong> <strong>the</strong> signals shall <strong>in</strong>dicate as follows:(1) For a left turn, <strong>the</strong> h<strong>and</strong> <strong>and</strong> arm shall be extended horizontally.(2) For a right turn, <strong>the</strong> left h<strong>and</strong> <strong>and</strong> arm shall be extended upward, exceptthat operators <strong>of</strong> motorcycles <strong>and</strong> pedalcycles may also be permitted to signala right turn by extend<strong>in</strong>g <strong>the</strong> right h<strong>and</strong> <strong>and</strong> arm horizontally.(3) To stop or decrease speed, <strong>the</strong> left h<strong>and</strong> <strong>and</strong> arm shall be extendeddownward.(Dec. 15, 1995, P.L.655, No.72, eff. 60 days)SUBCHAPTER DSPECIAL STOPS REQUIREDSec.<strong>33</strong>41. Obedience to signal <strong>in</strong>dicat<strong>in</strong>g approach <strong>of</strong> tra<strong>in</strong>.(a) <strong>General</strong> rule.--Whenever any person driv<strong>in</strong>g a vehicle approaches a railroadgrade cross<strong>in</strong>g under any <strong>of</strong> <strong>the</strong> circumstances stated <strong>in</strong> this section, <strong>the</strong>driver <strong>of</strong> <strong>the</strong> vehicle shall stop with<strong>in</strong> 50 feet but not less than 15 feetfrom <strong>the</strong> nearest rail <strong>of</strong> <strong>the</strong> railroad <strong>and</strong> shall not proceed until it can bedone safely. The forego<strong>in</strong>g requirements shall apply upon <strong>the</strong> occurrence <strong>of</strong>any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g circumstances:(1) A clearly visible electric or mechanical signal device gives warn<strong>in</strong>g <strong>of</strong><strong>the</strong> immediate approach <strong>of</strong> a railroad tra<strong>in</strong>.(2) A cross<strong>in</strong>g gate is lowered or a flagman gives or cont<strong>in</strong>ues to give asignal <strong>of</strong> <strong>the</strong> approach or passage <strong>of</strong> a railroad tra<strong>in</strong>.(3) A railroad tra<strong>in</strong> approach<strong>in</strong>g with<strong>in</strong> approximately 1,500 feet <strong>of</strong> <strong>the</strong>highway cross<strong>in</strong>g emits a signal audible from that distance <strong>and</strong> <strong>the</strong> railroadtra<strong>in</strong>, by reason <strong>of</strong> its speed or nearness to <strong>the</strong> cross<strong>in</strong>g, is a hazard.(4) An approach<strong>in</strong>g railroad tra<strong>in</strong> is pla<strong>in</strong>ly visible <strong>and</strong> is <strong>in</strong> hazardousproximity to <strong>the</strong> cross<strong>in</strong>g.(b) Compliance with cross<strong>in</strong>g gate or barrier.--(1) No person shall drive any vehicle through, around or under any cross<strong>in</strong>ggate or barrier at a railroad cross<strong>in</strong>g while <strong>the</strong> gate or barrier is closed.


(2) No person shall start to drive a vehicle through, around or under a gateor barrier at <strong>the</strong> entrance to a railroad cross<strong>in</strong>g while <strong>the</strong> gate or barrieris be<strong>in</strong>g opened or closed.(c) Penalties.--A violation <strong>of</strong> subsection (a) constitutes a summary <strong>of</strong>fensepunishable by a f<strong>in</strong>e <strong>of</strong> from $50 to $200. Vehicles required to stop at railroad cross<strong>in</strong>gs.(a) <strong>General</strong> rule.--Except as provided <strong>in</strong> subsection (c), <strong>the</strong> driver <strong>of</strong> anyvehicle described <strong>in</strong> subsection (b), before cross<strong>in</strong>g at grade any track ortracks <strong>of</strong> a railroad, shall stop <strong>the</strong> vehicle with<strong>in</strong> 50 feet but not less than15 feet from <strong>the</strong> nearest rail <strong>of</strong> <strong>the</strong> railroad cross<strong>in</strong>g <strong>and</strong> while so stoppedshall listen <strong>and</strong> look <strong>in</strong> both directions along <strong>the</strong> track for any approach<strong>in</strong>gtra<strong>in</strong>, <strong>and</strong> for signals <strong>in</strong>dicat<strong>in</strong>g <strong>the</strong> approach <strong>of</strong> a tra<strong>in</strong>. When it is safe todo so, <strong>the</strong> driver <strong>of</strong> <strong>the</strong> vehicle shall drive <strong>the</strong> vehicle across <strong>the</strong> tracksonly <strong>in</strong> such gear <strong>of</strong> <strong>the</strong> vehicle that <strong>the</strong>re will be no necessity for manuallychang<strong>in</strong>g gears while travers<strong>in</strong>g <strong>the</strong> cross<strong>in</strong>g. The driver shall not manuallyshift gears while cross<strong>in</strong>g <strong>the</strong> track or tracks.(b) Vehicles subject to stopp<strong>in</strong>g requirement.--Subsection (a) shall apply to<strong>the</strong> follow<strong>in</strong>g vehicles:(1) Any vehicle designated by <strong>the</strong> department <strong>in</strong> accordance with <strong>the</strong>provisions <strong>of</strong> subsection (d).(2) A school bus, whe<strong>the</strong>r or not carry<strong>in</strong>g passengers.(3) Every truck <strong>and</strong> tractor comb<strong>in</strong>ation which carries gasol<strong>in</strong>e, diesel fuel,fuel oil, explosives or radioactive materials.(4) Every bus transport<strong>in</strong>g passengers.(5) Any vehicle specified <strong>in</strong> 49 CFR 392.10(a) (relat<strong>in</strong>g to railroad gradecross<strong>in</strong>gs; stopp<strong>in</strong>g required) or any current amendment or modification tothat section published by <strong>the</strong> United States Department <strong>of</strong> Transportation.(c) Exceptions.--Subsection (a) does not apply at any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g:(1) Any railroad grade cross<strong>in</strong>g at which traffic is controlled by a police<strong>of</strong>ficer or flagman, who <strong>in</strong>dicates that <strong>the</strong> vehicle is not required to stop.(2) Any railroad grade cross<strong>in</strong>g at which traffic is regulated by afunction<strong>in</strong>g highway traffic-control signal transmitt<strong>in</strong>g a green <strong>in</strong>dicationfor <strong>the</strong> direction <strong>of</strong> travel <strong>of</strong> <strong>the</strong> vehicle.(3) Any railroad grade cross<strong>in</strong>g at which an <strong>of</strong>ficial traffic-control devicegives notice that <strong>the</strong> stopp<strong>in</strong>g requirement imposed by this section does notapply.(4) Any ab<strong>and</strong>oned railroad grade cross<strong>in</strong>g which is marked by <strong>the</strong> former railoperator with a sign prescribed by <strong>the</strong> department <strong>in</strong>dicat<strong>in</strong>g that <strong>the</strong> raill<strong>in</strong>e is ab<strong>and</strong>oned.(5) An <strong>in</strong>dustrial or spur l<strong>in</strong>e railroad grade cross<strong>in</strong>g marked with a signread<strong>in</strong>g "exempt." Such a sign shall be erected only by or with <strong>the</strong> consent <strong>of</strong><strong>the</strong> Pennsylvania Public Utility Commission.(d) Notice <strong>of</strong> vehicles subject to section.--The department shall publish <strong>in</strong><strong>the</strong> Pennsylvania Bullet<strong>in</strong> a notice describ<strong>in</strong>g <strong>the</strong> vehicles which must complywith <strong>the</strong> stopp<strong>in</strong>g requirements <strong>of</strong> subsection (a). In develop<strong>in</strong>g <strong>the</strong> list <strong>of</strong>vehicles, <strong>the</strong> department shall give consideration to <strong>the</strong> hazardous nature <strong>of</strong>any substance carried by <strong>the</strong> vehicle as determ<strong>in</strong>ed by <strong>the</strong> department <strong>and</strong> to<strong>the</strong> number <strong>of</strong> passengers carried by <strong>the</strong> vehicle <strong>in</strong> determ<strong>in</strong><strong>in</strong>g whe<strong>the</strong>r <strong>the</strong>vehicle shall be required to stop. This list <strong>of</strong> vehicles shall correlate with<strong>and</strong> so far as possible conform to <strong>the</strong> regulations <strong>of</strong> <strong>the</strong> United StatesDepartment <strong>of</strong> Transportation as amended from time to time.


(e) Use <strong>of</strong> vehicle hazard lights.--The driver <strong>of</strong> any vehicle mentioned <strong>in</strong>subsection (b)(2) <strong>and</strong> (3) shall activate <strong>the</strong> vehicle hazard lights whenstopp<strong>in</strong>g at <strong>the</strong> railroad cross<strong>in</strong>g.(f) Penalty.--A violation <strong>of</strong> this section constitutes a summary <strong>of</strong>fensepunishable by a f<strong>in</strong>e <strong>of</strong> from $100 to $150, except that a violation <strong>of</strong>subsection (b) or (e) shall be punishable by a f<strong>in</strong>e <strong>of</strong> from $200 to $500.(g) Requirement upon approach<strong>in</strong>g tracks.--Upon approach<strong>in</strong>g any track <strong>of</strong> arailroad, <strong>the</strong> driver <strong>of</strong> every commercial motor vehicle as def<strong>in</strong>ed by section1603 (relat<strong>in</strong>g to def<strong>in</strong>itions) o<strong>the</strong>r than those listed <strong>in</strong> subsection (b)shall:(1) reduce <strong>the</strong> rate <strong>of</strong> speed <strong>of</strong> <strong>the</strong> commercial motor vehicle <strong>and</strong> check that<strong>the</strong> tracks are free <strong>of</strong> approach<strong>in</strong>g tra<strong>in</strong>s; <strong>and</strong>(2) stop <strong>the</strong> vehicle if <strong>the</strong> tracks are not clear.(h) Railroad grade cross<strong>in</strong>g.--No commercial motor vehicle may proceed onto arailroad grade cross<strong>in</strong>g unless:(1) <strong>the</strong>re is sufficient space to drive completely through <strong>the</strong> cross<strong>in</strong>gwithout stopp<strong>in</strong>g; <strong>and</strong>(2) <strong>the</strong> vehicle has sufficient undercarriage clearance to allow <strong>the</strong> vehicleto drive completely through <strong>the</strong> railroad grade cross<strong>in</strong>g without stopp<strong>in</strong>g.(i) Traffic control.--No driver <strong>of</strong> a commercial motor vehicle may fail toobey a traffic control device or direction <strong>of</strong> an enforcement <strong>of</strong>ficer at arailroad grade cross<strong>in</strong>g.(July 9, 1986, P.L.544, No.96, eff. 60 days; Dec. 11, 1986, P.L.1530, No.166,eff. 60 days; Dec. 10, 1996, P.L.925, No.149, eff. 60 days; Dec. 21, 1998,P.L.1126, No.151, eff. 60 days; July 5, 2005, P.L.100, No.37; Oct. 24, 2012,P.L.1473, No.187, eff. 60 days)2012 Amendment. Mov<strong>in</strong>g heavy equipment at railroad grade cross<strong>in</strong>gs.(a) <strong>General</strong> rule.--No person shall operate or move any crawler-type tractor,power shovel, derrick, roller or any equipment or structure hav<strong>in</strong>g a normaloperat<strong>in</strong>g speed <strong>of</strong> ten or less miles per hour or a vertical body or loadclearance <strong>of</strong> less than one-half <strong>in</strong>ch per foot <strong>of</strong> <strong>the</strong> distance between any twoadjacent axles or <strong>in</strong> any event <strong>of</strong> less than n<strong>in</strong>e <strong>in</strong>ches measured above <strong>the</strong>level surface <strong>of</strong> a roadway, upon or across any tracks at a railroad gradecross<strong>in</strong>g without first comply<strong>in</strong>g with this section.(b) Notice <strong>of</strong> <strong>in</strong>tended cross<strong>in</strong>g.--Notice <strong>of</strong> any <strong>in</strong>tended cross<strong>in</strong>g shall begiven to an authorized representative <strong>of</strong> <strong>the</strong> railroad <strong>and</strong> a reasonable timebe given to <strong>the</strong> railroad to provide proper protection at <strong>the</strong> cross<strong>in</strong>g.(c) Stopp<strong>in</strong>g at cross<strong>in</strong>g.--Before mak<strong>in</strong>g any cross<strong>in</strong>g, <strong>the</strong> person operat<strong>in</strong>g ormov<strong>in</strong>g <strong>the</strong> vehicle or equipment shall first stop <strong>the</strong> vehicle or equipment notless than 15 feet nor more than 50 feet from <strong>the</strong> nearest rail <strong>of</strong> <strong>the</strong> railroad<strong>and</strong> while so stopped shall listen <strong>and</strong> look <strong>in</strong> both directions along <strong>the</strong> trackfor any approach<strong>in</strong>g tra<strong>in</strong> <strong>and</strong> for signals <strong>in</strong>dicat<strong>in</strong>g <strong>the</strong> approach <strong>of</strong> a tra<strong>in</strong>,<strong>and</strong> shall not proceed until <strong>the</strong> cross<strong>in</strong>g can be made safely.(d) Movement over cross<strong>in</strong>g.--No cross<strong>in</strong>g shall be made when warn<strong>in</strong>g is givenby automatic signal or cross<strong>in</strong>g gates or a flagman or o<strong>the</strong>rwise <strong>of</strong> <strong>the</strong>immediate approach <strong>of</strong> a railroad tra<strong>in</strong> or car. Movement over a cross<strong>in</strong>g shallbe under <strong>the</strong> direction <strong>of</strong> any flagman provided by <strong>the</strong> railroad.Cross References. Emerg<strong>in</strong>g from alley, driveway or build<strong>in</strong>g.Unless o<strong>the</strong>rwise directed by <strong>of</strong>ficial traffic-control devices erected <strong>in</strong>accordance with provisions <strong>of</strong> Subchapter B <strong>of</strong> <strong>Chapter</strong> 31 (relat<strong>in</strong>g totraffic-control devices), <strong>the</strong> driver <strong>of</strong> a vehicle emerg<strong>in</strong>g from an alley,


children <strong>and</strong> shall rema<strong>in</strong> <strong>in</strong> operation until <strong>the</strong> red visual signals areactuated. Amber signals shall not be used unless <strong>the</strong> red visual signals areto be actuated immediately follow<strong>in</strong>g.(e) Limitations on use <strong>of</strong> signals.--The visual signals required <strong>in</strong> <strong>the</strong>regulations shall not be actuated on streets <strong>in</strong> urban districts designated by<strong>the</strong> department or local authorities, at <strong>in</strong>tersections or o<strong>the</strong>r places wheretraffic is controlled by uniformed police <strong>of</strong>ficers or appropriately attiredpersons authorized to direct, control or regulate traffic, or <strong>in</strong> school busload<strong>in</strong>g areas designated by <strong>the</strong> department or local authorities when <strong>the</strong> busis entirely <strong>of</strong>f <strong>the</strong> roadway.(f) Operation for nonschool purposes.--When a school bus is be<strong>in</strong>g operatedupon a highway for purposes o<strong>the</strong>r than <strong>the</strong> actual transportation <strong>of</strong> schoolchildren to or from school or <strong>in</strong> connection with school activities, allmark<strong>in</strong>gs <strong>in</strong>dicat<strong>in</strong>g "SCHOOL BUS" shall be covered or concealed. Dur<strong>in</strong>g suchoperation, <strong>the</strong> flash<strong>in</strong>g visual signals shall not be actuated.(f.1) Use <strong>of</strong> school buses for transportation <strong>of</strong> disabled persons.--Whenever aschool bus is be<strong>in</strong>g used upon a highway or trafficway for <strong>the</strong> transportation<strong>of</strong> disabled persons exclusively <strong>and</strong> <strong>the</strong> school bus is equipped with redsignal lights, <strong>the</strong> driver <strong>of</strong> <strong>the</strong> school bus may actuate <strong>the</strong> signal lights <strong>in</strong><strong>the</strong> same manner as set forth <strong>in</strong> this section regard<strong>in</strong>g <strong>the</strong> transportation <strong>of</strong>school children. The driver <strong>of</strong> a vehicle approach<strong>in</strong>g <strong>the</strong> school bus shallhave <strong>the</strong> same duties regard<strong>in</strong>g stopp<strong>in</strong>g, pass<strong>in</strong>g <strong>and</strong> overtak<strong>in</strong>g as he doeswith respect to a school bus carry<strong>in</strong>g school children.(g) Exceptions from stopp<strong>in</strong>g requirements.--The driver <strong>of</strong> a vehicle upon ahighway or trafficway with separate roadways need not stop upon meet<strong>in</strong>g orpass<strong>in</strong>g a school bus with actuated red signal lights which is on a differentroadway.(h) Load<strong>in</strong>g zones for school children.--Every school district transport<strong>in</strong>gschool children by school bus shall establish <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> school bus load<strong>in</strong>gzones at or near all schools to or from which school children are transported<strong>and</strong> shall establish school bus load<strong>in</strong>g zones along <strong>the</strong> highways <strong>and</strong>trafficways traversed by school buses <strong>in</strong> accordance with regulationspromulgated by <strong>the</strong> department.(i) M<strong>and</strong>atory use <strong>of</strong> load<strong>in</strong>g zones.--Whenever school bus load<strong>in</strong>g zones havebeen established at or near a school or along a highway or trafficway, it isunlawful for a school bus operator to stop <strong>the</strong> bus to pick up or dischargeschool children at any location o<strong>the</strong>r than at <strong>the</strong> load<strong>in</strong>g zones. In <strong>the</strong> event it is necessary to stop, park or st<strong>and</strong> <strong>the</strong> vehicle on<strong>the</strong> roadway or any part <strong>of</strong> <strong>the</strong> roadway, an unobstructed width <strong>of</strong> <strong>the</strong> highwayopposite <strong>the</strong> vehicle shall be left for <strong>the</strong> free passage <strong>of</strong> o<strong>the</strong>r vehicles <strong>and</strong><strong>the</strong> vehicle shall be visible from a distance <strong>of</strong> 500 feet <strong>in</strong> each directionupon <strong>the</strong> highway.(b) Exception for disabled vehicles.--This section <strong>and</strong> sections <strong>33</strong>53 (relat<strong>in</strong>gto prohibitions <strong>in</strong> specified places) <strong>and</strong> <strong>33</strong>54 (relat<strong>in</strong>g to additional park<strong>in</strong>gregulations) do not apply to <strong>the</strong> driver <strong>of</strong> any vehicle which is disabled <strong>in</strong>such a manner <strong>and</strong> to such an extent that it is impossible to avoid stopp<strong>in</strong>g<strong>and</strong> temporarily leav<strong>in</strong>g <strong>the</strong> vehicle <strong>in</strong> that position.Cross References. Removal <strong>of</strong> vehicle by or at direction <strong>of</strong> police.(a) Outside bus<strong>in</strong>ess <strong>and</strong> residence districts.--Whenever any police <strong>of</strong>ficerf<strong>in</strong>ds a vehicle <strong>in</strong> violation <strong>of</strong> any <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> section <strong>33</strong>51(relat<strong>in</strong>g to stopp<strong>in</strong>g, st<strong>and</strong><strong>in</strong>g <strong>and</strong> park<strong>in</strong>g outside bus<strong>in</strong>ess <strong>and</strong> residencedistricts), <strong>the</strong> <strong>of</strong>ficer may move <strong>the</strong> vehicle, or cause <strong>the</strong> vehicle to bemoved, or require <strong>the</strong> driver or o<strong>the</strong>r person <strong>in</strong> charge <strong>of</strong> <strong>the</strong> vehicle to move<strong>the</strong> vehicle, to a position <strong>of</strong>f <strong>the</strong> roadway where <strong>the</strong> vehicle will not<strong>in</strong>terfere unduly with <strong>the</strong> normal movement <strong>of</strong> traffic or constitute a safetyhazard.(b) Unattended vehicle obstruct<strong>in</strong>g traffic.--Any police <strong>of</strong>ficer may remove orcause to be removed to a place <strong>of</strong> safety any unattended vehicle illegallyleft st<strong>and</strong><strong>in</strong>g upon any highway, bridge, causeway or <strong>in</strong> any tunnel, <strong>in</strong> suchposition or under such circumstances as to <strong>in</strong>terfere unduly with <strong>the</strong> normalmovement <strong>of</strong> traffic or constitute a safety hazard.(c) Removal to garage or place <strong>of</strong> safety.--Any police <strong>of</strong>ficer may remove orcause to be removed to <strong>the</strong> place <strong>of</strong> bus<strong>in</strong>ess <strong>of</strong> <strong>the</strong> operator <strong>of</strong> a wrecker orto a nearby garage or o<strong>the</strong>r place <strong>of</strong> safety any vehicle found upon a highwayunder any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g circumstances:(1) Report has been made that <strong>the</strong> vehicle has been stolen or taken without<strong>the</strong> consent <strong>of</strong> its owner.(2) The person or persons <strong>in</strong> charge <strong>of</strong> <strong>the</strong> vehicle are physically unable toprovide for <strong>the</strong> custody or removal <strong>of</strong> <strong>the</strong> vehicle.(3) The person driv<strong>in</strong>g or <strong>in</strong> control <strong>of</strong> <strong>the</strong> vehicle is arrested for analleged <strong>of</strong>fense for which <strong>the</strong> <strong>of</strong>ficer is required by law to take <strong>the</strong> personarrested before an issu<strong>in</strong>g authority without unnecessary delay.


(4) The vehicle is <strong>in</strong> violation <strong>of</strong> section <strong>33</strong>53 (relat<strong>in</strong>g to prohibitions <strong>in</strong>specified places) except for overtime park<strong>in</strong>g.(5) The vehicle has been ab<strong>and</strong>oned as def<strong>in</strong>ed <strong>in</strong> this title. The <strong>of</strong>ficershall comply with <strong>the</strong> provisions <strong>of</strong> <strong>Chapter</strong> 73 (relat<strong>in</strong>g to ab<strong>and</strong>onedvehicles <strong>and</strong> cargos).(d) Notice to owner prior to removal.--(1) Prior to removal <strong>of</strong> an ab<strong>and</strong>oned vehicle bear<strong>in</strong>g a registration plate,current certificate <strong>of</strong> <strong>in</strong>spection or vehicle identification number plate bywhich <strong>the</strong> last registered owner <strong>of</strong> <strong>the</strong> vehicle can be determ<strong>in</strong>ed, <strong>the</strong> policedepartment shall send a notice by certified mail to <strong>the</strong> last registered owner<strong>of</strong> <strong>the</strong> vehicle <strong>in</strong>form<strong>in</strong>g <strong>the</strong> owner that unless <strong>the</strong> vehicle is moved to asuitable location with<strong>in</strong> seven days <strong>of</strong> <strong>the</strong> date notice is mailed, <strong>the</strong> vehiclewill be removed under this section <strong>and</strong> held at a suitable facility where itmay be reclaimed by <strong>the</strong> owner <strong>in</strong> accordance with <strong>the</strong> provisions <strong>of</strong> section7306 (relat<strong>in</strong>g to payment <strong>of</strong> costs upon reclaim<strong>in</strong>g vehicle). If <strong>the</strong> ab<strong>and</strong>onedmotor vehicle does not bear an identifiable registration plate, currentcertificate <strong>of</strong> <strong>in</strong>spection or vehicle identification number plate, <strong>the</strong> noticemay be secured to <strong>the</strong> vehicle.(2) If, with<strong>in</strong> <strong>the</strong> seven-day period, <strong>the</strong> owner so requests, <strong>the</strong> owner shallbe given an opportunity to expla<strong>in</strong> to <strong>the</strong> police <strong>of</strong>ficer or department why<strong>the</strong> owner believes <strong>the</strong> vehicle should not be removed. If <strong>the</strong> police <strong>of</strong>ficeror department determ<strong>in</strong>es that <strong>the</strong> vehicle shall, none<strong>the</strong>less, be removed, <strong>the</strong>owner shall be given an additional 48 hours to remove <strong>the</strong> vehicle, have itremoved or dem<strong>and</strong> a hear<strong>in</strong>g, which shall conform to <strong>the</strong> requirements <strong>of</strong> 2Pa.C.S. Ch. 5 Subch. B (relat<strong>in</strong>g to practice <strong>and</strong> procedure <strong>of</strong> localagencies). The police <strong>of</strong>ficer or department shall <strong>in</strong>form <strong>the</strong> owner <strong>of</strong> <strong>the</strong>right to a hear<strong>in</strong>g by deliver<strong>in</strong>g to <strong>the</strong> owner a notice warn<strong>in</strong>g <strong>the</strong> ownerthat, unless <strong>the</strong> vehicle is removed or a hear<strong>in</strong>g is dem<strong>and</strong>ed, <strong>the</strong> owner shallbe subject to <strong>the</strong> provisions <strong>of</strong> section 7306. If, as a result <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g,it is determ<strong>in</strong>ed that <strong>the</strong> vehicle will be removed, <strong>the</strong> owner shall be givenan additional 48 hours to remove <strong>the</strong> vehicle or have it removed. The hear<strong>in</strong>gshall be before a civilian <strong>of</strong>ficer or employee <strong>of</strong> <strong>the</strong> municipality <strong>in</strong> which<strong>the</strong> vehicle is located.(3) The provision for notice set forth <strong>in</strong> this subsection is applicable onlyif <strong>the</strong> vehicle is ab<strong>and</strong>oned upon a highway <strong>and</strong> is not <strong>in</strong> violation <strong>of</strong>subsection (b) or section <strong>33</strong>51(a) or <strong>33</strong>53. Prohibitions <strong>in</strong> specified places.(a) <strong>General</strong> rule.--Except when necessary to avoid conflict with o<strong>the</strong>r trafficor to protect <strong>the</strong> safety <strong>of</strong> any person or vehicle or <strong>in</strong> compliance with lawor <strong>the</strong> directions <strong>of</strong> a police <strong>of</strong>ficer or <strong>of</strong>ficial traffic-control device, noperson shall:(1) Stop, st<strong>and</strong> or park a vehicle:(i) On <strong>the</strong> roadway side <strong>of</strong> any vehicle stopped or parked at <strong>the</strong> edge or curb<strong>of</strong> a street except that:(A) A pedalcycle may be parked as provided <strong>in</strong> section 3509(b)(2) (relat<strong>in</strong>g topark<strong>in</strong>g).(B) St<strong>and</strong><strong>in</strong>g or park<strong>in</strong>g for <strong>the</strong> purpose <strong>of</strong> load<strong>in</strong>g or unload<strong>in</strong>g persons orproperty may be authorized by local ord<strong>in</strong>ance, but <strong>the</strong> ord<strong>in</strong>ance shall notauthorize st<strong>and</strong><strong>in</strong>g or park<strong>in</strong>g on State designated highways except dur<strong>in</strong>g <strong>of</strong>fpeaktraffic-flow hours as determ<strong>in</strong>ed by department regulations.


<strong>the</strong> vehicle at <strong>the</strong> reasonable expense <strong>of</strong> <strong>the</strong> owner <strong>of</strong> <strong>the</strong> vehicle. Suchperson who removes or has removed a vehicle left parked or unattended <strong>in</strong>violation <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> subsection (b) shall have a lien aga<strong>in</strong>st <strong>the</strong>owner <strong>of</strong> <strong>the</strong> vehicle, <strong>in</strong> <strong>the</strong> amount <strong>of</strong> <strong>the</strong> reasonable value <strong>of</strong> <strong>the</strong> costs <strong>of</strong>remov<strong>in</strong>g <strong>the</strong> vehicle plus <strong>the</strong> costs <strong>of</strong> storage. Any city, borough,<strong>in</strong>corporated town or township may, by ord<strong>in</strong>ance, provide for rates to becharged for removal <strong>of</strong> vehicles <strong>and</strong> for municipal regulation <strong>of</strong> authorizedtow<strong>in</strong>g services. If storage charges are not set by <strong>the</strong> municipality, amaximum <strong>of</strong> $25 per day may be charged for storage.(d) Restrictions by appropriate authorities.--The department on Statedesignatedhighways <strong>and</strong> local authorities on any highway with<strong>in</strong> <strong>the</strong>irboundaries may by erection <strong>of</strong> <strong>of</strong>ficial traffic-control devices prohibit,limit or restrict stopp<strong>in</strong>g, st<strong>and</strong><strong>in</strong>g or park<strong>in</strong>g <strong>of</strong> vehicles on any highwaywhere eng<strong>in</strong>eer<strong>in</strong>g <strong>and</strong> traffic studies <strong>in</strong>dicate that stopp<strong>in</strong>g, st<strong>and</strong><strong>in</strong>g orpark<strong>in</strong>g would constitute a safety hazard or where <strong>the</strong> stopp<strong>in</strong>g, st<strong>and</strong><strong>in</strong>g orpark<strong>in</strong>g <strong>of</strong> vehicles would unduly <strong>in</strong>terfere with <strong>the</strong> free movement <strong>of</strong> traffic.(e) Penalty.--Any person violat<strong>in</strong>g any provision <strong>of</strong> this section is guilty <strong>of</strong>a summary <strong>of</strong>fense <strong>and</strong> shall, upon conviction, be sentenced to pay a f<strong>in</strong>e <strong>of</strong>not more than $50.(Nov. 9, 1977, P.L.226, No.69, eff. imd.; Nov. 10, 1979, P.L.460, No.95,eff. imd.; Oct. 10, 1980, P.L.791, No.147, eff. imd.; Dec. 9, 2002, P.L.1278,No.152, eff. 60 days; July 2, 2004, P.L.497, No.58, eff. imd.)2004 Amendment. Additional park<strong>in</strong>g regulations.(a) Two-way highways.--Except as o<strong>the</strong>rwise provided <strong>in</strong> this section, everyvehicle st<strong>and</strong><strong>in</strong>g or parked upon a two-way highway shall be positionedparallel to <strong>and</strong> with <strong>the</strong> right-h<strong>and</strong> wheels with<strong>in</strong> 12 <strong>in</strong>ches <strong>of</strong> <strong>the</strong> right-h<strong>and</strong>curb or, <strong>in</strong> <strong>the</strong> absence <strong>of</strong> a curb, as close as practicable to <strong>the</strong> right edge<strong>of</strong> <strong>the</strong> right-h<strong>and</strong> shoulder.(b) One-way highways.--Except as o<strong>the</strong>rwise provided <strong>in</strong> this section, everyvehicle st<strong>and</strong><strong>in</strong>g or parked upon a one-way highway shall be positionedparallel to <strong>the</strong> curb or edge <strong>of</strong> <strong>the</strong> highway <strong>in</strong> <strong>the</strong> direction <strong>of</strong> authorizedtraffic movement with its right-h<strong>and</strong> wheels with<strong>in</strong> 12 <strong>in</strong>ches <strong>of</strong> <strong>the</strong> righth<strong>and</strong>curb or, <strong>in</strong> <strong>the</strong> absence <strong>of</strong> a curb, as close as practicable to <strong>the</strong> rightedge <strong>of</strong> <strong>the</strong> right-h<strong>and</strong> shoulder, or with its left-h<strong>and</strong> wheels with<strong>in</strong> 12<strong>in</strong>ches <strong>of</strong> <strong>the</strong> left-h<strong>and</strong> curb or, <strong>in</strong> <strong>the</strong> absence <strong>of</strong> a curb, as close aspracticable to <strong>the</strong> left edge <strong>of</strong> <strong>the</strong> left-h<strong>and</strong> shoulder.(c) Angle park<strong>in</strong>g.--Local authorities may permit angle park<strong>in</strong>g on any highwayafter an eng<strong>in</strong>eer<strong>in</strong>g <strong>and</strong> traffic study has determ<strong>in</strong>ed that <strong>the</strong> highway is <strong>of</strong>sufficient width to permit angle park<strong>in</strong>g without <strong>in</strong>terfer<strong>in</strong>g with <strong>the</strong> freemovement <strong>of</strong> traffic, except that on a State-designated highway prior approval<strong>of</strong> <strong>the</strong> department shall also be obta<strong>in</strong>ed.(d) Person with a disability <strong>and</strong> disabled veterans.--(1) When a motor vehicle bear<strong>in</strong>g a person with a disability or severelydisabled veteran plate or display<strong>in</strong>g a person with a disability or severelydisabled veteran park<strong>in</strong>g placard as prescribed <strong>in</strong> this title is be<strong>in</strong>goperated by or for <strong>the</strong> transportation <strong>of</strong> <strong>the</strong> person with a disability orseverely disabled veteran, <strong>the</strong> driver shall be relieved <strong>of</strong> any liability forpark<strong>in</strong>g for a period <strong>of</strong> 60 m<strong>in</strong>utes <strong>in</strong> excess <strong>of</strong> <strong>the</strong> legal park<strong>in</strong>g periodpermitted by local authorities except where local ord<strong>in</strong>ances or policeregulations provide for <strong>the</strong> accommodation <strong>of</strong> heavy traffic dur<strong>in</strong>g morn<strong>in</strong>g,afternoon or even<strong>in</strong>g hours.


(2) At <strong>the</strong> request <strong>of</strong> a person with a disability or severely disabledveteran, local authorities may erect on <strong>the</strong> highway as close as possible to<strong>the</strong> person's or veteran's place <strong>of</strong> residence a sign or signs <strong>in</strong>dicat<strong>in</strong>g thatthat place is reserved for a person with a disability or severely disabledveteran, that no park<strong>in</strong>g is allowed <strong>the</strong>re by o<strong>the</strong>rs, <strong>and</strong> that anyunauthorized person park<strong>in</strong>g <strong>the</strong>re shall be subject to a f<strong>in</strong>e <strong>and</strong> may betowed. The absence <strong>of</strong> a sign stat<strong>in</strong>g <strong>the</strong> penalty amount <strong>in</strong>dicated <strong>in</strong>subsection (f) at park<strong>in</strong>g spaces designated with an <strong>in</strong>ternational symbol foraccess for persons with disabilities on a sign shall not preclude <strong>the</strong>enforcement <strong>of</strong> this subsection. A vehicle may only be towed under thisparagraph if <strong>the</strong> park<strong>in</strong>g space is posted with a sign <strong>in</strong>dicat<strong>in</strong>g that vehicles<strong>in</strong> violation <strong>of</strong> this section may be towed.(3) (i) Except for persons park<strong>in</strong>g vehicles lawfully bear<strong>in</strong>g a person with adisability or severely disabled veteran registration plate or display<strong>in</strong>g aperson with a disability or severely disabled veteran park<strong>in</strong>g placard whensuch vehicles are be<strong>in</strong>g operated by or for <strong>the</strong> transportation <strong>of</strong> a personwith a disability or a severely disabled veteran, no person shall park avehicle on public or private property reserved for a person with a disabilityor severely disabled veteran which property has been so posted <strong>in</strong> accordancewith departmental regulations. Regulations shall require that park<strong>in</strong>g spacesdesignated with an <strong>in</strong>ternational symbol for access for persons withdisabilities on a sign are posted with a sign stat<strong>in</strong>g <strong>the</strong> penalty amount<strong>in</strong>dicated <strong>in</strong> subsection (f) <strong>and</strong> that vehicles <strong>in</strong> violation <strong>of</strong> <strong>the</strong> subsectionmay be towed <strong>and</strong> require that signs be replaced when <strong>the</strong>y become ei<strong>the</strong>robsolete or miss<strong>in</strong>g with all costs to replace <strong>the</strong> necessary signs to be borneby <strong>the</strong> persons responsible for sign<strong>in</strong>g <strong>the</strong> particular location. The absence<strong>of</strong> a sign stat<strong>in</strong>g <strong>the</strong> penalty amount at park<strong>in</strong>g spaces designated with an<strong>in</strong>ternational symbol for access for persons with disabilities shall notpreclude <strong>the</strong> enforcement <strong>of</strong> this subsection. A vehicle which is unlawfullyparked <strong>in</strong> a designated person with a disability park<strong>in</strong>g area may be removedfrom that area by tow<strong>in</strong>g <strong>and</strong> may be reclaimed by <strong>the</strong> vehicle owner uponpayment <strong>of</strong> <strong>the</strong> tow<strong>in</strong>g costs. A vehicle may only be towed under this paragraphif <strong>the</strong> park<strong>in</strong>g space is posted with a sign <strong>in</strong>dicat<strong>in</strong>g that vehicles <strong>in</strong>violation <strong>of</strong> this section may be towed.(ii) Local authorities shall have <strong>the</strong> power <strong>and</strong> may, by ord<strong>in</strong>ance orresolution, authorize a person with a disability <strong>and</strong> severely disabledveterans to issue statements to violators or violat<strong>in</strong>g vehicles for violation<strong>of</strong> subparagraph (i). The form <strong>of</strong> <strong>the</strong> statement shall be as prescribed by <strong>the</strong>local authorities.(iii) No occupancy or driveway permit may be issued to a person whoseproperty is reserved for a person with a disability or a severely disabledveteran if <strong>the</strong> property is not posted with a sign stat<strong>in</strong>g <strong>the</strong> penalty amount<strong>in</strong>dicated <strong>in</strong> subsection (f).(e) Unauthorized use.--An operator <strong>of</strong> a vehicle bear<strong>in</strong>g a person with adisability or severely disabled veteran plate or display<strong>in</strong>g a person with adisability or severely disabled veteran park<strong>in</strong>g placard shall not make use <strong>of</strong><strong>the</strong> park<strong>in</strong>g privileges accorded to a person with a disability <strong>and</strong> severelydisabled veterans under subsection (d)(3) unless <strong>the</strong> operator is a personwith a disability or a severely disabled veteran or unless <strong>the</strong> vehicle isbe<strong>in</strong>g operated for <strong>the</strong> transportation <strong>of</strong> a person with a disability orseverely disabled veteran.(e.1) Motorcycle park<strong>in</strong>g.--Notwithst<strong>and</strong><strong>in</strong>g <strong>the</strong> provisions <strong>of</strong> section 6301(relat<strong>in</strong>g to prosecutions under local ord<strong>in</strong>ances superseded by title)regard<strong>in</strong>g park<strong>in</strong>g violations, a local ord<strong>in</strong>ance may not prohibit nor cite asa violation <strong>the</strong> parallel or angle occupancy by one or more motorcycles <strong>in</strong> anypark<strong>in</strong>g space on any highway o<strong>the</strong>rwise available for park<strong>in</strong>g for o<strong>the</strong>r<strong>in</strong>dividual vehicles, provided that <strong>the</strong> space occupied by one or moremotorcycles does not exceed <strong>the</strong> space with<strong>in</strong> which a s<strong>in</strong>gle vehicle must


park. In <strong>the</strong> <strong>in</strong>stance <strong>of</strong> a violation applicable to any s<strong>in</strong>gle vehicle, eachmotorcycle so parked shall be <strong>in</strong>dividually liable for any violation as if <strong>the</strong>motorcycle were <strong>the</strong> sole occupant <strong>of</strong> <strong>the</strong> park<strong>in</strong>g space.(f) Penalty.--A person violat<strong>in</strong>g subsection (a), (b) or (d)(1) is guilty <strong>of</strong> asummary <strong>of</strong>fense <strong>and</strong> shall, upon conviction, be sentenced to pay a f<strong>in</strong>e <strong>of</strong> notmore than $15. A person violat<strong>in</strong>g subsection (d)(2) or (3) or (e) is guilty<strong>of</strong> a summary <strong>of</strong>fense <strong>and</strong> shall, upon conviction, be sentenced to pay a f<strong>in</strong>e<strong>of</strong> not less than $50 nor more than $200. Driv<strong>in</strong>g vehicle at safe speed.No person shall drive a vehicle at a speed greater than is reasonable <strong>and</strong>prudent under <strong>the</strong> conditions <strong>and</strong> hav<strong>in</strong>g regard to <strong>the</strong> actual <strong>and</strong> potentialhazards <strong>the</strong>n exist<strong>in</strong>g, nor at a speed greater than will permit <strong>the</strong> driver tobr<strong>in</strong>g his vehicle to a stop with<strong>in</strong> <strong>the</strong> assured clear distance ahead.Consistent with <strong>the</strong> forego<strong>in</strong>g, every person shall drive at a safe <strong>and</strong>appropriate speed when approach<strong>in</strong>g <strong>and</strong> cross<strong>in</strong>g an <strong>in</strong>tersection or railroadgrade cross<strong>in</strong>g, when approach<strong>in</strong>g <strong>and</strong> go<strong>in</strong>g around a curve, when approach<strong>in</strong>g ahill crest, when travel<strong>in</strong>g upon any narrow or w<strong>in</strong>d<strong>in</strong>g roadway <strong>and</strong> when

Maximum speed limits.(a) <strong>General</strong> rule.--Except when a special hazard exists that requires lowerspeed for compliance with section <strong>33</strong>61 (relat<strong>in</strong>g to driv<strong>in</strong>g vehicle at safespeed), <strong>the</strong> limits specified <strong>in</strong> this section or established under thissubchapter shall be maximum lawful speeds <strong>and</strong> no person shall drive a vehicleat a speed <strong>in</strong> excess <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g maximum limits:(1) 35 miles per hour <strong>in</strong> any urban district.(1.1) 65 miles per hour or 70 miles per hour for all vehicles on freewayswhere <strong>the</strong> department has posted a 65-miles-per-hour or 70-miles-per-hourspeed limit.(1.2) 25 miles per hour <strong>in</strong> a residence district if <strong>the</strong> highway:(i) is not a numbered traffic route; <strong>and</strong>(ii) is functionally classified by <strong>the</strong> department as a local highway.(2) 55 miles per hour <strong>in</strong> o<strong>the</strong>r locations.(3) Any o<strong>the</strong>r maximum speed limit established under this subchapter.(b) Post<strong>in</strong>g <strong>of</strong> speed limit.--(1) No maximum speed limit established under subsection (a)(1), (1.2) or (3)shall be effective unless posted on fixed or variable <strong>of</strong>ficial trafficcontroldevices erected <strong>in</strong> accordance with regulations adopted by <strong>the</strong>department which regulations shall require post<strong>in</strong>g at <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>and</strong> end<strong>of</strong> each speed zone <strong>and</strong> at <strong>in</strong>tervals not greater than one-half mile.(2) No maximum speed limit established under subsection (a)(1.1) shall beeffective unless posted on fixed or variable <strong>of</strong>ficial traffic-control deviceserected after each <strong>in</strong>terchange on <strong>the</strong> portion <strong>of</strong> highway on which <strong>the</strong> speedlimit is <strong>in</strong> effect <strong>and</strong> wherever else <strong>the</strong> department shall determ<strong>in</strong>e.(c) Penalty.--(1) Any person violat<strong>in</strong>g this section is guilty <strong>of</strong> a summary <strong>of</strong>fense <strong>and</strong>shall, upon conviction, be sentenced to pay a f<strong>in</strong>e <strong>of</strong>:(i) $42.50 for violat<strong>in</strong>g a maximum speed limit <strong>of</strong> 65 miles per hour orhigher; or(ii) $35 for violat<strong>in</strong>g any o<strong>the</strong>r maximum speed limit.(2) Any person exceed<strong>in</strong>g <strong>the</strong> maximum speed limit by more than five miles perhour shall pay an additional f<strong>in</strong>e <strong>of</strong> $2 per mile for each mile <strong>in</strong> excess <strong>of</strong>five miles per hour over <strong>the</strong> maximum speed limit.(June 13, 1995, P.L.57, No.9, eff. 30 days; Dec. 21, 1998, P.L.1126, No.151,eff. 60 days; June 26, 2001, P.L.734, No.75, eff. 60 days; Nov. 25, 2013,P.L.974, No.89, eff. imd.; Mar. 19, 2014, P.L.361, No.23, eff. imd.)2014 Amendment. M<strong>in</strong>imum speed regulation.(a) Imped<strong>in</strong>g movement <strong>of</strong> traffic prohibited.--Except when reduced speed isnecessary for safe operation or <strong>in</strong> compliance with law, no person shall drivea motor vehicle at such a slow speed as to impede <strong>the</strong> normal <strong>and</strong> reasonablemovement <strong>of</strong> traffic.(b) Slow mov<strong>in</strong>g vehicle to drive <strong>of</strong>f roadway.--(1) Except when reduced speed is necessary for safe operation or <strong>in</strong>compliance with law, whenever any person drives a vehicle upon a roadwayhav<strong>in</strong>g width for not more than one lane <strong>of</strong> traffic <strong>in</strong> each direction at lessthan <strong>the</strong> maximum posted speed <strong>and</strong> at such a slow speed as to impede <strong>the</strong>normal <strong>and</strong> reasonable movement <strong>of</strong> traffic, <strong>the</strong> driver shall, at <strong>the</strong> firstopportunity when <strong>and</strong> where it is reasonable <strong>and</strong> safe to do so <strong>and</strong> aftergiv<strong>in</strong>g appropriate signal, drive completely <strong>of</strong>f <strong>the</strong> roadway <strong>and</strong> onto <strong>the</strong> bermor shoulder <strong>of</strong> <strong>the</strong> highway. The driver may return to <strong>the</strong> roadway after giv<strong>in</strong>gappropriate signal only when <strong>the</strong> movement can be made <strong>in</strong> safety <strong>and</strong> so as notto impede <strong>the</strong> normal <strong>and</strong> reasonable movement <strong>of</strong> traffic.(2) A pedalcycle may be operated at a safe <strong>and</strong> reasonable speed appropriatefor <strong>the</strong> pedalcycle. A pedalcycle operator shall use reasonable efforts so asnot to impede <strong>the</strong> normal <strong>and</strong> reasonable movement <strong>of</strong> traffic.(c) Establishment <strong>of</strong> m<strong>in</strong>imum speed limits.--At any o<strong>the</strong>r time when <strong>the</strong>department or local authorities under <strong>the</strong>ir respective jurisdictionsdeterm<strong>in</strong>e on <strong>the</strong> basis <strong>of</strong> an eng<strong>in</strong>eer<strong>in</strong>g <strong>and</strong> traffic <strong>in</strong>vestigation that slowspeeds on any highway or part <strong>of</strong> a highway impede <strong>the</strong> normal <strong>and</strong> reasonablemovement <strong>of</strong> traffic, <strong>the</strong> department or such local authority may determ<strong>in</strong>e <strong>and</strong>declare a m<strong>in</strong>imum speed limit below which no person shall drive a vehicleexcept when necessary for safe operation or <strong>in</strong> compliance with law. Special speed limitations.(a) Bridges <strong>and</strong> elevated structures.--(1) No person shall drive a vehicle over any bridge or o<strong>the</strong>r elevatedstructure constitut<strong>in</strong>g a part <strong>of</strong> a highway at a speed which is greater than<strong>the</strong> maximum speed which can be ma<strong>in</strong>ta<strong>in</strong>ed with safety to <strong>the</strong> bridge orstructure when <strong>the</strong> structure is posted with signs as provided <strong>in</strong> thissubsection.(2) The department <strong>and</strong> local authorities on highways under <strong>the</strong>ir respectivejurisdictions may conduct a traffic <strong>and</strong> eng<strong>in</strong>eer<strong>in</strong>g <strong>in</strong>vestigation <strong>of</strong> any


idge or o<strong>the</strong>r elevated structure constitut<strong>in</strong>g a part <strong>of</strong> a highway, <strong>and</strong> ifit shall <strong>the</strong>reupon f<strong>in</strong>d that <strong>the</strong> structure cannot safely withst<strong>and</strong> vehiclestravel<strong>in</strong>g at <strong>the</strong> speed o<strong>the</strong>rwise permissible under this title, <strong>the</strong> departmentor local authority shall determ<strong>in</strong>e <strong>and</strong> declare <strong>the</strong> maximum speed <strong>of</strong> vehicleswhich <strong>the</strong> structure can safely withst<strong>and</strong>, <strong>and</strong> shall cause or permit <strong>of</strong>ficialtraffic-control devices stat<strong>in</strong>g <strong>the</strong> maximum speed to be erected <strong>and</strong>ma<strong>in</strong>ta<strong>in</strong>ed before each end <strong>of</strong> <strong>the</strong> structure.(3) Upon <strong>the</strong> trial <strong>of</strong> any person charged with a violation <strong>of</strong> this subsection,pro<strong>of</strong> <strong>of</strong> <strong>the</strong> determ<strong>in</strong>ation <strong>of</strong> <strong>the</strong> maximum speed by <strong>the</strong> department <strong>and</strong> <strong>the</strong>existence <strong>of</strong> <strong>the</strong> signs shall constitute conclusive evidence <strong>of</strong> <strong>the</strong> maximumspeed which can be ma<strong>in</strong>ta<strong>in</strong>ed with safety to <strong>the</strong> bridge or structure.(b) School zones.--When pass<strong>in</strong>g through a school zone as def<strong>in</strong>ed <strong>and</strong>established under regulations <strong>of</strong> <strong>the</strong> department, no person shall drive avehicle at a speed greater than 15 miles per hour. An <strong>of</strong>ficial trafficcontroldevice shall <strong>in</strong>dicate <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>and</strong> end <strong>of</strong> each school zone totraffic approach<strong>in</strong>g <strong>in</strong> each direction. Establishment <strong>of</strong> a school zone,<strong>in</strong>clud<strong>in</strong>g its location <strong>and</strong> hours <strong>of</strong> operation, shall be approved by <strong>the</strong>department.(c) Hazardous grades.--The department <strong>and</strong> local authorities on highways under<strong>the</strong>ir respective jurisdictions may conduct traffic <strong>and</strong> eng<strong>in</strong>eer<strong>in</strong>g<strong>in</strong>vestigations on grades which are considered hazardous. If <strong>the</strong> grade isdeterm<strong>in</strong>ed to be hazardous, vehicles hav<strong>in</strong>g a gross weight <strong>in</strong> excess <strong>of</strong> adeterm<strong>in</strong>ed safe weight may be fur<strong>the</strong>r limited as to maximum speed <strong>and</strong> may berequired to stop before proceed<strong>in</strong>g downhill. The restrictions shall be<strong>in</strong>dicated by <strong>of</strong>ficial traffic-control devices erected <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong>edaccord<strong>in</strong>g to regulations established by <strong>the</strong> department.(c.1) Active work zones.--When pass<strong>in</strong>g through an active work zone, no personshall drive a vehicle at a speed greater than <strong>the</strong> posted limit. An <strong>of</strong>ficialtraffic-control device shall <strong>in</strong>dicate <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>and</strong> end <strong>of</strong> each activework zone to traffic approach<strong>in</strong>g <strong>in</strong> each direction.(d) Penalty.--(1) Any person violat<strong>in</strong>g any provision <strong>of</strong> this section commits a summary<strong>of</strong>fense <strong>and</strong> shall, upon conviction, be sentenced to pay:(i) Except as set forth under subparagraph (ii), a f<strong>in</strong>e <strong>of</strong> $35.(ii) For a violation <strong>of</strong> subsection (b), a f<strong>in</strong>e <strong>of</strong> not more than $500 if <strong>the</strong>person exceeds <strong>the</strong> maximum speed limit by more than 11 miles per hour.(2) Any person exceed<strong>in</strong>g a maximum speed limit established under this sectionby more than five miles per hour shall pay an additional f<strong>in</strong>e <strong>of</strong> $2 per milefor each mile <strong>in</strong> excess <strong>of</strong> five miles per hour <strong>in</strong> excess <strong>of</strong> <strong>the</strong> maximum speedlimit.(Oct. 10, 1980, P.L.791, No.147, eff. imd.; Dec. 23, 2002, P.L.1982, No.229;Dec. 8, 2004, P.L.1791, No.237, eff. 150 days)2004 Amendment. Charg<strong>in</strong>g speed violations.In every charge <strong>of</strong> violation <strong>of</strong> a speed provision <strong>in</strong> this subchapter, exceptfor a violation <strong>of</strong> section <strong>33</strong>61 (relat<strong>in</strong>g to driv<strong>in</strong>g vehicle at safe speed),<strong>the</strong> citation or compla<strong>in</strong>t shall specify <strong>the</strong> speed at which <strong>the</strong> defendant isalleged to have driven <strong>and</strong> <strong>the</strong> applicable speed limit.§ <strong>33</strong>67. Rac<strong>in</strong>g on highways.(a) Def<strong>in</strong>itions.--As used <strong>in</strong> this section <strong>the</strong> follow<strong>in</strong>g words <strong>and</strong> phrasesshall have <strong>the</strong> mean<strong>in</strong>gs given to <strong>the</strong>m <strong>in</strong> this subsection:


"Drag race." The operation <strong>of</strong> two or more vehicles from a po<strong>in</strong>t side by sideat accelerat<strong>in</strong>g speeds <strong>in</strong> a competitive attempt to outdistance each o<strong>the</strong>r, or<strong>the</strong> operation <strong>of</strong> one or more vehicles over a common selected course, from <strong>the</strong>same po<strong>in</strong>t to <strong>the</strong> same po<strong>in</strong>t, for <strong>the</strong> purpose <strong>of</strong> compar<strong>in</strong>g <strong>the</strong> relativespeeds or power <strong>of</strong> acceleration <strong>of</strong> <strong>the</strong> vehicle or vehicles with<strong>in</strong> a certa<strong>in</strong>distance or time limit."Race." The use <strong>of</strong> one or more vehicles <strong>in</strong> an attempt to outga<strong>in</strong>, outdistanceor prevent ano<strong>the</strong>r vehicle from pass<strong>in</strong>g, to arrive at a given dest<strong>in</strong>ationahead <strong>of</strong> ano<strong>the</strong>r vehicle or vehicles, or to test <strong>the</strong> physical stam<strong>in</strong>a orendurance <strong>of</strong> drivers over long distance driv<strong>in</strong>g routes.(b) <strong>General</strong> rule.--No person shall drive a vehicle on a highway <strong>in</strong> any race,speed competition or contest, drag race or acceleration contest, test <strong>of</strong>physical endurance, exhibition <strong>of</strong> speed or acceleration, or for <strong>the</strong> purpose<strong>of</strong> mak<strong>in</strong>g a speed record, <strong>and</strong> no person shall <strong>in</strong> any manner participate <strong>in</strong>any such race, competition, contest, test or exhibition.(c) Permits for special activities.--The department or local authoritieswith<strong>in</strong> <strong>the</strong>ir jurisdiction may issue permits for special activities whichwould o<strong>the</strong>rwise be prohibited by this section.(d) Penalty.--Any person violat<strong>in</strong>g this section is guilty <strong>of</strong> a summary<strong>of</strong>fense <strong>and</strong> shall, upon conviction, be sentenced to pay a f<strong>in</strong>e <strong>of</strong> $200.Cross References. Speed tim<strong>in</strong>g devices.(a) Speedometers authorized.--The rate <strong>of</strong> speed <strong>of</strong> any vehicle may be timed onany highway by a police <strong>of</strong>ficer us<strong>in</strong>g a motor vehicle equipped with aspeedometer. In ascerta<strong>in</strong><strong>in</strong>g <strong>the</strong> speed <strong>of</strong> a vehicle by <strong>the</strong> use <strong>of</strong> aspeedometer, <strong>the</strong> speed shall be timed for a distance <strong>of</strong> not less than threetenths<strong>of</strong> a mile.(b) Test<strong>in</strong>g <strong>of</strong> speedometers.--The department may appo<strong>in</strong>t stations for test<strong>in</strong>gspeedometers <strong>and</strong> may prescribe regulations as to <strong>the</strong> manner <strong>in</strong> which <strong>the</strong> testshall be made. Speedometers shall have been tested for accuracy with<strong>in</strong> aperiod <strong>of</strong> one year prior to <strong>the</strong> alleged violation <strong>and</strong> immediately upon change<strong>of</strong> tire size. A certificate from <strong>the</strong> station show<strong>in</strong>g that <strong>the</strong> test was made,<strong>the</strong> date <strong>of</strong> <strong>the</strong> test <strong>and</strong> <strong>the</strong> degree <strong>of</strong> accuracy <strong>of</strong> <strong>the</strong> speedometer shall becompetent <strong>and</strong> prima facie evidence <strong>of</strong> those facts <strong>in</strong> every proceed<strong>in</strong>g <strong>in</strong>which a violation <strong>of</strong> this title is charged.(c) Mechanical, electrical <strong>and</strong> electronic devices authorized.--(1) Except as o<strong>the</strong>rwise provided <strong>in</strong> this section, <strong>the</strong> rate <strong>of</strong> speed <strong>of</strong> anyvehicle may be timed on any highway by a police <strong>of</strong>ficer us<strong>in</strong>g a mechanical orelectrical speed tim<strong>in</strong>g device.(2) Except as o<strong>the</strong>rwise provided <strong>in</strong> paragraph (3), electronic devices such asradio-microwave devices (commonly referred to as electronic speed meters orradar) may be used only by members <strong>of</strong> <strong>the</strong> Pennsylvania State Police.(3) Electronic devices which calculate speed by measur<strong>in</strong>g elapsed time betweenmeasured road surface po<strong>in</strong>ts by us<strong>in</strong>g two sensors <strong>and</strong> devices which measure<strong>and</strong> calculate <strong>the</strong> average speed <strong>of</strong> a vehicle between any two po<strong>in</strong>ts may beused by any police <strong>of</strong>ficer.(4) No person may be convicted upon evidence obta<strong>in</strong>ed through <strong>the</strong> use <strong>of</strong>devices authorized by paragraphs (2) <strong>and</strong> (3) unless <strong>the</strong> speed recorded is sixor more miles per hour <strong>in</strong> excess <strong>of</strong> <strong>the</strong> legal speed limit. Fur<strong>the</strong>rmore, noperson may be convicted upon evidence obta<strong>in</strong>ed through <strong>the</strong> use <strong>of</strong> devicesauthorized by paragraph (3) <strong>in</strong> an area where <strong>the</strong> legal speed limit is lessthan 55 miles per hour if <strong>the</strong> speed recorded is less than ten miles per hour<strong>in</strong> excess <strong>of</strong> <strong>the</strong> legal speed limit. This paragraph shall not apply toevidence obta<strong>in</strong>ed through <strong>the</strong> use <strong>of</strong> devices authorized by paragraph (2) or(3) with<strong>in</strong> a school zone or an active work zone.


(d) Classification, approval <strong>and</strong> test<strong>in</strong>g <strong>of</strong> mechanical, electrical <strong>and</strong>electronic devices.--The department may, by regulation, classify specificdevices as be<strong>in</strong>g mechanical, electrical or electronic. All mechanical,electrical or electronic devices shall be <strong>of</strong> a type approved by <strong>the</strong>department, which shall appo<strong>in</strong>t stations for calibrat<strong>in</strong>g <strong>and</strong> test<strong>in</strong>g <strong>the</strong>devices <strong>and</strong> may prescribe regulations as to <strong>the</strong> manner <strong>in</strong> which calibrations<strong>and</strong> tests shall be made. The certification <strong>and</strong> calibration <strong>of</strong> electronicdevices under subsection (c)(3) shall also <strong>in</strong>clude <strong>the</strong> certification <strong>and</strong>calibration <strong>of</strong> all equipment, tim<strong>in</strong>g strips <strong>and</strong> o<strong>the</strong>r devices which areactually used with <strong>the</strong> particular electronic device be<strong>in</strong>g certified <strong>and</strong>calibrated. Electronic devices commonly referred to as electronic speedmeters or radar shall have been tested for accuracy with<strong>in</strong> a period <strong>of</strong> oneyear prior to <strong>the</strong> alleged violation. O<strong>the</strong>r devices shall have been tested foraccuracy with<strong>in</strong> a period <strong>of</strong> 60 days prior to <strong>the</strong> alleged violation. Acertificate from <strong>the</strong> station show<strong>in</strong>g that <strong>the</strong> calibration <strong>and</strong> test were madewith<strong>in</strong> <strong>the</strong> required period <strong>and</strong> that <strong>the</strong> device was accurate shall becompetent <strong>and</strong> prima facie evidence <strong>of</strong> those facts <strong>in</strong> every proceed<strong>in</strong>g <strong>in</strong>which a violation <strong>of</strong> this title is charged.(e) Distance requirements for use <strong>of</strong> mechanical, electrical <strong>and</strong> electronicdevices.--Mechanical, electrical or electronic devices may not be used totime <strong>the</strong> rate <strong>of</strong> speed <strong>of</strong> vehicles with<strong>in</strong> 500 feet after a speed limit sign<strong>in</strong>dicat<strong>in</strong>g a decrease <strong>of</strong> speed. This limitation on <strong>the</strong> use <strong>of</strong> speed tim<strong>in</strong>gdevices shall not apply to speed limit signs <strong>in</strong>dicat<strong>in</strong>g school zones, bridge<strong>and</strong> elevated structure speed limits, hazardous grade speed limits <strong>and</strong> workzone speed limits.(July 11, 1985, P.L.204, No.52, eff. 60 days; Mar. 27, 1986, P.L.71, No.24,eff. imd.; Dec. 23, 2002, P.L.1982, No.229, eff. 6 months; Nov. 26, 2008,P.L.1658, No.1<strong>33</strong>, eff. 60 days)2008 Amendment.
