<strong>Change</strong> <strong>of</strong> <strong>Use</strong>/Occupancy <strong>of</strong> Non‐Residential BuildingsThis document has been prepared to help individuals and firms who are pursuing a substantial change<strong>of</strong> use <strong>of</strong> a building understand tasks that need to be completed to comply with State Building Codes,State Fire Codes, Unified Development Ordinance and other local codes and ordinances. Theoccupancy <strong>of</strong> a building without compliance with the laws <strong>of</strong> the State <strong>of</strong> North Carolina, ForsythCounty and the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> is a criminal act.State Building and Fire Codes:• Plans: A design pr<strong>of</strong>essional is required to “Seal” all plans <strong>for</strong>non‐residential building plans <strong>for</strong> new construction and up‐fitswith an Appendix “B” submittal <strong>for</strong> review and approval prior tocommencement <strong>of</strong> work within the building.• New Construction and Up‐Fit Activities: The designpr<strong>of</strong>essional “Sealed” plans shall include, but not limited to, thefollowing construction trades and activities:o Building & Demolitiono Electricalo Mechanicalo Plumbingo Fire• Compliance with Regulations: <strong>Change</strong> <strong>of</strong> use shallrequire compliance with, but not limited to, the following codesand ordinances:o 101.3.1 Requirements <strong>of</strong> other state agencies,occupational license boards or commissions.o NC Building Codeo NC Accessibility Code (parking, access, restrooms,etc…)o NC Plumbing Codeo NC Mechanical Codeo NC Electrical Codeo NC Fire Prevention Codeo NC Fuel Gas Codeo NC Energy Conservation Codeo NC Existing Buildings Codeo NC Rehabilitation Codeo NC Building Code – Administrative Sec. 101.3.5Referenced standards and 101.3.6 Existing buildings.• Additions, alterations, repairs, replacement,rehabilitations or changes <strong>of</strong> occupancyshall be permitted to any existing structureor service system without requiring theexisting systems to comply with all therequirements <strong>of</strong> the current building codes.All new work shall con<strong>for</strong>m to therequirements <strong>of</strong> the technical codes <strong>for</strong> newconstruction except as modified by eitherthe existing buildings code or therehabilitation code. For any portion <strong>of</strong> anexisting building or service system thatcreates a hazard or unsafe condition, thecode en<strong>for</strong>cement <strong>of</strong>ficial shall determinethe extent to which that portion <strong>of</strong> theexisting building or service system is to beupgraded to con<strong>for</strong>m to the requirements <strong>of</strong>either the existing buildings code, therehabilitation code or the technical codes.o <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> Code <strong>of</strong> Ordinanceso Outside agency (FC Health Dept, NC Child DaycareSection, NC Dept. <strong>of</strong> Labor, CCUC, etc…) applicableapprovals required to be submitted at time <strong>of</strong> buildingpermit applicationUnified Development Ordinance:The Unified Development Ordinance contains all <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong>development related standards <strong>for</strong>, but not limited to:• Stormwater• Flood Zones• <strong>Zoning</strong>• Signage• Parking• Landscaping• BuffersInspections:After plans are approved and permits are issued, inspections are required <strong>for</strong>all regulated work. The permit holder is responsible <strong>for</strong> calling to scheduleinspections. Regulated work falls under, but not limited to, the followingpermits and regulations• Building• Electrical• Mechanical• Plumbing• Fire• <strong>Zoning</strong>• Watershed• Driveway <strong>Permit</strong>• Outside agenciesCertificate <strong>of</strong> Occupancy:After all plans have been approved and inspections completed, the permitholder is required to receive a Certificate <strong>of</strong> Occupancy. Occupancy <strong>of</strong> abuilding without approved plans and inspection approvals is a criminal act(Class 1 Misdemeanor). State Statute § 160A‐423. Certificates <strong>of</strong>Compliance.• At the conclusion <strong>of</strong> all work done under a permit, the appropriateinspector shall make a final inspection, and if he finds that thecompleted work complies with all applicable State and local laws andwith the terms <strong>of</strong> the permit, he shall issue a certificate <strong>of</strong> compliance.No new building or part there<strong>of</strong> may be occupied, and no addition orenlargement <strong>of</strong> an existing building may be occupied, and no existingbuilding that has been altered or moved may be occupied, until theinspection department has issued a certificate <strong>of</strong> compliance.
