Medical Pr<strong>of</strong>essionalsMedical pr<strong>of</strong>essionals may include physicians licensed pursuant to KRS 311.550 ornurses licensed pursuant to KRS 314.011 and o<strong>the</strong>r health care providers licensedwithin Kentucky statute. The statutes provide authority to physicians and hospitaladministrators to place a child under a 72-hour hold if necessary <strong>for</strong> protection (KRS620.040) and provides immunity from criminal or civil liability <strong>for</strong> per<strong>for</strong>ming diagnosticprocedures or taking x-rays pursuant to child abuse reports (KRS 620.050).Specific responsibilities <strong>of</strong> medical pr<strong>of</strong>essionals ______________________________relating to child sexual abuse cases include:• Provide a specialized medical evaluation to assess whe<strong>the</strong>r findings consistentwith <strong>the</strong> presentation <strong>of</strong> child sexual abuse or o<strong>the</strong>r <strong>for</strong>ms <strong>of</strong> abuse are present.The examination may include, but is not limited to use <strong>of</strong> a colposcope;• Diagnose and treat child victims <strong>of</strong> sexual abuse as indicated, specificallyincluding bodily injury, sexually transmitted diseases or o<strong>the</strong>r outcomes <strong>of</strong> <strong>the</strong>abuse;• Answer medical questions which arise during case discussions by teammembers, including explanation and interpretation <strong>of</strong> findings in <strong>the</strong> medicalreport;• Provide expert testimony <strong>for</strong> <strong>the</strong> court;• Provide screening and referral <strong>for</strong> o<strong>the</strong>r medical services;• Provide consultation regarding <strong>the</strong> significance <strong>of</strong> specific past medical data to<strong>the</strong> current investigation, including <strong>the</strong> credibility <strong>of</strong> previous medicalexaminations;• Serve as a resource to team <strong>for</strong>: current prevailing medical literature relating tochild sexual abuse; most widely accepted assessment tools or practices; bestpractices <strong>for</strong> age specific interventions;• Facilitate <strong>the</strong> development <strong>of</strong> medical resources <strong>for</strong> child sexual abuse cases in<strong>the</strong> community.Victim AdvocatesKRS 15.760 and 69.350 (relating to victim advocates hired by Commonwealth'sattorneys and county attorneys, respectively) and KRS 421.570 describe <strong>the</strong> position <strong>of</strong>victim advocate. There are statutory training requirements, duties and restrictions onactivities <strong>for</strong> victim advocates. The victim advocate assists crime victims, (as defined inKRS 421.500) with accessing rights af<strong>for</strong>ded to <strong>the</strong>m by <strong>the</strong> Crime Victim's Bill <strong>of</strong> Rights(KRS 421.500-575) and o<strong>the</strong>r applicable statutory provisions. Victim advocates areimportant, not only <strong>for</strong> <strong>the</strong> direct support and education services which <strong>the</strong>y provide tovictims and <strong>the</strong>ir families, but also because <strong>the</strong>y play a key role in linking pr<strong>of</strong>essionalsand agencies toge<strong>the</strong>r, and in increasing <strong>the</strong> accountability <strong>of</strong> <strong>the</strong> service system.Victim advocates should not duplicate services provided by o<strong>the</strong>r agencies (e.g.: DCBS18
