A Message fromthe Director GeneralAs we begin the new year of <strong>2002</strong>, on behalf of <strong>WIPO</strong> and its staff, I wish to extend our bestwishes to all. The start of a new year is a good time for reflecting on the challenges ahead.In the <strong>WIPO</strong> Millennium Declaration adopted by <strong>WIPO</strong>’s Policy Advisory Commission, theCommission members stated:“Intellectual property rights are a key and integral tool in efforts to address the fundamentalchallenge of development for all, which at the end of the twentieth century stands as themost universally important responsibility facing mankind.”One of the greatest challenges that <strong>WIPO</strong> faces today is the task of making the promise of intellectualproperty as a tool for economic development a reality.In this 21 st Century, intellectual property (IP) is a powerful driver of economic growth. When linked to thedevelopment of human capital, it results in educated, skilled and motivated individuals and becomes adynamic combination in terms of stimulating creativity and innovation, generating revenue, promotinginvestment, enhancing culture, preventing “brain drain”, and nurturing overall economic health.Despite the importance of IP to wealth creation and economic development, a gap continues to existbetween developed and developing nations in terms of IP asset ownership and use. This is not becauseof an inherent lack of creativity or innovation but mainly because of a lack of information aboutIP and its potential as a tool for economic growth. If all nations and their leaders integrate strategicintellectual property policies into their wealth creation plans, the current gap between knowledgeasset-basedpowers and others can shrink in a few decades.In developed countries there is also a lack of understanding in certain sectors of how IP promotes wealthcreation. Although some businesses effectively wield the “IP tool”, others, especially small and mediumsized enterprises (SMEs) may not have the information necessary to do so. For this reason, <strong>WIPO</strong> willcontinue the campaign it launched last year to demystify IP and make it more accessible to all.<strong>WIPO</strong> will address how IP works in practice, how it promotes investment and affects valuation, howinventions relate to research policies, how cultural industries can be supported by IP policies, howtrademarks relate to branding and licensing, how IP asset development can be incentivized, how IPassets are managed, how licensing operates to share knowledge and spread the value of IP, how IPcan be protected, and other matters of great interest to policy and business leaders.This is an important part of <strong>WIPO</strong>’s mission and will be integrated in all that we do as we moveforward into <strong>2002</strong>.<strong>WIPO</strong> will soon be publishing a book on IP and its relationship to economic development. Written fornon-experts, and based on success stories of IP drawn from many nations, it is entitled: “IntellectualProperty — A Power Tool for Economic Growth — A Road Map from the Rhetoric of UniversalCommitment to the Reality of Universal Achievement”. An abstract of the book is available on the<strong>WIPO</strong> website at www.wipo.int, via the “Message from the Director General” page.The challenges ahead for <strong>WIPO</strong> are exciting ones. The Organization’s success in meeting them willdepend upon full participation of its members, as well as civil society groups, academic institutions,businesses and citizens.

2<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong>DEVELOPMENTS INMULTILINGUALDOMAIN NAMESA symposium organized jointly bythe International TelecommunicationUnion (ITU) and <strong>WIPO</strong> in associationwith the MultilingualInternet Names Consortium (MINC)reviewed the technical, legal andpolicy issues relating to enlargementof the domain name space tosupport scripts of languages usingnon-Latin characters. Meeting inGeneva in December, symposiumparticipants – drawn from theInternet and legal communities, aswell as policy-makers and governmentrepresentatives – also discussedthe intellectual propertyimplications of such developments.Estimates indicate that by 2003two-thirds of all Internet users willbe non-English speakers; however,a significant barrier remains formany of these potential users asInternet domain names are in a restrictedset of Latin characters, mostcommonly used to write English.“Native speakers of Arabic, Chinese,Japanese, Korean, Tamil, Thaiand other languages are at a disadvantage,”said ITU Deputy Secretary-GeneralRoberto Blois. “Theglobal nature of the Internet makesinternational dialogue critical if auniversal solution to the problem isto be found.”<strong>WIPO</strong> Assistant Director GeneralFrancis Gurry further emphasizedthis point. “Equality of access to thevaluable resources provided by theInternet is an issue of critical importanceto the international community,”he said, “and is a key concernfor international intergovernmentalorganizations, such as ITUand <strong>WIPO</strong>.” Mr. Gurry noted thatwhile expansion of the domainname space means greater opportunitiesfor legitimate users, it alsoopens up new opportunities forcybersquatters. “We are keen onensuring that the expansion doesnot happen at the expense of anyone party,” he said.Problems Faced in aMultilingual SystemThe Domain Name System (DNS)serves to facilitate users’ ability tonavigate the Internet by mappingthe user-friendly domain name toits corresponding numeric InternetProtocol address. A domain nameregistration, whether in a generictop-level domain (gTLD) or a countrycode top-level domain (ccTLD),provides a global presence whichensures that the correspondingonline address is accessible onlinefrom anywhere. Some 100 millionsuch names are already stored inthe DNS, according to industry estimates.While the process of “internationalization”of the Internet’s DNS isunderway, a number of problemsneed to be overcome to ensure thatall linguistic systems are fairly representedon the Internet. The challengesare complex and go far beyondtechnical considerations.These include:wwwwwadministrative arrangements formultilingual domains,competition policy,market access,intellectual property and disputeresolution mechanisms,cultural and social issues.


3<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong>A number of commercial and privateorganizations have proposedsolutions that would enable multilingualdomain name use, but node facto or technical standards thatwould guarantee interoperabilityhave yet emerged from the InternetEngineering Task Force (IETF). Theresult is a risk of confusion in themarketplace among Internet usersand providers. As Mr. Blois noted,“We do not want to run the risk offracturing access to the Internet andas a result increasing the digital dividebetween developed and developingnations.”Key Challenge: ProtectingIntellectual PropertyThe symposium provided a forumin which a diversity of views andperspectives could be shared andfuture directions could be explored.By looking at existing challengesfaced on a daily basis by intellectualproperty holders and administratorsin protecting trademarksin our multilingual world,experts in intellectual property andInternet technology shared experiencesthat may lead to a greater understandingof the issues raised byan increasingly internationalizeddomain name space. Key amongthose issues is the critical challengefaced by enterprises in protectingtheir intellectual property in a multilingualworld, both on and offline,and the need for effective disputeresolution to resolve the domainname conflicts that inevitably arise.The joint ITU/<strong>WIPO</strong> symposiumaimed to bring about a wider understandingof the many issuesraised by the implementation ofmultilingual Internet names. “Wewelcome an orderly expansion ofthe domain name system whichmore accurately reflects the linguisticdiversity of the offline world andis done in a way that preserves therights of intellectual property owners,”said Mr. Gurry. Mr. Blois notedthat this activity is part of a broaderobjective, “the true internationalizationof the Internet.”¨


4<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong>WORK ADVANCES ONNEW GLOBAL ISSUES100,000 TH PCTAPPLICATIONFILEDTextilesfrom TunisiaThe second meeting of the <strong>WIPO</strong>Intergovernmental Committee onIntellectual Property and GeneticResources, Traditional Knowledgeand Folklore (IGC), held in Genevafrom December 10 to 14, approvedfurther work within <strong>WIPO</strong> on theintellectual property aspects of thedocumentation of public domaintraditional knowledge and its inclusionin the patent examination processas part of searchable prior art.This would make a useful contributionin addressing complaintsrelating to the grant of patents ontraditional knowledge.The Committee also approved furtherwork on the establishment ofmodel intellectual property clausesfor contractual agreements regulatingaccess to and benefit-sharing ingenetic resources. This could involvethe establishment of a databaseof model clauses submitted bystates and other stakeholders toserve as a guide in the negotiationof contracts.The IGC also discussed interim reportson traditional knowledge andfolklore that used empirical informationprovided by states to describethe extent to which the traditionalintellectual property systemis sufficient in addressing theseforms of knowledge. Final reportswill be considered at the thirdmeeting that is scheduled in June.In this regard, work will also continueto identify those componentsof traditional knowledge that mightbe protected by intellectual propertyrights.The IGC reaffirmed that <strong>WIPO</strong>should continue to address theseissues in collaboration, where appropriate,with the secretariat of theConvention on Biological Diversity(CBD) and the Food and AgricultureOrganization (FAO) and itsCommission on Genetic Resources,as well as the United Nations Educational,Scientific and CulturalOrganization (UNESCO).¨The Patent Cooperation Treaty(PCT) set a new record last yearwhen the 100,000 th internationalpatent application filed under theTreaty was received at <strong>WIPO</strong> inDecember. In the PCT’s 23-yearhistory, this is the largest numberof applications filed in a singleyear. In 2000, the PCT received90,948 international applications– representing a notional equivalentof just under 8.5 million nationalpatent applications – whichitself was a 22.9 percent increaseon figures for 1999. Since the PCTcame into force in 1978, morethan 600,000 international applicationshave been filed.


EFFORTS TO HARMONIZETRADEMARK LAWMOVE AHEAD5<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong>By filing a patent application underthe PCT, an applicant may applyfor patent protection in anyor all of the 115 PCT memberstates. This significantly reducesthe time and money invested inobtaining patent protection. ThePCT does not grant patents, butit contributes significantly to theprocess of seeking patent protectionin multiple countries.Initial statistics also show a significantincrease in use of thePCT by nationals from developingcountries. Last year’s largestnumber of users from developingcountries came from the Republicof Korea, China, South Africa,and India.A comprehensive effort at reformof the PCT has been underwayduring the last four years, includingefforts towards automation,lowering of fees, and simplificationof the treaty. Fee reductionshave been implemented for fiveconsecutive years, leading to atotal 45 percent reduction in feessince 1998.¨<strong>WIPO</strong> member States have agreedto move forward with a comprehensiveprogram of harmonization oflaws for the protection of marks. Ata meeting of the Standing Committeeon the Law of Trademarks, IndustrialDesigns and GeographicalIndications (SCT) in Geneva inDecember, negotiators committedto a program of work that aims tofurther simplify and streamline thetrademark procedures and to initiateharmonization of substantivetrademark law.The decision to move ahead withfurther harmonization efforts followsthe adoption of the Joint Recommendationon the Protection of Well-Known Marks (1999), the Joint Recommendationon TrademarkLicenses (2000) and the Joint Recommendationon the Protection ofMarks on the Internet (2001).Trademark formality requirementsare currently governed by the<strong>WIPO</strong> Trademark Law Treaty (TLT),concluded in 1994, which servesto harmonize and simplify the formalrequirements involved in trademarkprocedures. The SCT agreedto build on the TLT and to furthersimplify and expand the harmonizationof formalities by introducingprovisions for electronic filing,incorporating provisions containedin the <strong>WIPO</strong> Joint Recommendationon Trademark Licenses or offeringrelief in regard to variousformal mistakes and time limits.Photo: Mercedes Martínez DozalThe SCT also decided to initiatework on harmonization of substantivetrademark law, particularlyconcerning non-traditional marks(for instance, color marks, smellmarks, three-dimensional marks) orconflicts with prior rights. 6<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong>DOMAIN NAMECASES AT THEARBITRATION CENTERThe <strong>WIPO</strong> Arbitration and MediationCenter received 3,192 domainname cases during 2001, a 72 percentincrease over the previousyear. Since December 1999, theCenter has received 5,053 complaintsinvolving parties from 100countries.On December 12, the Center receivedits first .biz domain casefiled under the Uniform DisputeResolution Policy (UDRP), and onDecember 14 the first <strong>WIPO</strong> paneldecision concerning a .info domainname under the UDRP was issued.The Center also administered 25complaints in relation to non-Romanscript or “internationalized”domain names, which also becameavailable during the year.From August 28 to December 26,the Center received “sunrise challenges”against domain names registeredin the .info domain. Thesechallenges were part of the “sunriseregistration period” (July 25 -August 28, 2001) during whichtrademark owners could file a domainname application before thegeneral public involving a domainname that is identical to the textualelements of a trademark which theyowned, and which had national effectprior to October 2, 2000.Compliance with these conditionswas not examined at the entrylevel,but any person could submita challenge against domain namesregistered during the sunrise registrationperiod, alleging non-compliancewith the sunrise registrationconditions. Such challenges weresubject to the Afilias Sunrise ChallengePolicy for .info. Challengescould only be filed between August28 and December 26, 2001.The Center was the exclusive disputeresolution service provider forsunrise challenges and received atotal of 1,579 challenges, including656 in December. By the endof the year, the Center had alreadyresolved some 600 of these challenges.Some 53 cases have alsobeen filed under the special introductorymechanism for .biz, theStart-up Trademark OppositionPolicy (STOP). As of January 15,<strong>2002</strong>, the date on which .name becamefully operative, the Centerwill administer cases filed underthe specific dispute policy for thatregistry, the Eligibility RequirementsDispute Resolution Policy for.name (ERDRP).The <strong>WIPO</strong> Arbitration and MediationCenter is the leading providerof online domain name disputeresolution services worldwide andthe only international not-for profitinstitution offering this service. TheCenter administers the great majorityof all domain name cases filedunder various policies, includingthe UDRP, which was adopted atthe recommendation of <strong>WIPO</strong>, aswell as new policies developed bythe new generic Top Level Domains(new gTLDs). PROMOTING IPIN PUBLICADMINISTRATIONS7<strong>WIPO</strong> <strong>Magazine</strong>/February <strong>2002</strong><strong>WIPO</strong> took a novel approach to thepromotion of intellectual propertyby stressing the role that publicadministrations can play in thisarea during a workshop in HongKong, Special Administrative Region(SAR), China from December12 to 14. The workshop examinedthe relationship between the intellectualproperty system and variousaspects of public administration,and explored measures forimproving awareness of the intellectualproperty system and its rolein national development.The workshop, organized by <strong>WIPO</strong>in cooperation with the IntellectualProperty Department (IPD) and theCivil Service Training and DevelopmentInstitute (CSTDI) of theGovernment of Hong Kong SAR,attracted some 26 foreign and 20local participants.The workshop got underway witha keynote speech by <strong>WIPO</strong> DeputyDirector General Rita Hayes thathighlighted the most recent developmentsin the intellectual propertyarena. An introduction to intellectualproperty, <strong>WIPO</strong>, and itstreaties was also provided.The workshop explored the followingthemes:wpromoting intellectual propertyprotection and management: therole of the public service;wwwwwwidentifying and maximizing publicintellectual property assetsand minimizing the risk of intellectualproperty infringement;enforcement of intellectualproperty rights;intellectual property rights ofgovernment in contracts;enhancing compliance with theintellectual property system bythe public service;developing web-based resourcesfor public sector intellectualproperty training;policy and strategy considerationsfor public service educationand training in intellectualproperty.Speakers in the workshop stressedthe need to identify and maximizepublic intellectual property assetsand to minimize the risk of infringement,noting that in many developingcountries research and developmentactivities are still verymuch in the hands of the publicsector. They noted that, as governmentis still a major investor in researchand development activitiesin public universities and researchinstitutions, it is crucial to create asupportive environment for theseactivities. This includes makingpublic intellectual property assetsrelevant to industries and the public,providing incentives for inventiveactivities, as well as creating a”critical mass” of intellectual propertyliterate citizens through awarenessbuilding.Discussions on the aspect of intellectualproperty rights in governmentcontracts included cautionarymeasures for the public service,i.e., developing means to minimizethe risk of infringement of intellectualproperty rights of others andto promote intellectual propertycompliance in contracts.The experience of the public servicesof the government of HongKong SAR was discussed as an exampleof how to enhance compliancewith the intellectual propertysystem. The IPD lauched an intellectualproperty compliance officerscheme in January 2000, underwhich, within the cadre system ofthe government, the heads of departmentsappointed about 150compliance officers with the objectiveof promoting awareness withinthe government and ensuring compliancewith intellectual propertystandards and guidelines.¨Conference participantsin Hong Kong

Marketingand innovation produce results;all the rest are costs.” These twobasic functions guide the underlyingdesire of a business to make amonetary profit in the process ofproviding quality products and servicesto customers. Intellectualproperty plays a role in both ofthese functions, and specificallytrademarks are of primary importancein the marketing process.Every product in the market facescompeting products that are oftenalmost identical, similar or goodsubstitutes. Meeting or exceedingcustomers’ expectations is a challengingtask, especially when tastesand preferences continuouslyevolve in a competitive marketplace,with many similar productscatering for the same need. Onlybusinesses that can meet thesechallenges can expect to developand retain a loyal clientele.Distinguishing Productsfrom OthersTo develop trust, confidence andloyalty in its products, every businesshas to develop and maintain adistinct identity, image or reputation.Only then is it able to distinguishitself and its products fromthose of its competitors. It mustalso, at the same time, provide amechanism for linking the providerof a product to the valuable businessassets of trust and goodwill.Businesses achieve this mostlythrough a distinctive trade nameand one or more trademarks.These play a pivotal role in themarketing strategy of differentiatingproducts from those of rivals andin developing longer-term positive– and often emotional – relationshipswith customers by communicatingan assiduously nurtured imageor reputation. Every businessmust woo customers to move themquickly from brand awareness, viabrand recognition, to brand preferenceand finally to brand insistence,a point at which the consumerrefuses to accept alternativesand is willing to pay an even higherpremium for the desired brandedproduct.The popular terms used in marketingjargon, “brand” or “brandname” are interchangeable with“trademark,” the term used in intellectualproperty legal circles. Ofcourse, a product brand or a corporatebrand is a much larger conceptthan a mere trademark, asbuilding a strong brand and establishingthe brand equity of a businessis a bigger challenge thanchoosing, registering, or maintainingone or more trademarks. Strongbrands and successful brandinggenerally refers to successes interms of contribution to marketshare, sales, profit margins, loyaltyand market awareness. However,the ultimate success of a brand isalso judged in terms of the totalvalue derived by the customer fromthe product to which it relates.Designing a TrademarkBusinesses often use a portfolio oftrademarks for diversifying theirmarket strategy to meet the expectationsof different target groups inthe same or different countries.Building a strong brand image is noeasy task. Use of trademarks foreffective marketing of products requiresan excellent knowledge oftrademark law and practice at thenational and international levels –seeking professional guidance becomesnecessary, as this is a specializedtask. However, a few basicelements must be kept in mindfor the design of a good trademark.Trademarks shouldwwwwwbe inherently distinctive,be easy to memorize and pronounce,fit the product or image of thebusiness,have no legal restrictions, andhave a positive connotation.A brand/trademark may be a word,letter, symbol (logo), number, color,shape or, where the legislation ofthe country so allows, sound orsmell, or a combination of one ormore of these elements.<strong>No</strong>kia US$35 billion(estimated market value)© <strong>No</strong>kia

Accordingto a recent survey of businesses insome developed economies, it representsjust over 10 percent of thetotal value of the firm in the industrialsector, around 40 percent inthe financial services and the automotivesectors and as much as 70to 90 percent in the food or luxurygoods sector.In absolute terms the value of abrand, excluding the value of itsother intellectual property and intangibleassets, may be a phenomenalsum. Results from theInterbrand 2001 annual survey ofthe world’s most valuable globalbrands in the box above clearlydemonstrate this point. As such,trademarks/brands are extremelyvaluable assets, which need carefulhandling, care, nurturing andprotection; otherwise they may losevalue, be stolen or simply be destroyedor lost.Protect your TrademarksA major step in eliminating wastefulexpense and reducing risk is toregister the trademark early so thatit is legally secure and others cannotfree-ride on it. This is oftendone well before test marketing thenew product to avoid incurring expenseon advertising and other promotionalactivities, only to discoverthe brand name is not available.Some countries do provide a degreeof protection to unregistered trademarks,but in most countries protectionis contingent upon successfulregistration. Many countries allowregistration without prior use,but the trademark may be cancelledif it is not used in the marketplacein relation to the product for a certainperiod of time. It is easier todeal with the willful free-riding,known as counterfeiting of a trademarkand with gray market products(so-called parallel imports) ifthe trademark is validly registered.Informed businesses take activesteps to educate employees, dealers,distributors, newspaper editors,publishers of encyclopedias and thepublic that their trademark identifiestheir specific products aloneand therefore should be used in aproper manner.Another major step that must betaken by every business is to annuallyreview its portfolio of trademarksto check whether timely actionhas been taken to (1) registerall trademarks in use or proposedto be used in the domestic or exportmarkets, (2) record licensing ofa trademark if required under thetrademark law; (3) adequately controlthe quality of the product providedby a trademark licensee orfranchisee; and (4) renew trademarkregistrations.The next article in IP and Businesswill discuss the role of industrialdesigns in marketing.¨

This councilwas a pioneer in Brazil, creatingthe first national statutes for a geographicalindication, as well as itsrules and procedures. The local producersrespect the technical rulesin the document, and their productsare steadily improving in qualityand standard, and gaining widespreadrecognition in national andinternational circles.In Pursuit of aGeographical IndicationThe local wine producers carriedout a number of activities in orderto have a geographical indicationtitle granted. Initially, they createdAPROVALE, which included notonly the wine-growing establishmentsof the valley but all enterprisesconnected with tourism,agribusiness and the supply ofvinicultural inputs. Its principalmission: to develop and motivateresearch connected with viticultureto preserve and protect the geographicalindication of the wines inthe region.The Association developed a programthat aims at making the regioninto a national – and perhaps international– point of reference forproducts related to wine. For theimplementation of this project, therecognition of a geographical indicationwould be a positive factor, asit would bring an increase in consumptionand tourism and motivatemore producers to install winegrowingestablishments in the area.The Association ordered, in cooperationwith the Foundation of Supportto Research of the State of RioGrande do Sul (FAPERGS), a studyon the necessary specific knowledgefor a geographical indication. Theinstitutions involved with thisproject were the Brazilian Enterprisefor Agricultural Studies (EMBRAPA)and the University of Caxias do Sul(UCS). In 1999, the results werepublished in a book called “Valedos Vinhedos - CaracterizaçãoGeográfica da Região” (Vineyards’Valley - Geographical Characterizationof the Region).The example of the Vale dosVinhedos has stimulated other producersto consider the acquisitionof a national certificate of geographicalindication to strengthentheir products’ position on the internationalmarket and consolidateBrazil’s image as a developingcountry of great wealth and resources.The <strong>WIPO</strong> <strong>Magazine</strong> acknowledgesthe assistance of University ofCaxias do Sul and the Brazilian EnterpriseAgricultural Studies(EMBRAPA) in the preparation ofthis article.¨
